Mr. Mohd. Moin Khan filed a consumer complaint against Xiaomi Technology Pvt. Ltd. and TVS Electronics Ltd. regarding a defective Mi Pad. PARTICULARS
Xiaomi tech private limited selling their product through different
dealer and other source. Mi pad sold to ghala through flipkart which
gives 1 year warranty for manufacturing defects by manufacture.
Mr. Mohd Moin khan is the user of said mi pad with permission of
ghala.
Manufacturing defects occurred on 8/12/2015 and said submitted
to authorized service center TVS Electronics Ltd. at vashi on
9/12/2015 after lots of complaint and efforts, opp. Party no.2 did
the faulty repair and return it back to me on 5/01/2016, again
submitted the faulty mi pad on 06/01/2016 with notice sent by post
and emails.
Opposite party no. 1 is the manufacturer and opposite party no. 2 is
authorized service center for repair of defects for product of
opposite party no.1.
The opposite parties have not removed defect from said mi pad till
date and still in possession of opposite party no.2.

May it please to your honour:

This complaint petition is being filed by Mr. Mohd. Moin Khan,Law Student,
residing at room no.1, Kasturi Bai Chawl, Sangam Gali, Sion dharavi road,
Mumbai-400017. , referred hereafter as complaint , and is as follows:

1. That the opposite Party no.1 engaged in the business of Manufacturing &
selling consumer durable like mobile and pad (tab) etc. , to the public for
consideration.
2. That opposite Party no. 2 is engaged in repair service for manufacturing
defect in the products of opposite party no.1
(Narration of the incident)
1. That Mi pad manufactured by Xiaomi Company was purchased by
Piyush Ghala from the Flipkart website on 08/04/2015 having its
invoice no. od202533834063853100 & Sr no. 991400045449,
Purchaser of above product given possession to Mohd. Moin Khan on
consideration by giving invoice and box, whereas Moin Khan is the
user of MI Pad (elect. Gadget).

That said Mi Pad abruptly stopped functioning on 8/12/2015 due to


manufacturing defect and the above mentioned Product was
submitted to opposite party no.2 on 9/12/2015 as it is an authorized
Service Center of opposite party no.1 as mi pad is under warranty.
According to them there was an issue with the mother board of the
Product. As the product was under warranty they told that the
motherboard should be replaced hence they made a Job Sheet no.
890090980 with different sr. no.864512478912545, according to
them system design for making a Job Sheet is based on mobiles
IMEI no. and not for Sr.no. and mi pad does not have IMEI no.

3. That the opposite party no.2 assured that said product would be
returned back on 22/12/2015. When I made the call to opposite party no.2
(9702032868) on 22/12/2015 they asked for some more time as the
replacing part (motherboard) was not available for defected said product by
opposite party no.1. I called customer care no. 180010336286 of opposite
party no.1 and said about the same problem of opposite party no.2 , they
gave me the same reply as opposite party no. 2.

4. That on 28/12/2015 I called customer care no. 180010336286, they


said me to wait for few more days. Later I sent an email to
sevice.in@xiaomi.com regarding my issue on 28/12/2015. They sent me a
reply on 28/12/2015 and told me to wait for few more days as according to
them they have escalated my issues to higher authority.

5. That again on 29/12/2015 I sent an email to sevice.in@xiaomi.com


regarding said issues, they sent an email in reply asking about details of my
issues and I replied to them on 30/12/2015 with my entire details of issues.
6. That mean while I kept on contacting opposite part no. 2 and customer
care no. 180010336286. I kept on asking about the date of return back but
they said to me that I will receive a sms if its ready.
7. That After long harassment, mental torture, I received my said mi pad
with replaced mother board in evening on 5/01/2016 and sr. no. of replaced
motherboard is 580014200000 . I didnt had the time to check. After
reaching home I checked the mi pad there was lots of issue and error. The
issues are with wifi connectivity and Bluetooth connectivity, camera. The
error was in the delivery document i.e. given below
(1) The old sr. no. 991400045449 is not mentioned in the said delivery
receipt.
(2) The DELIVER RECEIPT of replaced motherboard sr. no. 580014200000
did not match with mi pad sr. no. 991400082052 which is actually visible in
mi pad.
I immediately sent an email to the company register email id
sevice.in@xiaomi.com about the said repair issue and error.
9. That above said mi pad submitted to opposite party no.2 again on
6/01/2016 by me in the morning and reported the same issue and error
above mentioned the problem was again regarding the mother board and
till date the said product is still with opposite party no.2 possession. They
provided me a ref. number 927702 and 968441 for the call I made.

10. That I sent a notice on 6/01/2016 to opposite party no. 1 to remove


the defect and error in the said product within 7 days( customer service
head, xiaomi tech. pvt ltd., 8th floor , tower-1, umiya business bay ,
marathalli , sarajpure, over ring road, Banglore Karnatka-560103) and
opposite party no.2 .

EM886339784IN respectively with entire document and details .Which was


received on 9/01/16 and 8/01/16 respectively.

11. That till date there is no progress and no response from opposite party
no. 1 & 2. Due to delay in time for repair of the said product my warranty
period was lapsed.

12. That opposite party no.1 and 2 did not bother to honor till date that the
complainant is suffering due to non availability of mi pad.

13. That the opposite parties had supplied defective goods .

PRAYER
In the view of the submission of contained in the preceding paragraph, the
complainant most respectfully pray to the Honorable forum to direct the
opposite parties to :
(a) Refund the cost of mi pad of Rs 12999/- along with interest of 20%.
(b) Pay sum of Rs 30000/- towards physical strain and mental agony
suffered by my self and my family members (compensation); and
(c) Pay a sum of Rs 10000/- towards cost of this petition (cost);
for which act of kindness , the complainant shall, as is duty bound, ever
pray.
