IMPLEMENTING RULES AND REGULATIONS OF THE ENHANCED BASIC EDUCATION ACT OF 2013 (REPUBLIC ACT NO.

10533) Pursuant to Section 16 of Republic Act No. 10533, entitled An Act Enhancing the Philippine Basic Education System by Strengthening Its Curriculum and Increasing the Number of Years for Basic Education, Appropriating unds !herefor and for "ther Purposes,# otherwise known as the Enhanced Basic Education Act of $%&',#appro ed on !a" 15, #013, and which took effect on $une %, #013, the &epart'ent of (ducation )&ep(d*, the +o''ission on ,i-her (ducation )+,(&*, and the .echnical (ducation and Skills &e elop'ent Authorit" ).(S&A*, hereb" issue the followin- rules and re-ulations to i'ple'ent the pro isions of the Act. RULE I. GENERAL PROVISIONS Sect !" 1. T t#e. .hese rules and re-ulations shall be referred to as the Implementing (ules and (egulations )I((* of the Enhanced Basic Education Act of $%&'# )(epublic Act No+ &%,''*+ Sect !" 2. Sc!$e %"& A$$# c%t !". .he pro isions of this /RR shall pri'aril" appl" to all public and pri ate basic educational institutions and learnin- centers. .his /RR shall also appl" to ,i-her (ducation /nstitutions ),(/s*, .echnical0 1ocational /nstitutions ).1/s*, dul" reco-ni2ed or-ani2ations actin- as .eacher (ducation /nstitutions ).(/s*, and foundations. Sect !" 3. Dec#%'%t !" !( P!# c). .his /RR shall be interpreted in li-ht of the &eclaration of Polic" found in Section # of the Act. Sect !" *. De( " t !" !( Te'+,. 3or purposes of this /RR, the followin- ter's shall 'ean or be understood as follows4 )a* Act refers to Republic Act No. 10533, entitled 5 An Act Enhancing the Philippine Basic Education System by Strengthening Its Curriculum and Increasing the Number of Years for Basic Education, Appropriating unds !herefor and for "ther Purposes,# other-ise .no-n as the Enhanced Basic Education Act of $%&'+# )b* Learning Center refers to a ph"sical space to house learnin- resources and facilities of a learnin- pro-ra' for out0of0school "outh and adults. /t is a enue for face0to0face learnin- acti ities and other learnin- opportunities for co''unit" de elop'ent and i'pro e'ent of the people6s 7ualit" of life. .his 'a" also be referred to as 5Community /earning Center# authori2ed or reco-ni2ed b" the &ep(d.

)c* Learner refers to a pupil or student, or to a learner in the alternati e learnins"ste'. )d* Mother Language or First Language (L1) refers to the lan-ua-e or lan-ua-es first learned b" a child, which he8she identifies with, is identified as a nati e lan-ua-e user of b" others, which he8she knows best, or uses 'ost. .his includes 3ilipino si-n lan-ua-e used b" indi iduals with pertinent disabilities. .he re-ional or nati e lan-ua-e refers to the traditional speech ariet" or ariet" of 3ilipino si-n lan-ua-e e9istin- in a re-ion, area or place. )e* Non-DepEd Public School refers to a public school offerin- basic education operated b" an a-enc" of the national -o ern'ent other than the &ep(d, or b" a local -o ern'ent unit. Sect !" 5. B%, c E&-c%t !". Pursuant to Section 3 of the Act, basic education is intended to 'eet basic learnin- needs which pro ides the foundation on which subse7uent learnin- can be based. /t enco'passes kinder-arten, ele'entar", and secondar" education as well as alternati e learnin- s"ste's for out0of0school learners and those with special needs under Section % of this /RR. Sect !" .. E"/%"ce& B%, c E&-c%t !" P'!0'%+. 3or purposes of this /RR and pursuant to Section : of the Act, the enhanced basic education pro-ra' enco'passes at least one )1* "ear of kinder-arten education, si9 )6* "ears of ele'entar" education, and si9 )6* "ears of secondar" education, in that se7uence. Secondar" education includes four ):* "ears of ;unior hi-h school and two )#* "ears of senior hi-h school education. .he enhanced basic education pro-ra' 'a" likewise be deli ered throu-h the alternati e learnin- s"ste'. 1 "&e'0%'te" E&-c%t !" is the first sta-e of co'pulsor" and 'andator" for'al education which consists of one )1* "ear of preparator" education for children at least fi e )5* "ears old as a prere7uisite for <rade 1. E#e+e"t%') E&-c%t !" refers to the second sta-e of co'pulsor" basic education which is co'posed of si9 )6* "ears. .he entrant a-e to this le el is t"picall" si9 )6* "ears old. Sec!"&%') E&-c%t !" refers to the third sta-e of co'pulsor" basic education. /t consists of four ):* "ears of ;unior hi-h school education and two )#* "ears of senior hi-h school education. .he entrant a-e to the ;unior and senior hi-h school le els are t"picall" twel e )1#* and si9teen )16* "ears old, respecti el".

