Chapter 1 : Nursing as a Profession


Profession: occupation or calling that requires advanced training and
experience in some specific or specialized body of knowledge which provides
to society in that special field.

CRITERIA OF A PROFESSION:
1. satisfies an indispensable social need based on well established and
socially accepted principles
2. must give evidence of needed skills which the public does not possess
3. must have a developed scientific technique which is a result of a tested
experience
4. must have sufficient self impelling power to retain its members
throughout life, thus must not be used as merely a stepping stone to other
occupations
5. constantly enlarges the body of knowledge it uses and subsequently
imposes on its members a lifelong obligation to be current in order to do no
harm
6. functions autonomously in formulation of prof. policy and in monitoring
its practice and practitioners
7. must recognize its obligations to society by insisting that its members
live up to an established code of ethics
8. must demand adequate pre-professional and cultural training
9. must demand possession of a body specialized and systematic training
10. must require the exercise of discretion and judgment as to time and
manner of the performance of duty.

⭐ The constant search for better services to patients, the improvement of


educational programs in nursing and the formulation of its own code of ethics
are but a few factors that point to the professionalization of nursing

PROFESSIONAL NURSE
1. completed a basic nursing education program
2. licensed to practice

PROFESSIONAL NURSING: PNA 1991 of RA 7164 repealed by PNA 2002 of RA 9173


which is the scope of the nursing practice.

Scope of the nsg practice:


✓Performs duty singly or in collaboration
✓Patients are I,F,C or in any health care setting
✓Includes but not limited to nsg care during:
✰conception ✰childhood ✰adolescence
✰labor ✰toddler ✰adulthood
✰delivery ✰preschool ✰old age
✰infancy ✰school age

✓independent practitioners’ primary responsibility:


Promotion of Health and Prevention of Illness
✓Collab with other HCP:
curative, preventive, rehab aspects, restoration of Health, Alleviation of suffering,
Assistance towards a peaceful death

Specific duties in PNA 2002:

A. Practice nsg:
1. traditional and innovative approaches
2. therapeutic use of self
3. executing Hcare techniques and procedures
4. Essential Primary Hcare
5. Comfort measures
6. Health Teachings
7. Admin. of written prescription for oral, topical and parenteral meds
8. Internal exam during labor in the absence of antenatal bleeding
9. Delivery
10. aduturing Perineal lacerations only with special trainings

B. Establish linkages with community resources and coordination with the Health team.
C. Provide H. education to IFC
D. Teach, guide and supervise students in nursing education programs in administration of
nsg services in varied settings, undertake consultation services, engage in activities that
require the utilization of knowledge and decision making skills
E. Undertake nursing and Health human resource devt training and research to develop
advanced nsg practice

☆This scope of nsg doesnt apply to nsg students because theyre still under direct
supervision of a qualified faculty

Provided further, nurse is duty bound to observe the Code of Ethics for nurses and uphold
the standards of Safe nursing practice. Thus, required to maintain competence by continual
learning throughcontinuing professional education and this will be submitted and approved
by the Board.

QUALIFICATIONS AND ABILITIES OF A PROFESSIONAL NURSE

A. Professional preparation (3)


BSN, license to practice and being physically and mentally fit

B. Personal qualities and Professioanl Proficiencies (Attitude + skills)


Attitude: interest and willingness to work and learn with ind or groups, warm personality and
concern for people, resourceful, creative and a balanced emotional condition, capable to
work cooperatively, initiative to improve self and service and lastly, active participation in
issues confronting nurses and nursing
Skills: competece in the useof nsg process, skill in decision making, communicating, relating
with others and being research oriented.

BASIC EDUCATION PROGRAM IN NURSING:


a 4 year collegiate degree program earning BSN

BSN CURRICULUM:
a competency based oriented curriculum
an entry preparation for various clinical settings

Terminal competencies or end of program competencies:


1. Utilize Nursing Process to IFC through ADPIE
2. Communicate effectively by applying therapeutic use of self, documenting and reporting
observations and responses to nursing actions and lastly, relate with IFC and Hteam
members
3. Utilize the elements of Management by utilizing the management process, participating in
the formulation and implementation of policies and working independently and or in
collaboration with others.
4. Utilize research findings in the health care
5. Assume responsibility for personal and professional growth and development by
promotiing it, accepting accountability for professional actions, participating in the solution
of Health or social problems.

Overall behaviors expected


*caring behaviors like being compassionate, competent and committed
*critical and creative thinking
*ability to practice legal, ethico moral, social responsibilities or accountabilities
*skill in practicing SKA and values for the promotion of health, prevention of illness,
restoration of H, alleviation of S, and assisting clients to face death with dignity and peace.

