1 Introduction

Harmonized standards for Sanitary Appliances have been available for some time. CE
marking of construction products started with the Construction Products Directive (CPD)
89/106 EC. This directive was replaced by 305/2011 EC “Construction Products Regulation”
(CPR) in July 2013. The introduction of the CPR legislation brought with it a new legal
framework mandating CE marking for compliant products and the supply of Declaration of
Performance (DoP) documents when placing compliant products on the market.

The harmonized standards available at the present time may not show the actual legal
situation according to the Construction Products Regulation (CPR). Nevertheless, the
products when placed on the market must follow the latest legal requirements detailed from
the European Commission (EC).

It is only permissible to use harmonized standards only after the citation of the standards in
the European Official Journal [OJEU] (followed by the citation in national official Journals).
Currently the harmonized standards cited in the OJEU are reporting older product CE
marking details, requesting a Declaration of Conformity (DoC), while e.g. the revised
standards, still waiting for citation in the OJEU, include the reference to the Declaration of
Performance (DoP) in accordance with the CPR. This situation can easily occur due to time
delays between the publication of a regulation and the necessary revision of the underlying
standards.

This document has the aim to show the current CPR requirements and examples for DoP and
CE marking procedure of sanitary appliances. This guide is to help everyone to understand
the actual legal requirements in terms of Declaration of Performance and CE marking that
must be used for sanitary appliances.

2 Scope

This document is primary guidance and shows instructions, explanations and examples for
both preparation of declarations of performance and CE marking in accordance with
305/2011 EC. The guidance is especially for harmonized standards of CEN/TC 163 e.g.
EN 997, EN 12764, EN 13310, EN 13407, EN 14055, EN 14296, EN 14428, EN 14516,
EN 14527, EN 14528 and EN 14688.
Products covered by these harmonised standards and therefore the CPR are WCs and WC
suites, whirlpool baths, kitchen sinks, wall-hung urinals, WC and urinals flushing cisterns,
communal washing troughs, shower enclosures, baths for domestic purposes, shower trays
for domestic purposes, bidets and wash basins.
The relationship of the above mention standards with EU Construction Products Regulation
are in the informative Annex ZA of the respective standard.
This document is guidance only and has no mandatory function. Legal requirements stated in
305/2011 EC and complementary delegated acts of EC e.g. 148/2014 EC and 574/2014 EC.

4 General

This document is a guidance paper for products complying with harmonized standards of
CEN/TC 163. The basis for this guidance are the requirements laid out including and specific
delegated acts of the CPR.
The EC 305/2011 “Construction Products Regulation” (CPR) lays down harmonized rules for
marking construction products in the EU. The Regulation provides a common technical
language to assess the performance of construction products. It ensures that reliable
information is available to manufacturers, public authorities, market surveillance and
consumers etc., so they can compare the performance of products from different
manufacturers in different countries.
The Declaration of Performance (DoP) is a new key part of the CPR. It provides information
to the market of the performance of a product. Each construction product covered by an
European harmonized standard or for which a European Technical Assessment has been
issued, needs such a DoP and has to be CE marked. This helps to increase transparency of
information concerning the product in the market.
All EU countries are obliged to allow the selling of construction products bearing the CE
mark. This means that public authorities cannot ask for any additional marks or certificates,
or additional testing. Therefore, manufacturers are able to trade their products in any
country of the European Internal Market with the same documentation and assessed
product performance. In some cases, an EU country may have local regulations that do not
allow the installation of some CE marked products despite the fact that they can legally be
placed on the market.

The affixing of the CE marking to a product means that the manufacturer is assuring that the
performance of the sold product is the same as what was declared and indeed that it is fit for
purpose.

 The CE marking indicates that a product is in accordance with the requirements of the
CPR.
 With the CE marking of a product, the responsible person declares, that:
• the corresponding conformity assessment procedures were carried out and
• the product is subject to all applicable Community regulations.
 CE marking shall be the only marking which attests conformity of the construction
product with the declared performance in relation to the essential characteristics,
covered by relevant harmonised standard.
 Other markings e.g. trade marks may be used, provided that they help to improve the
protection of users of construction products and are not covered by existing European
Union harmonisation legislation, but only on condition that the visibility and legibility of
the CE marking are not reduced, and provided that such marks are not likely to deceive
third parties as to the meaning and form of the CE marking.
 Member States cannot impose any additional requirement at national, regional or local
level on construction products that bear CE marking.
 Member States are allowed to select necessary properties by means of requirements on
build level. Hence not all CE marked products could be installed all over Europe.
The format of the above mentioned Declaration of Performance (DoP) is defined in the CPR
(EC 305/2011; Annex III). Further definitions for the preparation of DoPs as well as an
amended template for the DoP were introduced with EC 574/2014.

