AN ORDINANCE FURTHER REVISING TAX ORDINANCE NO. 7

SERIES OF 1980 ENTITLED AN ORDINANCE ESTABLISHING THE
ORMOC CITY BUS SERVICE TERMINAL

WHEREAS, Section 7 of R.A. 7160 or the Local Government Code of

1991 states that Local Governments shall endeavor to be self-reliant
and shall continue exercising the powers and discharging the duties
and functions currently vested upon them. Local Government Units
shall likewise exercise such other powers and discharge such other
functions and responsibilities as are necessary, appropriate, or
incidental to efficient and effective provision of the basic services and
facilities, including the establishment of public markets,
slaughterhouses and other enterprises, and adequate communication
and transportation facilities;

WHEREAS, Section 16 of the R.A. 7160 or the Local Government Code

of 1991 states that the Local Government Unit shall exercise the
powers expressly granted, those necessarily implied therefrom, as well
as powers necessary, appropriate, or incidental for its efficient and
effective governance, and those which are essential to the promotion
of the general welfare;

WHEREAS, establishing the guidelines for the proper management and

operation of the terminal and the facilities therein are necessary in
order to provide convenience and safety to transport providers and
passengers alike;

Be it enacted by the 14thSangguniangPanlungsod that:

ARTICLE I
TITLE, SCOPE, DEFINITION OF TERMS

SECTION 1. TITLE. This Ordinance shall be known as Revised Ormoc

City Bus ServiceTerminal Ordinance.

SECTION 2. VENUE.The Bus Terminal Services as provided for in the

proceeding section shall have its place of business and be housed in
the building located near theOrmoc City Pier.
SECTION 3.SCOPE OF ORDINANCE. - The provisions of this
ordinance shall govern, control, enforce, direct, regulate and supervise
the establishment, operation and maintenance of Ormoc City Transport
Terminals, in consonance with the mandate of the pertinent provisions
of Republic Act No. 7610, otherwise known as The Local Government
code of 1991.

SECTION 4 .DEFINITION OF TERMS. For purposes of this Ordinance,

the following terms are hereby defined:

a) Services shall mean to include all the facilities in the terminal

that could be afforded and would inure to the benefit of the
riding public.
b) Terminal means the area or place where incoming public utility
conveyances could discharge or disembark their passengers and
could likewise solicit passengers for their respective destinations.
c) Dispatcher-means any person employed by the operator of a
bus or jeepney to solicit passengers for a given public
conveyance.
d) TSBAC-Terminal Special Bids and Awards Committee
e) Driver refers to any person who drives motor vehicles and the
likes and duly licensed as such by the Land Transportation Office.
f) Stall shall refer to any allotted space, stand, compartment,
store or any place wherein merchandise is sold, offered for sale,
or for such purpose in the public market.
g) Public Utility Jeepney (PUJ) refers to a passenger type
vehicle that provides transport services for a fee, with duly
approved franchise from LTFRB.
h) Asian Utility Vehicle (AUV) for hire (FX)/Van for hire
refers to an AUV or FX Van that renders transport services for a
fee.
i) Operator -a natural or juridical person who is either a holder of
a Certificate of Public Conveyance (CPC) or a holder of a valid
business permit and engage in legal activity within the terminal
area; means a person who is a holder of a certificate of public
convenience to conduct the business of transporting passengers
within a given line or route.
j) Major repairs- means those repairs which require a period of
not less than three (3) hours time for their accomplishments
k) Garage means a building or compartment of a building used for
housing an automotive vehicle; a repair shop for automotive
vehicles;
l) Overnight Parking shall mean to be the parking of a vehicle
in the premises of the terminal from the early hours of the
evening until and up to anytime past twelve oclock (12:00)
midnight.
 m) Paved Bay an area within the terminal building allocated for
Public Utility Vehicles (PUV) for the purpose of loading and
unloading passengers.
n) Bus any motor vehicle covered with a valid Certificate of
Public Conveyance (CPC) and registered as bus for hire with
the Land Transportation Office.
o) Jeepney any motor vehicle covered with a valid Certificate of
Public Conveyance (CPC) and registered as jeepney for hire
with the Land Transportation Office. This includes the so-called
Filcab/Multicabs.
p) Van any vehicle covered with a valid Certificate of Public
Conveyance (CPC) registered as van for hire with the Land
Transportation Office.