.he &ep(d 'a" allow pri ate educational institutions fle9ibilit" in adoptin- the pro-ra' pro ided that the" co'pl" with the &ep(d0prescribed 'ini'u' standards consistent with the Act. Sect !" 2. C!+$-#,!') B%, c E&-c%t !". /t shall be co'pulsor" for e er" parent or -uardian or other persons ha in- custod" of a child to enroll such child in basic education, irrespecti e of learnin- deli er" 'odes and s"ste's, until its co'pletion, as pro ided for b" e9istin- laws, rules and re-ulations. Sect !" 3. I"c#-, 4e"e,, !( E"/%"ce& B%, c E&-c%t !". /n furtherance of Section 3 of the Act, inclusi eness of enhanced basic education shall 'ean the i'ple'entation of pro-ra's desi-ned to address the ph"sical, intellectual, ps"chosocial, and cultural needs of learners, which shall include, but shall not be li'ited to, the followin-4 3.1. P'!0'%+, (!' t/e G (te& %"& T%#e"te& . .hese shall refer to co'prehensi e pro-ra's for the -ifted and talented learners in all le els of basic education. 3.2. P'!0'%+, (!' Le%'"e', 5 t/ D ,%6 # t e,. .hese shall refer to the co'prehensi e pro-ra's desi-ned for learners with disabilities which 'a" be ho'e0, school0, center0 or co''unit"0based. 3.3. M%&'%,%/ P'!0'%+. .his shall refer to the co'prehensi e pro-ra' usin- the !adrasah curriculu' prescribed b" the &ep(d, in coordination with the +o''ission on !usli' 3ilipinos, for !usli' learners in public and pri ate schools. 3.*. I"& 0e"!-, Pe!$#e, (IP) E&-c%t !" P'!0'%+. .his shall refer to the pro-ra' that supports education initiati es undertaken throu-h for'al, non0for'al, and infor'al 'odalities with e'phasis on an" of, but not li'ited to, the ke" areas of4 /ndi-enous =nowled-e S"ste's and Practices and co''unit" histor"> indi-enous lan-ua-es> /ndi-enous ?earnin- S"ste' )/?S* and co''unit" life c"cle0based curriculu' and assess'ent> educational -oals, aspirations, and co'petencies specific to the /ndi-enous +ultural +o''unit" )/++*> en-a-e'ent of elders and other co''unit" 'e'bers in the teachin-0learnin- process, assess'ent, and 'ana-e'ent of the initiati e, reco-nition and continuin- practice of the co''unit"6s /?S> and the ri-hts and responsibilities of /++s. 3.5. P'!0'%+, (!' Le%'"e', -"&e' D (( c-#t C 'c-+,t%"ce,. .his shall refer to the ti'el" and responsi e pro-ra's for learners under difficult circu'stances, such as, but not li'ited to4 -eo-raphic isolation> chronic illness> displace'ent due to ar'ed conflict, urban resettle'ent, or disasters> child abuse and child labor practices.

Sect !" 7. Acce#e'%t !". Acceleration of learners in public and pri ate basic educational institutions shall be allowed, consistent with &ep(d rules and re-ulations. RULE II. CURRICULUM Sect !" 10. B%, c E&-c%t !" C-'' c-#-+ De4e#!$+e"t. /n the de elop'ent of the @asic (ducation +urriculu', the &ep(d shall be -uided b" the followin-4 10.1 F!'+-#%t !" %"& De, 0". Pursuant to Section 5 of the Act, the &ep(d shall for'ulate the desi-n and details of the enhanced basic education curriculu'. .he &ep(d shall work with the +,(& and .(S&A to craft har'oni2ed basic, tertiar", and technical0 ocational education curricula for 3ilipino -raduates to be locall" and -loball" co'petiti e. 10.2. St%"&%'&, %"& P' "c $#e,. .he &ep(d shall adhere to the followinstandards and principles, when appropriate, in de elopin- the enhanced basic education curriculu'4 )a* .he curriculu' shall be learner0centered, inclusi e and de elop'entall" appropriate> )b* .he curriculu' shall be rele ant, responsi e and research0based> )c* .he curriculu' shall be -ender0 and culture0sensiti e> )d* .he curriculu' shall be conte9tuali2ed and -lobal> )e* .he curriculu' shall use peda-o-ical approaches that are constructi ist, in7uir"0based, reflecti e, collaborati e and inte-rati e> )f* .he curriculu' shall adhere to the principles and fra'ework of !other .on-ue0@ased !ultilin-ual (ducation )!.@0!?(* which starts fro' where the learners are and fro' what the" alread" know proceedin- fro' the known to the unknown> instructional 'aterials and capable teachers to i'ple'ent the !.@0 !?( curriculu' shall be a ailable. 3or this purpose, !.@0!?( refers to for'al or non0for'al education in which the learner6s 'other ton-ue and additional lan-ua-es are used in the classroo'> )-* .he curriculu' shall use the spiral pro-ression approach to ensure 'aster" of knowled-e and skills after each le el> and )h* .he curriculu' shall be fle9ible enou-h to enable and allow schools to locali2e, indi-eni2e and enhance the sa'e based on their respecti e educational and social conte9ts.