5 Declaration of Performance

The declaration of performance shall express the performance of construction products in


relation to the essential characteristics of those products in accordance with the relevant
harmonized European Standard.
In case of, e.g. a dealer or a wholesaler distributing a product under his own brand (private
label), the responsibility for the CE-marking procedure will be passed to the product owner.
In this case the product owner is the wholesaler or dealer as they have taken the
responsibility by placing the product on the market under their own label / brand as if they
are a manufacturer.
A copy of the DoP of each product which is made available on the market shall be supplied
either in paper form or by electronic means.
o Common practice is to distribute DoP documents via manufacturers websites

In accordance with this Regulation, the DoP shall contain, in particular, the following
information:

The reference of the product type for which the declaration of performance has been drawn
up;
o All products covered by a single standard are deemed to be the same product type
e.g. WC suite or pan, flushing cistern, urinal, wash basin, bidet, bath shower
enclosure shower tray, communal washing trough and kitchen sink. For sanitary
appliances –all products must be one of the 11 for mentioned types.
o Any one type can cover lists of multiple products that have only to satisfy the same
Essential Characteristics.
 the Assessment, Verification and Constancy of Performance (AVCP) system or systems of
the construction product, as set out in Annex V of the CPR;
o Sanitary Appliances are set at AVCP system level 4 according to mandate M/110
 the reference number and date of issue of the harmonized standard which has been used
for the assessment of each Essential Characteristic;
o E.g. EN 997: 2017
o E.g. EN 997 2012 + A1: 2015
o The only applicable product standard for use are those that are cited in the OJEU.
 where applicable, the reference number of the Specific Technical Documentation used
and the requirements with which the manufacturer claims the product complies.
o For sanitary appliances, this will always be the reference to the cited product
standard.

The DoP shall in addition contain:

 the intended use or uses for the construction product, in accordance with the applicable
harmonized technical specification;
o Personal hygiene or PH
o Preparation of food, Washing of dishes and Drainage of waste water, or PWD
(kitchen sinks only)
 the list of Essential Characteristics, as determined in the harmonized technical
specification for the declared intended use or uses;
o see table ZA1 in annexes ZA of harmonized technical specification (e.g. product
standards)
 the performance of at least one of the essential Characteristics of the construction
product, relevant for the declared intended use or uses;
o Common practice for Sanitary Appliances is to assess and declare all essential
characteristics.
o Abbreviations of the essential characteristics are defined in the cited product
standard(s)

 where applicable, the performance of the construction product, by levels or classes,


or in a description, if necessary based on a calculation in relation to its Essential
Characteristics determined in accordance with the Commission determination regarding
those Essential Characteristics for which the manufacturer shall declare the performance
of the product when it is placed on the market or the Commission determination

regarding threshold levels for the performance in relation to the Essential Characteristics
to be declared;
o Sanitary appliances do not have assessments for levels or classes within the product
standards according to the CPR.
o In some cases, where product standards were cited under CPD, classes may be used
but this will be a temporary situation that gets resolved with the publication and
citation of newer harmonized product standards under the CPR.
 the performance of those Essential Characteristics of the construction product which are
related to the intended use or uses, taking into consideration the provisions in relation to
the intended use or uses where the manufacturer intends the product to be made
available on the market;
o Not all essential characteristics are mandated in all EU member states. The essential
characteristics of a product that are mandated in any member state shall be
assessed and declared for the market.
o Common practice for Sanitary Appliances is to assess and declare all essential
characteristics.
 for the listed Essential Characteristics for which no performance is declared, the letters
“NPD” (No Performance Determined) were used.
o Common practice for Sanitary Appliances is to assess and declare all essential
characteristics.

Regarding the supply of the DoP, Article 7 of the Regulation (EU) No. 305/2011 applies.
The CPR permits the distribution of the DoP on websites of the manufacturer or agent by
means of the regulation:
COMMISSION DELEGATED REGULATION (EU) No 157/2014 of 30 October 2013 on the
conditions for making a declaration of performance on construction products available on a
website.

Annex III to Regulation (EU) No 305/2011 of the European Parliament and of the Council on
the model to be used for drawing up a declaration of performance on construction products”

Using the framework of the Construction Products Regulation (CPR), Where products are
assessed using harmonised standards they are required to carry a CE mark/label which in
turn is supported by a Declaration of Performance (DoP) detailing the performance of the
product to the Basic Requirements for Construction Works (BRCW) – also commonly known
as essential characteristics.
Sanitary appliances, when assessed under the appropriate harmonised standards to
demonstrate compliance with the CPR, has a number of characteristics that must be
validated. With this in mind and the need to provide labelling in the language of country of
destination, a simplified coding method has been developed to aid easy checking and
verification by authorities of the CE label placed on a sanitary appliances product or
packaging.
o A full system of simplified abbreviation codes has been developed for Sanitary
Appliances and these are fully checked and supported by the European Commission
as suitable methods to detail product performance on CE labels.
o This is also the case where the standards were previously cited under the CPD as
declarations given under the CPD are still valid under the CPR until they are replaced
by newly cited product standards.