ARTICLE II
MANAGEMENTAND SUPERVISION OF THE TERMINAL

SECTION 5. TERMINAL ADMINISTRATOR. The Mayor shall appoint

a Terminal Administrator whom shall be under the direct supervision of
the City Administrator.

SECTION 6. DUTIES AND RESPONSIBILITIES OF TERMINAL

ADMINISTRATOR.Administration, operation and maintenance of the
City Terminal shall be supervised by the Terminal Administrator who
shall have the following duties and responsibilities:

(a.) To maintain the facilities, such as but not limited to keeping

the fence and gates intact, replacing the busted bulbs, and
others;
(b.) To keep the premises in a clean and sanitary condition;
(c.) To adopt and enforce rules for orderly vehicle movements and
parking inside the terminal;
(d.) To keep the terminal clear of vendors, peddlers, hawkers and
illegal occupants;
(e.) To maintain peace and order inside the Terminal;
(f.) To keep daily records of departure of Public Utility Vehicles;
(g.) To assist the City Treasurers Office in the collection of
terminal fees from PUVs;
(h.) To keep accounts of collection and financial operation of the
terminal;
(i.) To ensure the implementation of this ordinance; and
(j.) To perform all other functions required by the City Mayor for
the efficient operation of the Terminal.
 ARTICLE III
TERMINAL FEES, ADJUDICATION/AWARDING OF STALLS AND
OTHER FACILITIES

SECTION 7. TERMINAL FEES. There shall be levied upon and

imposed on every passenger bus or jeepney, including vehicles for fire,
a terminal fee for services rendered and facilities offered for parking
and/or loading purposes categorized as follows:

SECTION 8. PARKING FEE. Vehicles plying the route Ormoc Manila

and Ormoc Davao shall be allowed to park in the terminal not to
exceed five (5) hours from the time of its arrival and for every hour in
excess thereof a fee of Thirty Pesos (P 30.00) shall be collected. For all
other routes, one (1) hour is collected.

SECTION 9. COLLECTION AND DISPOSITION OF FEES. The

fees/charges herein provided shall be collected by the City Treasurer
through his duly assigned deputies.

SECTION 10. USE OF PREMISES.That in no case shall the terminal

premises be converted into a garage for vehicles and neither shall
major repairs be undertaken thereat.

Bus Terminal No. 1 Shall be bounded as follows: On the West

side, is Real Street, on the East side, Rizal Street, on the South Side, is
Ebony Street; this area will be used exclusively for mini bus, jeepneys
and multicabs; and

Bus Terminal No. 2 Shall be bounded as follows: On the West

side is Rizal Street and on the East Side Bonifacio Street and on the
South side is Ebony Street and on the North side is IAL Building and will
be used exclusively for buses and other vehicles for hire such as FX,
L300, Adventure and the like.

ARTICLE IV
LEASE OF OFFICE SPACES AND STALLS

SECTION 11. VACANCY. Vacant office spaces and stallsin the terminal
shall be adjudicated in the following manner:

A notice of vacancy of the office spaces or stalls shall be made for a

period of fifteen (15) days immediately preceding the date fixed for the
award to a qualified applicant to apprise the public of the fact that
such office space or stall is unoccupied and available for lease. Such
notice shall be posted conspicuously on the unoccupied office space or
stall and three other conspicuous places in the following form:

NOTICE is hereby given that Stall No. ______ of Ormoc City

Terminal is vacant. Any person, 18 years of age or more and is not
legally incapacitated desiring to lease this stall, shall file an application
thereof on the prescribed form (copies may be obtained from the
Business Permits and Licensing Office during office hours) in case there
are more than one applicant, the awarding of the lease of the vacant
stall shall be determined thru public bidding for the lease thereof to be
conducted on ________________, 20____ at _____ oclock _________ at the
Session Hall, this City.

ARTICLE V
ADJUDICATION/AWARDING OF STALLS AND OFFICE SPACES

SECTION 12. PUBLIC BIDDING. In cases where a vacant stall or

office space has two or more competing applicants desiring to lease
out a specific office space or stall in the terminal, a public bidding shall
be conducted in order to decide on which of the qualified applicants
shall be awarded the lease for the said office space or stall.

