APPLICATION UNDER ORDER 39 RULE 1 & 2 R/W SECTION 151 CPC FOR THE
GRANT OF AD-INTERIM INJUCTIONS RESTRAINING THE DEFENDANTS FROM
PEACEFUL POSSESSION OF PREMISES SCO123,SECTOR 15, CHANDIGARH.

EXCEPT WITH THE DUE COURSE OF LAW DURING THE PENDENCY OF SUIT.

RESPECTFULLY SHOWETH:

1.That the applicant/plaintiff is filing the accompanying suit for permanent injunction and as per
the averments made therein, which may be read as part of this application, the suit of the
plaintiff to succeed.

2.That prima facie the applicant/plaintiff has a very good and is in continuous possession of the
demised premises for the last one year and there is every likely hood of his succeeding its main
suit.

3.That the balance of convenience very heavily lies in the favor of the plaintiff and against the
defendant. The suit of the plaintiff /applicant to be decreed with cost on merits.

4.That in case defendant/respondent is not restrained from interfering in peaceful possession of


demised premises i.e. front portion of……,except with due course of law the suit of
applicant/plaintiff would become infrastructure.
5.That the defendant has installed the affixtures for putting a sign board in front of demised
premises of plaintiff. A notice was sent to defendant in month of……for removal of sign board
as it interferes with the peaceful possession and enjoyment of the property of the plaintiff. The
defendant did not even care to reply to notice sent by applicant/plaintiff and after repeated
request the defendant has not removed sign board from the demised premises of plaintiff. The
copy of the same has been affixe3d as A5.

6.It is therefore humbly requested that the application may kindly allowed and order of
temporary injunction be passed restraining the defendant from interfering the demised premises
of the applicant/plaintiff of address.
