AFFIDAVIT OF DESISTANCE

I, SHISLEY ANN SANCHEZ-MATEO, of legal age, married, Filipino and a


resident of # 152 Tendido St., Bgy. San Jose, Quezon City, after having duly sworn
to in accordance with law hereby depose and state:

1. I am the complaining witness for Acts of Lasciviousness in relation to R.A.


7610 against John Jhet Pincale y Sanchez in the case entitled “ People of the
Philippines versus John Jhet Pincale y Sanchez a.k.a. “JJ” , Criminal Case No. R-
QZN-19-05767-CR , Regional Trial Court , Branch 102 , Quezon City ;

2. After my sober and soul searching assessment and analysis of the incident, I
have realized that the accused cannot commit such a crime against my daughter
because he is my cousin and his actions were actually without malice, end even
assuming that he had a malicious intent , he himself decided not to continue with his
criminal purpose having set one foot on the verge of crimes, heed the call of his
conscience and return to the path of righteousness ;

3. Since I could not state with certainty and without doubt the liability of John
Jhet Pincale y Sanchez , in fairness to him, I am permanently withdrawing my
complaint against him. I clear him of whatever responsibility or liability to me and
my daughter .

4. I hereby inform the City Prosecutor of Quezon City that I am withdrawing


my complaint for Acts of lasciviousness in relation to R.A. 7610 in Criminal Case
No. R-QZN-19-05767-CR , entitled“ People of the Philippines versus John Jhet
Pincale y Sanchez a.k.a. “JJ” Regional Trial Court , Branch , Quezon City .

5. I likewise request the Regional Trial Court , Branch 102 , Quezon City to
dismiss with prejudice the said criminal case .
IN WITNESS WHEREOF, I hereby set my hand this __ day of April 2019 In