SECTION 13. TERMINAL SPECIAL BIDS AND AWARDS

COMMITTEE (TSBAC).A Terminal Special Bids and Awards Committee
shall be constituted to supervise the conduct of a public bidding for the
lease of office spaces and stalls in the Terminal. The TSBAC shall be
composed of the following:

SECTION 14. FUNCTIONS AND RESPONSIBILITIES OF THE
TSBAC.The TSBAC shall exercise the following functions and
responsibilities:

a) Examine and evaluate all applications for lease of terminal stalls

and other facilities submitted by the applicants to the
SangguniangPanlungsod (SP);
b) Recommend to the SP a course of action for applications filed
before it;
c) Recommend to the SP the cancellation of existing contracts of
stall owners that have been found to have violated the provisions
of this ordinance; and
d) Supervise the conduct of the public bidding for the lease of office
spaces and stalls in the terminal in cases where two or more
applicants are vying for the lease of the same office space or
stall.

SECTION 15. LEASE OF OFFICE SPACES AND STALLS AT THE BUS

TERMINAL. Office Spaces at the Bus Terminal will be leased to
qualified occupants on a per square meter basis at the rate of P75.00
per square meter, said contract of lease will be signed by the City
Mayor or his duly authorized representative.

SECTION 16. REQUIREMENTS FOR APPLICATION.Every applicant

shall be required to submit one (1) copy each of the following
requirements to the Terminal Administrator:

a) Application letter addressed to the Chairman of the Terminal

Special Bids and Awards Committee;
b) Duly accomplished application form;
c) Non-refundable application fee amounting to _________.

It shall be the duty of the Terminal Administrator to keep a registry

book showing the names and address of all applicants for vacant stalls,
booths or tiendas, the number and description of the same applied for
them and the date and hour of receipt of each application. It shall be
his duty to acknowledge receipt of the application setting forth therein
the time and date of the receipt thereof.

SECTION 17. APPLICATION FOR LEASE. There shall be adopted a

manner by which lease applications shall be treated by the TSBAC and
shall substantially be in the following form:

Should the above mentioned shall be leased to me in accordance

with theterminal rules and regulations, I promise to hold the same
under the followingconditions:

(1) That while I am occupying or leasing this stall I shall at all times
havemy picture and that of my helper (or those of my
helpers)conveniently framed and hung up conspicuously in the stall.
(2) I shall keep the stall at all times in good sanitary condition and
shallcomply strictly with all sanitary and transport terminal rules
andregulations now existing or which may hereafter be promulgated.
(3) I shall pay the corresponding rents for the booth or the fee for the
stallin the manner prescribed by the existing ordinance.
(4) The business to be conducted in the stall shall belong exclusively
tome.
(5) In case I engage helpers, I shall nevertheless personally conduct
mybusiness and be present at the stall. I shall promptly notify
theterminal authorities of my absence, giving my reason or
reasonstherefor.
(6) I shall not sell or transfer my privilege to the stall or otherwise
permitanother person to conduct business therein.
(7) Any violation on my part or on the part of my helpers of the
foregoingconditions shall be sufficient cause of the transport
terminalauthorities to cancel this contract.

SECTION 18. LEASE PERIOD. The contract of lease shall be awarded

to the winning bidder for a stall/space, which shall be for a period of
one (1) year renewable upon its expiration, unless revoked in
accordance with the provisions of this article.

The Lease Contract shall be in the following form:

This Contract of Lease, made and executed on this ____ day of

Philippines by and between:

THE CITY OF ORMOC , a public corporation existing under and by

virtue of the Laws of the Republic of the Philippines, represented
by its Municipal Mayor Richard I. Gomez ,hereinafter called the
LESSOR;

____________________________, of legal age, single/married

to______________________, widow/widower, Filipino, a citizen
andresident of _________________________ hereinafter called the
LESSEE;

WHEREAS, in consideration of the rent and the term andcondition

herein contained, the LESSOR hereby demise and lease to
theLESSEE a stall which is a portion of the Rentable Building No. __
located at __________absolutely belonging to and owned by herein
LESSOR;

WHEREAS, the LESSOR agrees to lease Room No. __ situated at the

above to herein LESSEE;

NOW THEREFORE, for and in consideration of the above premises,

the parties herein have agreed to the following terms and

a) The terms of the lease contract shall be for a period of one

(1)year starting from the execution of this contract,
renewablefor a like period at the option of the LESSOR and
subject tothe terms and conditions herein contained and those
that maybe agreed upon by the parties in writing;

b) The agreed monthly rental for the use and occupancy ofStall

each month and every currentmonth thereafter without the
necessity of an express demandtherefore, said rental to be paid
to the Municipal Treasurer or his duly authorized representative.

