Facts: The appellee is the People of the Philippines. The appellant is Roger or Regelio Puedan.
In the case at bar, a certain Florencio Ilar went to the house of a certain Luceno Tulo to buy a
piglet. Luceno Tulo was fashioning out of a mortar for pounding palay near his house, when
Florencia arrived at his house. Florencio told Luceno that he is interested in buying a piglet from
him. Later on, the herein appellant arrived and willfully stabbed Florencio five times using a
pointed knife locally known as plamingco. The wife of the stabbed victim ran swiftly to the place
of the incident, but Florencio was already dead when she arrived. The police came later that day,
and the herein appellant was then arrested. The RTC then hold the appellant liable for the crime
of murder as qualified by treachery. Hence, the appeal.
Held: The Supreme Court said that it is clear that the killing was attended by the qualifying
circumstance of treachery. The act of the herein appellant in stabbing the unsuspecting victim
five times in the abdomen is sufficient to prove the presence of treachery. The Supreme Court
said that such mode of killing was deliberately and consciously adopted by the latter since it was
done without any warning or whatsoever.