Chapter 2: License To Practice Nursing


License: legal document given by the government that permits a person to offer to the
public his or her skills and knowledge in a particular jurisdiction, where such practice would
otherwise be unlawful without a license. Thus, it gives him or her the privilege of
representing herself or himself as a licensed nurse.

PRC :appropriate authority that administers, implement and enforce the regulatory policies
of the government in regilating and licensing various professions and organizations under its
jurisdiction

NEED FOR LICENSURE: The license primary purpose is to protect the health of the people by
establishing min. standatd which qualified practitioners must meet. It discourages people
tempted to represent themselves as nurses. It is the most important tool for legal control
and enforcement of the nsg. practice and used to gather statistical data about nurses and
nursing in the country.

REGISTRATION: recording of names of people who have qualified under the law to practice
that respective profession.
It is recorded in a registration book:
1. full name
2. number and date of registration
3. Age, Sex and Place of Birth
4. Place of Business
5. Post Office Address
6. School, College or University studied and Graduated
7. Date of Graduation or term of study + time spent in study of professional elsewhere if any
8. all other degrees granted to him or her from other institutions of learning

Note: COR is issued by the PRC to show such qualification


Registration is req under PNA 2002 Sec 12 and 20 in which license nsg is issued to
those who pass the licensure exam or by reciprocity ( foreigner nurses).

REGISTRATION BY RECIPROCITY: RA 9173 sec. 20


Reciprocity is the mutuality in the grant and enjoyment of privileges between person or
nations. This is a relationship established by the law, treaty or agreement bet. 2 countries or
states whereby each country or state grants to the citizens of each other, the privilege
within their respective territorial jurisdictions. It is based on the principle, “DO UT DES”
meaning, FOR A COUNTRY TO EXPECT A FAVOR FROM ANOTHER, IT SHOULD BE WILLING TO
GIVE A CORRESPONDING FAVOR. Then, the COR may be issued without an examination.
*Provided that, the the requirements for registrati9nor licensing of nurses in the said country
are substantially the same.
** Provided further, laws of such stste or country grant the same privileges to Filipino RNs
like their citizens.

PROVISIONS PNA 2002 RA 9173 SEC 20:


1. Filipino RNs in forign countries must have same privileges with their citizens, proof of such
reciprocity will be verified by the DFA.
2. Applicant is a nurse reg. under the law of his or her state or country.
3. Reqs must be substantially same for licensing or application
4. Applicant has resided in the Phil for at least 3 consecutive years (RA5181)

BOARD OF NURSING
where you present your completed application and certicates of registration as nurse
granted by the state or country and then, attach the ff:
1. Certificate of Commission on Immigration and Deportation (resides 3 years)
2. Copy of law or petition showing reciprocal practice with the Philippines.
3. Copy of their officially approved BSN Curriculum.

SEC 21: PRACTICE THROUGH SPECIAL OR TEMPORARY PERMIT


This is issued by the Board subject to approval of the Commission and the reasons
considered are only for:
A. Licensed foreigner nurses that service a fee or free if internationally well known
specialists or outstanding experts in branch or specialty in nursing
B. Licenses Alien Rns in medical mission (free services)
C. Licensed Alien RNs that are exchange professors employed by schools

*Provided, however that the special or tempo permit shall be effective only for the duration
of the project , medical mission or employment contract

REGISTRATION BY EXAMINATION:
A. Examination and Registration
Sec12: All applicants needing a Registration as nurses and issuance of COR and prof. ID card
are required to pass a written exam given by the Board and must also be fully compliant by
RA 8981

Sec 13: Qualifications for Admission to the Licensure Examinaton


1. Filipino Citizen or alien with substantially the same reqs
2. good moral character
3. BSN holder

B. Requirements for Examination


1. Original TOR and date of graduation
2. Record of actual RLE for entire BSN program signed by Chief nurse or rep and Dean.
3. Actual number of scrubs and deliveries assisted also signed same
4. Where applicable:
birth certificate, marriage certificate, Alien Certificate of Naturalization, Clearance showing
dismissal of case from the Court or Prosecutor’s ofc if any
* Application form and requirements should be filed by the PRC 10 days prior to the first day
of examination

C. Fees for exam and registration are set by the Commission

D. Scope of Examination: Sec 14


Determined by the board, which measures the level of competenceor proficiency rather than
the compartmentalized subject area of examination
Covers 5 Broad areas: Fundamental of Nursing, MCN, CHN, Nursing of Adolescence, Adults
and Aged and the Mental Psychiatric Nursing. Including: A and P, Pharma, Microbiology and
diet therapy