OTHERSERVICES which shall be borne exclusively by the
LESSEE;

c) Upon the execution of this contract, the LESSEE, will pay

the two(2) months deposit, plus three (3) months advance
rental forthe lease premises. The deposit is to guarantee and
secure thefaithful compliance on the part of the LESSEE with
the terms and conditions set forth herein and cannot be
refundable, ifthe LESSEE stays LESS than one (1) year, in the
leasedpremises, since said deposit maybe forfeited and applied
by the LESSOR as liquidated damages;

d) The LESSEE is strictly prohibited and is not authorized to make

any improvement and/or alterations in the leased premises.
Any violation of this provisions shall be cause for termination of
this contract even before the expiration of the one (1) year
period or a ground for ejectment of the LESSEE;
e) The LESSEE, shall not sublease, or assign the leased premises,
neither can the LESSEE sell or transfer his/her rights under the
contract of lease to any other person whomsoever. A violation
of this condition will be ground fortermination of this lease
contract even before the expiration of the one (1) year period;

f) The LESSEE, in case of his temporary absence must appoint

any responsible person in the person who will take charge of
the safety of the leased premises and the faithful compliance of
the terms and conditions herein setforth. In no case shall the
temporary absence of the LESSEE exceed thirty (30) days;
otherwise, he or she shall be deemed to have abandoned the
leased premises. In the event that the LESSEE decide to vacate
the leased premises as aforesaid herein. LESSOR shall be
released and/or freed from and all claims and responsibilities
arising therefrom.

g) The LESSEE shall not use the leased premises for residence or
dormitory, but exclusively for the purpose to which it is
intended.

h) This contract of lease shall be rescinded whenever by reason of

conflagration, flood, river, earthquake or other
fortuitouscauses, the building shall be totally or partially
destroyed andthe LESSOR shall not at any time be responsible
to theLESSEE or any damage which may result to the
LESSEEfrom any of the said causes.

i) LESSEE, shall permit the LESSOR or his duly

authorizedrepresentative to enter and inspect the condition of
the leasedpremises at reasonable hour in convenient manner;

j) It is further agreed that the LESSEE shall be responsible forany

and all acts omissions or his/her servants/employees;

k) Should the LESSEE fails to pay the rent herein stipulated

inaccordance with the terms above mentioned or violate
theterms of this contract, the LESSOR shall have the right
toeject the LESSEE from the premises, and to collect and
recover from him/her all accrued rentals and to pay a penaltyof
twenty-five PERCENT (25%);

l) In case of court litigation by virtue of non-payments of

theagreed rentals or any other breach of this contract on the
partof the LESSEE, said LESSEE further bind and
obligatehimself/herself to pay the LESSOR the additional
 amount of_____________________________________

m) LESSOR and LESSEE hereby agrees that in the event ofcourt

litigations, the venue shall be in City of Ormoc;

n) LESSOR reserve its rights to increase the rents at the end ofone

o) LESSEE shall surrender and yield up quietly and peacefullyto

the LESSOR the premises with all the fixtures other thanthose
owned by the LESSEE at the termination of this leaseor earlier
termination thereof, in the same condition in whichhe/she shall
have found them; Ordinary wear and tear andreasonable use
and other unavoidable loses, excepted;

p) LESSOR hereby warrants the peaceful possession

andenjoyment of the leased premises by the LESSEE;

q) PROVIDED, always, that in case of breach by the LESSEEof any

of the terms and conditions herein contained, theLESSOR may
while said breach may continue, andnotwithstanding any
waiver of any prior breach of said termsand conditions without
notice of demand, hereby terminatethis lease, and may
thereupon expel and remove the LESSEEand his effects;

ARTICLE V
GUIDELINES FOR STALL OCCUPANTS

SECTION 19. VENDORS RESPONSIBILITIES. The following are

responsibilities of the vendor occupying a stall in terminal :
a. Shall maintain cleanliness and orderliness of the stalls and the
premises
b. Shall not change the nature of business
c. Shall not Engaged in business that competed with the
businesses of the lessees in the terminal lounge
d. Shall not maintain illegal activities ,such as gambling , selling of
prohibited items and the like
e. No subleasing allowed
f. No renovations and /or improvements shall be introduced by the
vendors in the stalls neither cause damage nor destruction of
the stalls
g. Shall personally man the stall or by its relative within the 4th
civil degree of affinity or consanguinity

SECTION 20.STALLS FOR OCCUPANCYPROHIBITIONS.The

following are prohibitions for stall occupancy:
a. Only one stall shall be allowed to be occupied per vendor
 b. No vendor shall be allowed to extend beyond the boundary
/marker.
c. Shall not be used as sleeping area/sleeping quarters
d. Stalls shall be manned by not more than 2 persons
e. Shall not be used as cooking area
f. Shall not be used as restaurant
g. No chairs and tables shall be displayed / allowed to be placed in
the stalls except for the chairs to be used by the vendors
manning the stalls which shall be limited to only two.