10.3. P'!&-ct !" %"& De4e#!$+e"t !( M%te' %#,. .he production and de elop'ent of locall" produced teachin- and learnin- 'aterials shall be encoura-ed. .he appro al of these 'aterials shall be de ol ed to the re-ional and di ision education unit in accordance with national policies and standards. 10.*. Me& -+ !( Te%c/ "0 %"& Le%'" "0. Pursuant to Sections : and 5 of the Act, basic education shall be deli ered in lan-ua-es understood b" the learners as lan-ua-e pla"s a strate-ic role in shapin- the for'ati e "ears of learners. .he curriculu' shall de elop proficienc" in 3ilipino and (n-lish, pro ided that the first and do'inant lan-ua-e of the learners shall ser e as the funda'ental lan-ua-e of education. 3or =inder-arten and the first three "ears of ele'entar" education, instruction, teachin- 'aterials, and assess'ent shall be in the re-ional or nati e lan-ua-e of the learners. .he &ep(d shall for'ulate a 'other lan-ua-e transition pro-ra' fro' the 'other8first lan-ua-e to the subse7uent lan-ua-es of the curriculu' that is appropriate to the lan-ua-e capacit" and needs of learners fro' <rade : to <rade 6. 3ilipino and (n-lish shall be -raduall" introduced as lan-ua-es of instruction until such ti'e when these two )#* lan-ua-es can beco'e the pri'ar" lan-ua-es of instruction at the secondar" le el. 10.5. St%8e/!#&e' P%'t c $%t !". .o achie e an enhanced and responsi e basic education curriculu', the &ep(d shall undertake consultations with other national -o ern'ent a-encies and other stakeholders includin-, but not li'ited to, the &epart'ent of ?abor and ('plo"'ent )&A?(*, the Professional Re-ulation +o''ission )PR+*, pri ate and public schools associations, national student or-ani2ations, national teacher or-ani2ations, parents0teachers associations, cha'bers of co''erce and other industr" associations, on 'atters affectin- the concerned stakeholders. Sect !" 11 C-'' c-#-+ C!",-#t%t 4e C!++ ttee. Pursuant to Section 6 of the Act, a +urriculu' +onsultati e +o''ittee shall be created, to be chaired b" the &ep(d Secretar" or his8her dul" authori2ed representati e, and with 'e'bers co'posed of, but not li'ited to, a representati e each fro' the +,(&, .(S&A, &A?(, PR+, the &epart'ent of Science and .echnolo-" )&AS.*, and a representati e fro' business cha'bers such as the /nfor'ation .echnolo-" B @usiness Process Autsourcin- )/.0@PA* industr" association. .he +onsultati e +o''ittee shall o ersee the re iew and e aluation of the i'ple'entation of the enhanced basic education curriculu' and 'a" reco''end to the &ep(d the for'ulation of necessar" refine'ents in the curriculu'. RULE III. TEACHER 9UALIFICATIONS: TRAINING AND CONTINUING PROFESSIONAL DEVELOPMENT