E. Citizenship Requirements
Sec 1 Citizens at the time of the adoption of this Constitution and those who elected
Philippine citizenship
Sec 2 Female Filipina marries alien retains Phil. citizen unless renounced by act or
ommission.
Sec 3 Philippine Citizenship thus may be lost or reinstated in manner provided by the law
Sec 4 Natural Born Citizen - no act needed to acquire or perfect the Philippine citizenship

Doctrines Sec. 4
Jus Sanguinis D. :nationality is based on law of his descent or parentage wherein child
follows the citizenship of his gather
Jus Soli D. : determined by place of birth; for a child born in a foreign country whatever the
citizenship of his father is a citizen of that country

F. Rating of the NLE on Sec 15


Passed only if you pass the 2 Criteria:
Gen average must be 75% and there must be no grade below 60% in a subject

If one of these two criteria is failed while the other criteria above the expected criteria, still it
is considered failed, and retake is another option

Renewal Examinations
This is taken within 2 years after the last failed examination

Reconsideration of Ratings
requests entertained are only mechanical, clerical errors or malfeasance in rating
This is filed 90 days from the date of the official release of the exam results only after review
of thetest paper can she file the request for reconsideration

Oath Taking for nurses


>This is required before the Board or any government official authorized to administer oaths
prior to entering the nursing practice, the schedule of mass oath taking (date and place) is
within 15 days upon the release of the results in a press released by the PRC.
>This is a pledge (support and defend the constitution, bear true faith and allegiance to
same, obey laws, legal orders and decrees promulgated by adherence to the ethical and
professional standards of nursing.
>The Commission and the accredited professional organization are present as nurses are
inducted as new members

Issuance of Certificate of Registration or Professional License


This is issued to those who passed upon payment of the prescribed fees
This has the:
1. full name and serial number
2. signature of the chairperson of Commission and Board members
3. Official seal of the Commission

Professional ID card
This is
1.signed by the chairperson of the committee
2. has date of registration
3.date of issuance and expiration

Annual registration: pays a fee for 3 years at the Professional ‘s birth. (if failed to pay, has a
surcharge of 20% each calendar year not paid; if after 5 continuous years not paid, COR
suspended and name will be dropped from the annual roster for not having been in good
standing and may be reinstated only after application and payment and may not take
another examination)
>If a practitioner wants to stop practicing his or her profession, must inform the Board in
writing 1 year prior to exempt annual fee payment. But if wants to resume again, can be
reinstated in the annual roster.
>The annual reg card must be presented to the BIR when paying tax; Official receipt of
evidence: reg card’s reg no., date of issuance, year shown on the card (thus payor is
authorized to practice the profession.

Automatic reg of nurse- once you appear in the annual roster of nurses, this is IPSO FACTO

Non registration and non issuance of COR or even Special Permit: if convicted by court of
crime or has unsound mind declared by court

Renewal of the Nurse’s license:


every three years with PRC not later than the due date in the license card
CPE: Continuing Professional Education
There must be total of 60 CPE credits to nurses with BSN degree and if you exceed the
credit, it cant be carried over to the next three year period except for doctoral and masteral
degree

Revocation or Suspension of COR:


As we may know, COR is not permanent because there are conditions that have been held
upon it.
Grounds to revoke or suspend the license:
a. all causes mentioned in RA 9173, sec 22
b. Unprofessional and unethical conduct
c. Gross incompetence or serious ignorance
d. Malpractice or Negligence
e.Use of fraud, deceits or false statements in obtaining CORor special permit
f. For practicing the profession during suspension of practice
note: suspension must only be in a 4 year period

Re issuance of Revoked Certificates:


After 4 years when cause of revocation has been cured or corrected, with proper application
and payment of fees may issue another copy. And, may also issue when COR has been lost,
destroyed or mutilated.

Suspension: nurse is not allowed to practice temporarily until final judgment , IT IS NOT
CONFISCATED.
Revocation: Confiscated temporarily or permanently

Prohibitions in the Practice of Nursing:


Fine: 50,000 to 100,000 and 1-6 yrs imprisonment orupon court discretion is imposed on the
ff:
a. without having COR or special permit
b. uses another’s COR or special permit
c. uses invalid special permit or COR: suspended or revoked or expired
d. gives ant false evidence to the Board to obtain COR or special permit
e. falsely poses or advertises as a nurse orany other means that tend to convey the
impression that shes a licensed nurse
f. who appends BSN or RN without a degree or registration
g. though a nurse, assists in illegal practices not lawfully qualified
h. any CEO or juridicial entity that conducts in service educational programs or review
classes for both local and national exams without permit or clearance from the board and
commission.
i. any employer who violates the minimum base pay of nurses, incentives and benefits