SECTION 21. PROHIBITION TO HAWK, SELL OR PEDDLE ALONG

SIDEWALKS. No person shall hawk or peddle his/her wares along the
sidewalks, alleys, aisles or corridors inside the terminal;No person shall
hawk or peddle his/her wares inside the buses or any public utility
vehicle within the terminal.

SECTION 22. PROHIBITION ON ILLEGAL STRUCTURES. No

person shall put up any structure, shanty, barong-barong, shed, table
or push cart within the premises of the EusebioBulaong Public Terminal
for the purpose of selling or keeping his wares or articles for sale to the
public.

SECTION 23. REVOCATION OF LEASE. - Failure to pay the rent of

stalls as herein provided or any violation of any provisions of this Code
by a Stallholder or his helper shall be sufficient cause for the
revocation of the lease and for the ejectment of the stallholder from his
stall or stalls.

SECTION 24. EJECTED STALLHOLDERS DISQUALIFIED. -

Stallholders, who have been ejected from his/her stall for cause as in
this Code provided, shall be disqualified from applying for any vacant.

SECTION 25. REPORT ON FEES. - It shall be required of the operator

of the public market to submit monthly to the Treasurers Office, a
certified list of stallholders showing the amount of stall fees or rentals
paid daily by each stallholder, which report shall be submitted on or
before the tenth day of each month following and shall pay 3% of the
gross receipt from stall rentals to the city, thru the City Treasurer.
Failure to submit said list and to pay the corresponding amount within
the period herein prescribed shall subject the operator to the penalties
provided in this code and to such other administrative remedies as
may be deemed appropriate including revocation of permit to operate.

ARTICLE VI
GUIDELINES ON BUS/ LAND TRANSPORT VEHICLES
SECTION 26. REGULATORY ACTS
1. All AUVs/Van for hire, PUJs and tricycle terminals must comply with
all existing laws applicable to them.

2. The designated terminal should not be in an area that prevents

access to a road to public or private vehicles

3. Vehicles parked within the terminal must not cause inconvenience to

pedestrians or obstruction to traffic.

4. Observe order and cleanliness within the terminal and immediate

surroundings at all times.

5. All Officers of the association applying for Terminal Regulation Permit

or after approval thereof shall have responsibility and obligation to
discipline their members with respect to the use of said terminals or its
facilities

6. The Terminal Regulation Permit shall be valid for one year and shall
be subject to renewal every year thereafter, approval of which shall be
upon the discretion of the issuing officer based on the associations
performance.

7. And such regulatory acts deemed necessary in the implementation

of this ordinance.

SECTION 27. EMPLOYMENT OF DISPATCHERS: BOND REQUIRED.

Operators of passenger buses or jeepneys may be allowed or
permitted to employ dispatchers; PROVIDED, that dispatchers as
employed shall have to be bonded in the amount of not less than one
thousand pesos (P1,000.00), cash or property bond, the same being
answerable to whatever loss or losses that any passenger may suffer in
the course of handling of such cargo or cargoes and/or effects by the
dispatchers concerned, properly identified by wearing their respective
uniforms and nameplates and in no case shall any person be employed
as such if he or she has been convicted of a crime involving moral
turpitude and, for this purpose, police and court clearances shall have
to be secured before his or her employment as dispatcher by any given
bus or jeepney company or operator. The necessary permit, however,
shall have to be secured from the Office of the City Mayor before any
dispatcher could exercise such privileges within the City of Ormoc.

SECTION 28. EMPLOYMENT OF A CITY SUPERVISING

DISPATCHER. To ensure an orderly, peaceful and disciplined
passenger dispatch in the bus terminal, all dispatchers as employed by
their respective bus or jeepney operators shall be under the control
and supervision of the City Supervising Dispatcher to be appointed
and/or designated by, and who shall be directly responsible to the City
Mayor and whose emolument shall be proved for in the city budget.
The City Supervising Dispatcher shall be responsible for the conduct,
behavior and proper discipline of the different bus or jeepney
dispatchers brought under his control and supervision.

