Atty. Rogelio Vinluan had a confirmed first class ticket on a TWA flight from New York to San Francisco but was denied boarding in first class at the airport and forced to take economy despite confirming twice. He witnessed Caucasian passengers who checked in after him being accommodated in first class. Vinluan sued TWA for damages and was awarded moral and exemplary damages and attorney's fees by the trial court which was partially affirmed by the Court of Appeals, lowering some amounts. TWA appealed to the Supreme Court claiming the denial was due to mechanical problems.

Japan Airlines and other airlines
• • He had a first class ticket on his TWA flight from JFK to San Francisco
• • He reconfirmed twice
• • But when he got to JFK, he was told that there were no more first
class seats
• • Then he saw that Caucasians who checked-in after him were
accommodated
• • Vinluan was forced to take an economy class seat
• • Vinluan sued TWA for damages
• • RTC awarded P500K (moral), P300 (exemplary) P100K (attorney’s
fees) at 12% pa
• • CA affirmed, but lessened the interest rate to 6% pa and lowered
attorney’s fees to P50K
• • TWA appeals to the SC
• • TWA claims that the event was caused by a change in plans due to
mechanical problems