Due Process of Law:


since in the bill of rights, no person shall be deprived of life, liberty or property without due
process of law nor shall any person be denied equal protection of laws
>Term Due process of law= law which hears before it condemns, proceeds upon inquiry and
renders judgment only after trial
>Due process of law fundamental requirement: opportunity for hearing and defense

Fundamental Requirements of Due Process


1. accused is presumed innocent until the contrary is proved
2. right to free access to courts and adequate legalassistance
3. right to remain silent and have competent and independent counsel preferably of his own
choice , if cant afford, must be provided
4. right to bail and potection against excessive bail
5. right to be heard by himself and counsel
6. right to be informed ofthe nature of the cause of the accusation against him
7. right to have speedy, impartial and public trial
8. right to meet witness face to face
9. right against self incrimination
10.right when under investigation to remain silent and to counsel and to be informed of his
or her right
11. right against use of force, violence, threat, intimidation or anything that vitiates the
freewill
12. right against cruel and unusual punishment
13. right against excessive fines
14. right against double jeopardy

Chapter 3: The Licensing board


PD 223 is repealed by RA 8981, The Prc modernization act of 2000: it is when the prc of
nursing has the regulatory power to profession

Organization and Composition:


1 chairperson plus 6 board members represnting 3 areas in nursing namely nursing
education, nursing service and chn.
a. all records, application for exams, and other investigative cases of the board is under the
Commission
b. the commissions shall designate the sec of the board and provide secretariat and
supportive services of the board to implement provisions

chairperson and the the members


of the board are appointed by the president of phil and is confirmed by the commissioner on
appointment members of the board of nursing
Types of appointments:
1. Regular appointment: PNA certifies for appointment to the nsg board of the prc the 12
candidates and ranked accdly then forwarded to the commissioner of prc for further
screening. the commissioner then submits 6 from the list to the president of the philippines.
such appointment is confirmed by the commissioner on appointments.
2. Ad interrim appointment: board member is appointed in the meantime to fill a vacancy
druing the absence of a regular incumbent
3. doctrine of hold over: a member of the board is permitted to continue exercise fxns of ofc
after the end of his or her lawful term until replaced

a.Commission shall before the last year of the term of the board member notify and request
accredited professional organization of nurses in the phil to submit to the commission at
least 3 qualified nominees per vacancy
b. the accredited prof org shall rank said nominees and submit to the president of the phil,
two nominees, per vacancy, not later than 2 months before the vacancy and it must be 30
days before the scheduled lnle
c. necessary operating procedures to ensure the strict compliance therewith shall be
embodied in a memorandum of agreement by the commission andtheaccredited
professional organization of nurses.

QUALIFICATIONS OF CHAIRPERSON AND THE MEMBERS TO THE NURSING BOARD


a.natural born citizen and resident of the Phil
b.member of good standing of accredited prof org
c.RN and holder of a masters degree in nsg, education or other allied medical professions
d.must have at least 10 years of continuous practice, last five years of which must be in the
Philippines
e. musthave not been convicted of any crime

REQUIREMENTS UPON QUALIFICATION AS A CHAIRPERSON AND MEMBER OF THE BOARD:


a. immediately resign from any teaching position or admin supervision in nursing schools or
even in review programs (also, no pecuniary interest)
b. immediately resignfrom any office in the private sector and government, corps or
agencies
Pecuniary interest is the involvement ofhusband, wife, childrenrelativesin any activity that
conflict her position in the board

TERM OF OFFICE
Chairperson and members shall hold office of period of three years until their successors
shall have been appointed and qualified
a. no chairperson and member shall be appointed or reappointed for two terms or 6 years.
b. they must take proper oath of ofc prior to the performance of his or her duties
the incumbent chairperson and members of the board shall continue toserve until their
replacements shall have been appointed by the president and shall have been duly qualified

COMPENSATION OF BOARD MEMBERS are paid based on the principle of quantum merit
meaning, as much as they deserve

REMOVAL OR SUSPENSION OF MEMBERS: The president may remove or suspend any


member after heir she defends in a proper admin investigation:
Grounds:
a. continued neglect of duty or incompetence
b. commission or toleartion of irregularities in the nle
c. unprofessional, immoral or dishonorable conduct

POWERS, FUNCTIONS AND RESPONSIBILITIES OF VARIOUS BOARD


IN MODERNIZATION ACT OF 2000:
regulate the practice of the professions in accordance with the provisions of their respective
professional laws
monitors the conditions affecting the profession; maintenance of high professional ethical,
technical standards, ocular inspections in industrial, mechanical, establishments hospitals,
clinics, labs.
hear and investigate the cases arising from violations of their respective