Sect !" 12. Te%c/e' E&-c%t !" %"& T'% " "0. .o ensure that the enhanced basic education pro-ra' 'eets the de'and for 7ualit" teachers and school leaders, the &ep(d, +,(&, and .(S&A shall conduct teacher education and traininpro-ra's, in collaboration with rele ant partners in -o ern'ent, acade'e, industr", and non0-o ern'ental or-ani2ations. Such professional de elop'ent pro-ra's shall be initiated, conducted and e aluated re-ularl" throu-hout the "ear to ensure constant up-radin- of teacher skills. .eacher education and traininpro-ra's shall include, but shall not be li'ited to4 12.1. I";,e'4 ce T'% " "0 !" C!"te"t %"& Pe&%0!0). &ep(d teachers who will i'ple'ent the enhanced basic education curriculu' but ha e not under-one pre0 ser ice education that is ali-ned with the enhanced basic education curriculu' shall be trained to 'eet the content and perfor'ance standards of the enhanced basic education curriculu'. .he &ep(d shall ensure that pri ate educational institutions shall be -i en the opportunit" to a ail of such trainin-. 12.2. T'% " "0 !( Ne5 Te%c/e',. New -raduates of the .eacher (ducation curriculu' not ali-ned with the enhanced basic education curriculu' shall under-o additional trainin-, upon hirin-, to up-rade their co'petencies and skills to the content and perfor'ance standards of the new curriculu'. 3urther'ore, the +,(&, in coordination with the &ep(d and rele ant stakeholders, shall ensure that the .eacher (ducation curriculu' offered in these .(/s will 'eet the necessar" 7ualit" standards for new teachers. &ul" reco-ni2ed or-ani2ations actin- as .(/s, in coordination with the &ep(d, +,(&, and other rele ant stakeholders, shall ensure that the curriculu' of these or-ani2ations 'eets the necessar" 7ualit" standards for trained teachers. 3or purposes of this subpara-raph, the ter' duly recogni0ed organi0ations acting as !EIs# refers to or-ani2ations, other than schools or ,(/s, contracted out b" the &ep(d durin- the transition and for a fi9ed period, to pro ide teacher trainin- for purposes of retoolin- the -raduates of the .eacher (ducation curriculu', and onl" in such areas where there is a shorta-e of trained teachers. 12.3. T'% " "0 !( Sc/!!# Le%&e',/ $. Superintendents, principals, sub;ect area coordinators, and other instructional school leaders shall likewise under-o workshops and trainin- to enhance their skills on their roles as acade'ic, ad'inistrati e, and co''unit" leaders. 12.*. T'% " "0 !( A#te'"%t 4e Le%'" "0 S),te+ (ALS) C!!'& "%t!',: I",t'-ct !"%# M%"%0e',: M!6 #e Te%c/e',: %"& Le%'" "0 F%c # t%t!',. A?S

coordinators, instructional 'ana-ers, 'obile teachers, and learnin- facilitators shall likewise under-o workshops and trainin- to enhance their skills on their roles as acade'ic, ad'inistrati e, and co''unit" leaders. Sect !" 13. H ' "0 !( Ot/e' Te%c/e',. Notwithstandin- the pro isions of Sections #6, #C and #% of Republic Act No. C%36, otherwise known as the 5Philippine !eachers Professionali0ation Act of &112,D the &ep(d and pri ate educational institutions shall hire, as 'a" be rele ant to the particular sub;ect4 13.1. <raduates of science, 'athe'atics, statistics, en-ineerin-, 'usic and other de-ree courses needed to teach in their speciali2ed sub;ects in ele'entar" and secondar" education with shorta-es in 7ualified applicants who ha e passed the ?icensure (9a'ination for .eachers )?(.*. .he" shall also include -raduates ad'itted b" foundations dul" reco-ni2ed for their e9pertise in the education sector and who satisfactoril" co'plete the re7uire'ents set b" these or-ani2ations> Pro3ided, .hat the" pass the ?(. within fi e )5* "ears after their date of hirin-> Pro3ided, further, .hat if such -raduates are willin- to teach in basic education on part0ti'e basis, the pro isions of ?(. shall no lon-er be re7uired. .he ter' foundations,# as used in this section, refers to non0stock, non0profit or-ani2ations, which are not operatin- as educational institutions, contracted out b" the &ep(d for a fi9ed period, to pro ide olunteers to teach in basic education in areas where there is a shorta-e of 7ualified teachers. .he &ep(d shall issue the -uidelines and procedures for selection and eli-ibilit" of these or-ani2ations. 13.2. <raduates of technical0 ocational courses to teach in their speciali2ed sub;ects in the secondar" education> Pro3ided, .hat these -raduates possess the necessar" certification issued b" .(S&A> Pro3ided, further, .hat the" under-o appropriate in0ser ice trainin- to be ad'inistered b" the &ep(d or ,(/s at the e9pense of the &ep(d. .he &ep(d shall pro ide ad'inistrati e support to pri ate educational institutions for the in0ser ice trainin- of their teachers on the enhanced basic education curriculu'. 13.3. 3acult" of ,(/s to teach in their -eneral education or sub;ect specialties in secondar" education> Pro3ided, .hat the facult" 'ust be a holder of a rele ant @achelor6s de-ree, and 'ust ha e satisfactoril" ser ed as a full0ti'e ,(/ facult"> 13.*. .he &ep(d and pri ate educational institutions 'a" hire practitioners, with e9pertise in the speciali2ed learnin- areas offered b" the enhanced basic education curriculu', to teach in the secondar" le el4 Pro3ided, .hat the" teach on part0ti'e basis onl". 3or this purpose, the &ep(d, in coordination with the appropriate