SECTION 29. CONDUCT AND BEHAVIOR OF DISPATCHERS. Utmost

courtesy and honesty shall be accorded to all and every passenger by
the dispatchers and in no case shall roughness and discourteous
conduct be made.

SECTION 30. PROHIBITION TO SOLICIT OR ACCEPT PASSENGERS

OUTSIDE THE TERMINAL PREMISES: EXCEPTION. It shall be
prohibited and be considered as a violation of this Ordinance for a
passenger bus or jeepney driver, conductor, dispatcher, or any other
person authorized or not by any operator of his representative to solicit
or accept passengers and allow them to board their bus or jeepney in
any place of the poblacion of Ormoc City other than the bus terminal
area heretofore designated, except the picking up of passengers while
on their way out of the Poblacion or in the course of their route towards
their respective destinations.

ARTICLE VII
DUTIES AND RESPONSIBILITIES OF OPERATORS OF BUSES,
VANS AND PUJS

SECTION 31. The operators of public utility buses, vans, jeepneys,

filcabs or multicabs shall secure the necessary individual business
permits, licenses, upon payment of appropriate taxes, fees and other
impositions that may be imposed, levied and collected by duly
constituted authorities before using or taking possession of the
premises assigned to them.

SECTION 32. For operator of public utility buses, vans and jeepneys
with two or more units franchised under his/her name, he/she shall be
required to get only one permit for his/her units. The plate numbers of
the units must be reflected in the permit.

SECTION 33. There shall be printed/typewritten on the face of the

business permit the following: Any violation by the permitee of a law,
ordinance, executive order or other issuances in the preparation of his
business shall be cause for the revocation of the permit. The Business
Permits and Licenses Division shall also issue corresponding vehicle
stickers to all approved permitee, which shall be displayed on the front
windshield of their vans, jeepneys and buses.

SECTION48. The Operators shall not start or proceed with any repair
work, extend the area, occupy more bays/alleys as allowed nor in any
case introduce improvements or make any alteration in the leased
premises without prior written consent and approval of the City
Administrator; and that in case of permitted improvements or
alterations, the same shall not be removed but shall belong to and
become the exclusive property of the City Government of General
Santos, without any right of reimbursement on the part of the
operators.

SECTION 34. The operators shall comply with all sanitation rules and
safety regulations which are promulgated by the duly constituted
authorities and those that may be imposed from time to time by the
City Administrator and to keep and maintain the leased premises in
clean and sanitary condition and disposed of all rubbish or garbage
only thru the means and places indicated by the City Administrator for
the purpose.

SECTION 35. Each operator shall require his/her employee/s to wear

companys ID upon entering the premises of the EusebioBulaong Public
Terminal and to require them to log-in the logbook prepared by the
overseer of the said Terminal for identification purposes.

SECTION 37. Each operator shall comply with any and all laws,
ordinances, regulations or orders of the National or City Government
authorities arising from or regarding the use, occupation and sanitation
of the leased premises.

SECTION 38. Each operator or his/her duly authorized representatives

shall recognize the authority of the City Administrator or his duly
authorized representatives to inspect the leased premises at any
reasonable hour of the day or night.

SECTION 39. Each operator shall notify in writing the City

Administrator at least Thirty (30) days in advance should he/she decide
to vacate the leased premises.

SECTION 40. All operators shall submit to the terminal authorities

their own daily arrival and departure reports on arrivals and departures
of their own units;

ARTICLE VIII
FEES, LICENSES, PERMITS AND TAXES
SECTION 41. - All fess, licenses, permit and/or taxes appurtenant to
or in connection with the establishment, operation and maintenance of
privately owned bus/land transport terminal shall be in accordance
with the pertinent provisions prescribed under Ordinance no.
___________ Otherwise known as the Revenue code of the City of Ormoc
.
ARTICLE X
FINAL PROVISIONS

SECTION 42. PENALTY. Any violation of the provisions of this

Ordinance by any driver, conductor, dispatcher and/or any
representative of an operator of a public conveyance, or by the
operator himself or herself, shall subject such offender to a fine of not
less than three hundred pesos (P300.00) for the first offense and
cancellation of his/her permit for the succeeding offense and
disqualifying him or her to be granted permit for the exercise of such
vocation or privilege within the jurisdiction of Ormoc City.

SECTION 43. SEPARABILITY. If any section or portion of this

Ordinance shall not be declared unconstitutional or ultra vires, such
declaration shall not invalidate the whole of this Ordinance.

SECTION 44. EFFECTIVITY. This Ordinance shall take effect

immediately