The CE marking indicates that a construction product is in conformity with its declared
performance and shall include the following information:

 The CPR demands a specific set of data to be included on the CE label

 name or identifying mark of the manufacturer


o A name or identifying mark of the ‘manufacturer’ shall be given or the name of the
manufacturer in the EEA or his authorized appointed deputy in the EEA.

 registered address of the manufacturer or an address which allows the consumer to


get into contact with the manufacturer.
o Manufacturers shall include the name and the registered address of the
manufacturer, or an identifying mark which easily allows the identification of the
name and address of the manufacturer or
a post box address or a web address (as long as the web address leads to the details
the full postal address of the manufacturer) is sufficient.

 the last two digits of the year in which the marking was first affixed
Manufacturers are obliged to include the last two digits of the year of the CE-marking
which could refer to:
o the year in which the initial type testing was carried out, as the first reference of the
attestation of performance of the product
or
o the actual year, when factory production control has confirmed the accordance to
the CPR as a continual and regular process based on AVCP as described in Annex ZA
of the relevant standard.
 the unique identification code of the product-type
o This code shall be the unique identification code of the product type without any
ambiguity which will link the CE marking to the declaration of performance and the
declared performance.
This be could be a part code or an SKU (Stock Keeping Unit) number code or a
subset of these codes that describe the product and can be related to the
information contained on the DoP e.g. this could describe the product without a
specific colour code. XX.XXX.YY where YY could be e.g. a colour option or other
additional feature not related to the harmonized product standard or performance
of the product – in case XX.XXX would be sufficient.

 the reference number of the declaration of performance will also have to be included
o In case the unique identification code of the product type is not the same as the
reference number of the declaration of performance this number shall also be
shown
 reference to the European Standard (used to assess the products’ performance)
o This means the reference to the harmonized standard applied to assessment of the
product
e.g. EN 997 etc. This does not need to include the year of publication of the
harmonized product standard as this information is detailed on the DoP.
 the designation of the product according the corresponding European Standard
o The designation codes fully describe the performance of the product. Characteristics
are tested for compliance with the applicable standard.
For sanitary appliance this is the applicable abbreviation code as detailed in the
appropriate harmonized product standard.
 the intended use as laid down in the harmonized European Standard
o The relevant information about the intended use shall be included and has to be the
same as the corresponding point in the declaration of performance.
o For sanitary appliances, this will be
o Personal hygiene or PH
o Preparation of food, washing of dishes and drainage of waste water or PWD
(kitchen sinks only)

The CE marking symbol shall be in accordance with the general principles set out in Article 30
of Regulation (EC) No. 765/2008. It may be followed by a pictogram or any other mark
notably indicating a special risk or use.

 It shall be affixed visibly, legibly and indelibly in such a way:


• to the product
o e.g. WC suite or wall-hung urinal
or
• to a label attached to it
o e.g. WC suites or wall-hung urinal
 Where this is not possible or not warranted on account of the nature of the product, it
shall be affixed
• to the packaging
or
• to the accompanying documents
o e.g. shower enclosures
This approach is justified to guarantee the easy visibility of the CE-mark to give the maximum
chance for e.g. market surveillance for the identification of the CE-marking.
o Common practice for Sanitary Appliances is that the CE label is placed on the
product. When products are inside packaging e.g. carton boxes that render the
product non-visible the CE label shall be placed on the packaging. In this case
there is no further need to label the product inside the packaging.
o In case, e.g. a dealer or a wholesaler distributes a product under his own brand
(private label), the responsibility for the CE-marking procedure will be passed to
the product owner.

7 Guide to Designations for Sanitaryware

As a principle, the Standard and the designation of the product shall be given in the first line.
The second line shall give the designation for the Essential Characteristics according the
mandate and can be deleted if all characteristics have been fulfilled.
The intended use of a sanitaryware product, in accordance with the scope of the relevant
standard, is personal hygiene and in case of kitchen sinks preparation of food, washing of
dishes and drainage of waste water.
NOTE 1 The intended use is also mentioned in Annex ZA, Table ZA.1 of the relevant
standard.

