ORDER DENYING DEFENDANTS’ MOTION TO SEAL

Defendants Joseph R. Price, Victor J. Zaborsky, and Dylan M. Ward filed a joint Motion

to Seal Plaintiff’s Motion for Issuance of a Commission to Verizon Communications and the

attachments thereto. Plaintiff has now withdrawn the Motion for Issuance of a Commission.

This, however, does not moot the Motion to Seal.

From a review of the record, it appears that the attachments to the Motion for

Commission which contained emails between two of the parties and an advertisement are already

in the public domain. The latter was a published advertisement and the former were submitted in

evidence in the criminal trial. Moreover, there is a general right of the public to inspect and copy

public records. Mokhiber v. Davis, 537 A.2d 1100, 1106 (D.C. 1988). Nothing in the filings

implicates privacy rights of others not before the Court. Accordingly, it is by the Court this 24th

day of August 2010, hereby

ORDERED that the Court’s Order of August 16, 2010, sealing the filings until the Court

could rule on the instant motion is now moot; and it is further

ORDERED that defendants’ Motion to Seal plaintiff’s Motion for Issuance of a

Commission is DENIED; and it is further

ORDERED that the Clerk of the Court shall unseal the material and make the filings

publically available; and it is further

ORDERED that the Status Hearing set for September 10, 2010, is moved from 9:45 to

10:30 a.m.
