PLEA BARGAINING AGREEMENT

COMES NOW, ACCUSED, through the undersigned counsel, most


respectfully submits that:

1. Accused is charged with violating Sections 11 (1) and 12 of RA 9165.


The following penalties are prescribed in the said law:

Section 11, par. 3, - twelve (12) years and one (1) day
of RA 9165 to twenty (20) years and a fine
ranging from Three hundred
thousand pesos (P300,000.00) to
Four hundred thousand pesos
(P400,000.00)

2. Pursuant to the Department Circular No. 061, the violations for Sec.
11, par.1 of RA 9165 and Section 12 of RA 9165 can now be the subject of a
Plea Bargaining Agreement, under the following recommended offense and
respective charge, to wit:

3. Thus, Accused is praying from this Honorable Court, with the


approval from the Honorable Public Prosecutor, to allow them to plea
bargain for violating Sec. 11, paragraph 3, of RA 9165 and be charged
instead with the penalty 6 months of rehabilitation considering that this
case is accused’ first offense;

4. The above recommendations are respectfully submitted for the


resolution to the Honorable Court with approval from the Honorable Public
Prosecutor.