-o ern'ent a-encies, shall deter'ine the necessar" 7ualification standards in hirin- these e9perts. RULE IV. PRIVATE EDUCATIONAL INSTITUTIONS Sect !" 1*. Re%,!"%6#e S-$e'4 , !" %"& Re0-#%t !". As a 'atter of polic" laid down in Article E/1, Section 5)1* of the 1F%C Philippine +onstitution, the State reco-ni2es the co'ple'entar" roles of public and pri ate institutions in the educational s"ste' and shall e9ercise reasonable super ision and re-ulation of all educational institutions. Sect !" 15. I,,-%"ce %"& Re4!c%t !" !( Pe'+ t, %"&<!' Rec!0" t !" !( P' 4%te Se" !' H 0/ Sc/!!#,. .he &ep(d shall re-ulate the offerin- of senior hi-h school in pri ate educational institutions. Pri ate educational institutions 'a" onl" offer senior hi-h school when so authori2ed b" the &ep(d. .he &ep(d shall prescribe the -uidelines on the issuance and re ocation of per'its and8or reco-nition of senior hi-h schools. Sect !" 1.. S$ec %# =%t !", " P' 4%te Se" !' H 0/ Sc/!!#. Pri ate educational institutions 'a" offer speciali2ations in senior hi-h school that are essential to the econo'ic and social de elop'ent of the nation, re-ion or localit". ?ocal planninin the de elop'ent of educational policies and pro-ra's shall be encoura-ed consistent with the State polic" to take into account re-ional and sectoral needs and conditions. RULE V. CAREER GUIDANCE AND COUNSELING ADVOCAC> Sect !" 12. C%'ee' G- &%"ce %"& C!-",e# "0 P'!0'%+,. +onsistent with Section F of the Act, to properl" -uide the students towards beco'in- producti e and contributin- indi iduals throu-h infor'ed career choices, the &ep(d, in coordination with the &A?(, .(S&A, +,(&, PR+, NG+, industr" associations, professional associations, and other rele ant stakeholders, shall pursue pro-ra's that e9pose students to the world and alue of work, and de elop the capabilit" of career counselors and ad ocates to -uide the students and e7uip the' with the necessar" life skills and alues. Sect !" 13. C%'ee' A&4!c%c) Act 4 t e,. +areer ad ocac" acti ities refer to acti ities that will -uide secondar" le el students in choosin- the career tracks that the" intend to pursue. +areer ad ocac" acti ities in ol e pro ision of career infor'ation and e9periences, ad isin-, coordinatin- and 'akin- referrals, and 'a" include, but are not li'ited to, career talks, career and ;ob fairs, parents6 orientations, and se'inar0workshops on career decision0'akin-.

Sect !" 17. C%'ee' A&4!c%te,. Notwithstandin- the pro isions of Section #C of Republic Act No. F#5%, otherwise known as the 4uidance and Counseling Act of $%%2,# career ad ocates shall be allowed to conduct career ad ocac" acti ities for secondar"0le el students of the schools where the" are currentl" e'plo"ed> Pro3ided, .hat the" under-o appropriate capacit" buildin- pro-ra's de eloped and i'ple'ented b" the &ep(d, in coordination with the &A?(, .(S&A, +,(&, PR+, NG+, student or-ani2ations, industr" associations, -uidance and counselin- associations, professional associations, and other rele ant stakeholders. +areer ad ocac" 'a" be conducted b" career ad ocates and peer facilitators. +onsistent with Section F of the Act, career ad ocates refer to career and e'plo"'ent -uidance counselors who are not re-istered and licensed -uidance counselors. +areer ad ocates include ho'eroo' ad isers and teachers of all learnin- areas who will i'ple'ent career ad ocac" acti ities. Peer facilitators are secondar"0le el students trained to assist career ad ocates in i'ple'entin- career ad ocac" acti ities. Sect !" 20. R!#e !( t/e De$E&. .he &ep(d shall4 )a* /nte-rate career concepts in the curriculu' and undertake teachin- in rele ant learnin- areas> )b* +onduct career assess'ents> )c* +onduct re-ular career ad ocac" acti ities> )d* +onduct continuous professionali2ation and capacit" buildin- of -uidance counselors, career ad ocates, and peer facilitators> )e* &e elop or accredit trainin- pro-ra's on career ad ocac"> )f* (stablish a career ad ocac" unit and pro ide ade7uate office space in hi-h schools> and )-* &esi-nate -uidance super isors at the di ision le el and career ad ocates at the school le el. RULE VI. E;GASTPE BENEFICIARIES AND OTHER FINANCING ARRANGEMENTS ?ITH PRIVATE EDUCATIONAL INSTITUTIONS AND NON;DEPED PUBLIC SCHOOLS Sect !" 21. E@$%", !" !( E;GASTPE Be"e( c %' e,. Pursuant to Section 10 of the Act, the &ep(d shall de elop pro-ra's of assistance that will e9tend the