9 REACH information

Construction products are subject to the Registration, Evaluation, Authorisation & Restriction
of Chemicals (REACH) Regulation XVI covering chemicals used in the EU. Therefore,
manufacturers have also to fulfil all the requirements established in this regulation.
However, construction products manufacturers are not usually obliged to supply a safety
data sheet because these products are not considered to be a substance or mixture
according to the REACH regulation (see article 31 and article 33 of REACH).
E.g. sanitary ceramics, mentioned in this document, do not meet the criteria of REACH Article
31.1 and the manufacturers, importers and distributors of mixtures are not obligated to
supply neither a REACH certificate nor a safety data sheet.
The following gives an example of document confirming the non-obligation of REACH for
ceramics products / components within sanitary appliances:

The legislation concerning the registration, assessment, approval and restriction of chemical
substances (REACH) came into force on the 18th. November 2006.
As a manufacturer of sanitary ceramic products, company XXX is regarded as a "downstream
user" in terms of the REACH Directive 1907/2006. Obligations arising from the manufacture
and placing on the market of substances / chemicals to pre-registration and registration are
not applicable to us.
Our products and commodities are therefore not defined as Materials or Preparations.
Furthermore, no materials are released from our commodities under normal and predictable
conditions of use. This means that company XXX is subject neither to the obligation to
register, nor to the obligation to produce safety data-sheets.
In order to guarantee our customers a continuous supply of reliable and safe products, we
also ensure that our suppliers fulfil all the requirements with regard to materials, and thus do
not use any chemical substances included in the list of candidates of concern-generating
materials (SVHC) for the manufacture of our products.

10 Information on dangerous substances

The Construction Products Regulation defines the ways in which a declaration of


performance may be made by the producer. In respect of dangerous substances this is likely
to be by way of a level or class, rather than a description.
A principle of the Construction Products Regulation [2] is that the Declaration of
Performance (DoP), together with the harmonised standards, should give all the information
needed by users and regulators.
Further information on dangerous substances can be found in specific clauses in each
harmonised product standard for Sanitary Appliances.

Delegated acts covering the specifics of dangerous substances are currently being prepared.
E.g. for ceramic products; Hereby we declare that our products made of sanitary ceramics
are in accordance with the relevant safety and health requirements of the EC directives due
to their choice of raw materials, design and construction.

Use of a post box address


The CPR (305/2011 EC) demands to show the address or identifying mark of the
manufacturer to accompany the CE-marking (Article 9 of 305/2011) with the aim to easily
find the correct contact information.
A post box address; or a web address (as long as the web address leads to the details of the
full postal address of the manufacturer) is therefore sufficient.
Does the CE label need to include the Year of publication of the standard on the label?
No.
There is no requirement to include the year of publication of the harmonised standard on
the CE label as this information has to be provided as part of the DoP information. The DoP
is the full confirmation of the assessment of the performance of the product while the CE
label is a shortened form to help convey information in an expedient format for market
surveillance purposes.
How should packs that contain multiple CE compliant products be labelled?
Where the pack contains e.g. both a WC bowl and a flushing cistern, these products can be
covered by a label under EN 997. (See also EN 14055 scope that details EN 997 to cover one
piece and Type 2 products). In some cases, manufacturers may choose to separately detail
CE labels (and associated DoPs) for EN 997 (WC) and EN 14055 (flushing cisterns).
Where a pack may contain multiple products that are not designed to work together as in
the case of WCs, each applicable CE label should be covered on the outer pack.
Marking of Glass & Curved Glass in shower enclosure/bath screens
Thermally toughened soda lime silicate safety glass for use in shower enclosures in flat panel,
typically conforms with EN 12150. However, there is currently no similar existing test
specification for curved glass. When preparing EN 14428 as a test specification for shower
enclosures, the EN 12150 test requirements were written in to EN 14428 for all flat and
curved glass. However, when glass producers make curved glass for use in shower
enclosures they are unable to mark the panels with EN 12150. The shower enclosure
manufacturer will however have verified the curved glass (using EN 14428) to the same
performance standard as that detailed for flat glass in EN 12150. For reference the
requirement in EN 12150 and in EN 14428 for glass is a particle count of 40 or greater and
the length of the longest particle shall not exceed 100mm.
Does the CE label need a ‘Made in XXX’ country of origin mark?
No.
This is not a requirement of the CE label. Full contact details of the
manufacturer/agent/importer should be included on the DoP – this is registered address of
the company and not the address of the production plant.

Are all versions of published standards suitable for use for CE marking?
No.
Only those standards that have been cited in the OJEU are applicable to be used as the
reference document for CE labels and DoP documents for Sanitary Appliances.
When a new product standard is cited in the OJEU, does the CE label and DoP document
need to be updated?
No.
Where standards have been cited in the OJEU but have subsequently been replaced by
newer versions of product standards; products already placed on the market may in fact be
CE marked with DoP documents relating to these older cited versions. This is also acceptable
until the point that the manufacturer decides to change the product at which point
assessment must be made against the latest cited version of the product standard.
