Torts Outline

- Harm is required for a tort and is about vindicating individual rights and redressing private harms. Intentional torts like battery require that the defendant intend to cause a harmful or offensive contact. There are two types of intent - purpose and knowledge with substantial certainty that the contact will result. The contact must be harmful or offensive to a reasonable person but need not actually cause physical injury. Consent is a defense to battery if the contact was consented to. Negligence involves failing to take reasonable care to prevent harm and is determined using a risk-utility analysis. Causation and damages must also be proven for any tort.