A,, ,t%"ce t! 9-%# ( e& St-&e"t,. .he pro-ra's of assistance shall be 'ade a ailable pri'aril" to students who co'pleted ;unior hi-h school in public schools, takin- into account the inco'e back-round and financial needs of students, a ailable capacities of public, pri ate and non0&ep(d public schools in the localit", socio0econo'ic needs of re-ions, o erall perfor'ance of pri ate and non0&ep(d public schools, as well as -eo-raphic spread and si2e of the student population. .he pro-ra's of assistance 'a" also be 'ade a ailable to students who co'pleted ;unior hi-h school in pri ate educational institutions, whether these students are (0 <AS.P( beneficiaries or not, sub;ect to co'pliance with the 7ualifications and -uidelines to be deter'ined b" the &ep(d. Sect !" 23. F!'+, %"& A+!-"t !( A,, ,t%"ce. .he for's of assistance that 'a" be pro ided b" the &ep(d 'a" include an" of the followin-4 )a* A oucher s"ste', where -o ern'ent issues a coupon directl" to students to enable the' to enroll in eli-ible pri ate educational institutions or non0&ep(d public schools of their choice under a full or partial tuition or schoolin- subsid"> )b* (ducation Ser ice +ontractin- )(S+*, where the -o ern'ent enters into contracts with pri ate educational institutions or non0&ep(d public schools to shoulder the tuition and other fees of hi-h school students who shall enroll in pri ate hi-h schools under this pro-ra'> )c* !ana-e'ent contracts, where -o ern'ent enters into contractual arran-e'ents with pri ate educational institutions or non0&ep(d public schools to 'ana-e the da"0to0da" operations of public schools under a-reed perfor'ance tar-ets> )d* 3or's of assistance pro ided under Republic Act No. %5:5> and )e* Ather for's of financial arran-e'ents consistent with the principles of public0 pri ate partnership. .he &ep(d shall take into account the abilit" of pro-ra' beneficiaries to co er tuition differentials, if an", in settin- the a'ount of the oucher, (S+, or other for's of assistance. .he a'ount of assistance to be -i en b" the -o ern'ent shall not e9ceed the deter'ined per student cost in public schools.

Sect !" 2*. P%'t c $%t "0 Sc/!!#,. Pri ate educational institutions, non0&ep(d public schools, and other potential pro iders of basic learnin- needs that 'a" be authori2ed to offer senior hi-h school are eli-ible to participate in pro-ra's of assistance, as 'a" be applicable, under the (0<AS.P( pro-ra' and other financial arran-e'ents for'ulated b" the &ep(d and &@! based on the principles of public0pri ate partnership. .he continued participation of said pro iders in the (0<AS.P( pro-ra' and other financial arran-e'ents is sub;ect to their 'eetin'ini'u' re7uire'ents and standards, includin- student perfor'ance, as deter'ined b" the &ep(d. .o pro'ote partnership and -reater cooperation between public and pri ate educational institutions, -o ern'ent will take into account e9istin- and potential capacities of pri ate educational institutions in e9pandin- public school capacit". Sect !" 25. I+$#e+e"t%t !" Mec/%" ,+,. .he &ep(d 'a" enter into contractual arran-e'ents or establish new 'echanis's for the desi-n, ad'inistration, and super ision of pro-ra's of assistance or aspects thereof, sub;ect to the appro al of the appropriate -o ern'ent a-encies. 3or this purpose, the &ep(d shall4 )a* /ssue the appropriate -uidelines for the i'ple'entation of the pro-ra's of assistance> )b* (nsure transparenc" and accountabilit" in the i'ple'entation of the pro-ra's of assistance> )c* /'ple'ent infor'ation and ad ocac" pro-ra's to infor' the -eneral public and ensure -reater participation and a ail'ent of the pro-ra's of assistance> and )d* Hndertake periodic re iews of the pro-ra' features and 'ake ad;ust'ents, as necessar", to ensure the successful, effecti e and sustainable i'ple'entation of the pro-ra'. .he pro-ra' features shall include, a'on- others, a'ount of subsid", nu'ber of -rantees, eli-ibilit" re7uire'ents, and perfor'ance of participatinschools. Sect !" 2.. F-"& "0 ReA- 'e+e"t. .he bud-etar" re7uire'ent of the pro-ra's under this Rule shall be ensured b" the national -o ern'ent. .he &ep(d shall encoura-e pri ate and corporate donors to support the pro-ra's of assistance in this section under the fra'ework of Republic Act No. %5#5, entitled, An Act Establishing An 6Adopt7A7School Program,8 Pro3iding Incenti3es !herefor, And or "ther Purposes,# and other rele ant laws and policies.

Sect !" 22. T +e('%+e. .he &ep(d shall i'ple'ent the pro-ra's pro ided in this Rule no later than the start of School Gear #0160#01C. Sect !" 23. A&& t !"%# Be"e( c %' e,. .he &ep(d 'a" de elop si'ilar pro-ra's of assistance for kinder-arten and ele'entar" pupils and alternati e learnins"ste' learners in accordance with specific ob;ecti es, takin- into account the need and capacities of public and pri ate educational institutions. RULE VII. TRANSITOR> PROVISIONS Sect !" 27. P' 4%te B%, c E&-c%t !"%# I",t t-t !",B T'%", t !" t! t/e E"/%"ce& B%, c E&-c%t !" P'!0'%+. .he &ep(d shall ensure the s'ooth transition of pri ate ele'entar" and hi-h schools in the countr" that are not ali-ned with the enhanced basic education pro-ra'. Pri ate educational institutions or a -roup thereof shall de elop their plans detailin- how to transition fro' their current basic education s"ste' to the enhanced basic education pro-ra'. .he &ep(d shall pro ide the appropriate -uidelines on the e aluation of the transition plans. Pri ate educational institutions offerin- twel e )1#* to thirteen )13* "ears of basic education prior to the enact'ent of this Act shall sub'it to the &ep(d their transition plans within twel e )1#* 'onths fro' the effecti it" of this /RR, sub;ect to the -uidelines that will be issued b" the &ep(d. Sect !" 30. I+$#e+e"t%t !" Mec/%" ,+, %"& St'%te0 e,. Pursuant to Section 1# of the Act, the &ep(d, +,(& and .(S&A shall for'ulate the appropriate strate-ies and 'echanis's needed to ensure s'ooth transition fro' the e9istin- ten )10* "ears basic education c"cle to the enhanced basic education pro-ra'. .he strate-ies 'a" co er, a'on- others, chan-es in ph"sical infrastructure, hu'an resource, or-ani2ational and structural concerns, brid-in- 'odels linkinsecondar" education co'petencies and the entr" re7uire'ents of new tertiar" curricula, and partnerships between the -o ern'ent and other entities. !odelinfor Senior ,i-h School )S,S* 'a" be i'ple'ented in selected schools to si'ulate the transition process and pro ide concrete data for the transition plan followinthe -uidelines set b" the &ep(d. .he results of the S,S 'odelin- pro-ra' 'a" be considered in the nationwide i'ple'entation of the S,S pro-ra' in School Gear #0160#01C. 30.1. P%'t"e',/ $, 5 t/ HEI, %"& TVI,. .o 'ana-e the initial i'ple'entation of the enhanced basic education pro-ra' and 'iti-ate the e9pected 'ulti0"ear low enrol'ent turnout for ,(/s and .1/s startin- School Gear #0160#01C, the &ep(d shall en-a-e in partnerships with ,(/s and .1/s for the utili2ation of the latter6s hu'an and ph"sical resources, and issue rele ant -uidelines on such partnerships.

!oreo er, the &ep(d, +,(&, .(S&A, .1/s and ,(/s shall coordinate closel" with one another to i'ple'ent strate-ies that ensure the acade'ic, ph"sical, financial, and hu'an resource capabilities of ,(/s and .1/s to pro ide educational and trainin- ser ices for -raduates of the enhanced basic education pro-ra' to ensure that the" are not ad ersel" affected. .he facult" of ,(/s and .1/s allowed to teach students of secondar" education under Section % of the Act, shall be -i en priorit" in hirin- for the duration of the transition period. 30.2. F "%"c "0 F'%+e5!'8 (!' St%te U" 4e', t e, %"& C!##e0e, D-' "0 t/e T'%", t !" Pe' !&. .he +,(& and &@! shall re iew the financin- polic" fra'ework for State Hni ersities and +olle-es in li-ht of the Act with the end in iew of opti'i2in- the use of -o ern'ent resources for education, the results of which shall be co ered b" a ;oint ad'inistrati e issuance. 30.3. E((ect, !( I" t %# I+$#e+e"t%t !" !( t/e E"/%"ce& B%, c E&-c%t !" P'!0'%+ !" I"&-,t') H-+%" Re,!-'ce ReA- 'e+e"t,. .he &A?(, +,(&, &ep(d, .(S&A and PR+, in coordination with industr" associations and cha'bers of co''erce, shall de elop a contin-enc" plan, not later than the start of School Gear #0150#016, to 'iti-ate the effects of the enhanced basic education pro-ra' with respect to a potential reduction or absence of colle-e -raduates to 'eet the hu'an resource re7uire'ents of industr". .he plan shall contain 'iti-ation strate-ies for industries to ad;ust their e'plo"'ent policies as dee'ed necessar" and e9pedient, and 'a" include the adoption of other rele ant pro-ra's or appropriate 7ualifications. Sect !" 31. L%6!' %"& M%"%0e+e"t R 0/t,. /n the i'ple'entation of the Act, includin- the transition period, the ri-hts of labor as pro ided in the +onstitution, the +i il Ser ice Rules and Re-ulations, ?abor +ode of the Philippines, and e9istin- collecti e a-ree'ents, as well as the prero-ati es of 'ana-e'ent, shall be respected. .he &A?(, &ep(d, +,(& and .(S&A shall pro'ul-ate the appropriate ;oint ad'inistrati e issuance, within si9t" )60* da"s fro' the effecti it" of this /RR, to ensure the sustainabilit" of the pri ate and public educational institutions, and the pro'otion and protection of the ri-hts, interests and welfare of teachin- and non0teachin- personnel. 3or this purpose, the &A?( shall con ene a technical panel with representati es fro' the &ep(d, +,(&, .(S&A and representati es fro' both teachin- and non0 teachin- personnel or-ani2ations, and ad'inistrators of the educational institutions. Sect !" 32. T'%", t !" Pe' !&. .he transition period shall be reckoned fro' the date of the appro al of this /RR until the end of School Gear #0#10#0##.

RULE VIII. COINT CONGRESSIONAL OVERSIGHT COMMITTEE Sect !" 33. C! "t C!"0'e,, !"%# O4e', 0/t C!++ ttee !" t/e E"/%"ce& B%, c E&-c%t !" P'!0'%+. .he $oint +on-ressional A ersi-ht +o''ittee created under Section 13 of the Act shall be co'posed of fi e )5* 'e'bers each fro' the Senate and fro' the ,ouse, includin- +hairs of the +o''ittees on (ducation, Arts and +ulture, and 3inance of both ,ouses. .he 'e'bership of the +o''ittee for e er" ,ouse shall ha e at least two )#* opposition or 'inorit" 'e'bers. RULE ID. MANDATOR> EVALUATION AND REVIE? Sect !" 3*. M%"&%t!') E4%#-%t !" %"& Re4 e5. @" the end of School Gear #01:0#015, the &ep(d shall conduct a 'andator" re iew and sub'it a 'idter' report to +on-ress as to the status of i'ple'entation of the (nhanced @asic (ducation Pro-ra' in ter's of closin- the followin- current shorta-es4 )a* teachers> )b* classroo's> )c* te9tbooks> )d* seats> )e* toilets> )f* other shorta-es that should be addressed. .he &ep(d shall include a'on- others, in this 'idter' report, the followin- ke" 'etrics of access to and 7ualit" of basic education4 )a* participation rate> )b* retention rate> )c* National Achie e'ent .est results> )d* co'pletion rate> )e* teachers6 welfare and trainin- profiles> )f* ade7uac" of fundin- re7uire'ents> and )-* other learnin- facilities includin-, but not li'ited to, co'puter and science laboratories, libraries and librar" hubs> and sports, 'usic and arts. RULE D. COMMITMENT TO INTERNATIONAL BENCHMAR1S Sect !" 35. C!++ t+e"t t! I"te'"%t !"%# Be"c/+%'8,. .he &ep(d shall endea or to increase the per capita spendin- on education towards the i''ediate attain'ent of international bench'arks. .owards this end, the &ep(d shall seek to4 a* en-a-e local -o ern'ent units to efficientl" use the special education fund and other funds to ad ance and pro'ote basic education> b* i'ple'ent pro-ra's that will enhance pri ate sector participation and partnership in basic education> and c* propose an annual bud-et allocation in accordance with these -oals. .he &ep(d shall further de elop a 'ulti0"ear spendin- plan to ensure that the HN(S+A0 prescribed standards on education spendin- are attained. RULE DI. FINAL PROVISIONS

Pursuant to Section 11 of the Act, the initial fundinfor the operationali2ation of the (nhanced @asic (ducation Pro-ra' shall be char-ed a-ainst the current appropriations of the &ep(d. .hereafter, such su's which shall be necessar" for the continued i'ple'entation of the enhanced basic education pro-ra' shall be included in the annual <eneral Appropriations Act. Sect !" 32. I+$#e+e"t "0 Det% #,. .he &ep(d, +,(& and .(S&A 'a" issue such policies and -uidelines as 'a" be necessar" to further i'ple'ent this /RR. Sect !" 33. A+e"&+e"t. A'end'ents to this /RR shall be ;ointl" pro'ul-ated b" the &ep(d Secretar", +,(& +hairperson, and .(S&A &irector0<eneral. Sect !" 37. Se$%'%6 # t) C#%-,e. Should an" pro ision of this /RR be subse7uentl" declared in alid or unconstitutional, the sa'e shall not affect the alidit" and effecti it" of the other pro isions. Sect !" *0. Re$e%# "0 C#%-,e. Pursuant to Section 1% of the Act, rules and re-ulations i'ple'entin- the pertinent pro isions of Batas Pambansa Bilang $'$ or the Education Act of &19$,D Republic Act No. F155 or the 4o3ernance of Basic Education Act of $%%&,# Republic Act No. F#5%, Republic Act No. C%36, and all other laws, decrees, e9ecuti e orders and rules and re-ulations, contrar" to or inconsistent with the pro isions of the Act are dee'ed repealed or 'odified accordin-l".
