AFFIDAVIT OF EXPLANATION

I, MARIEKRIS G. BARCELOS, of legal age, single, Filipino,


and a resident of Vinzons, Camarines Norte after having been duly
sworn to in accordance with law, hereby state:

1. That I am the Unit Manager (OIC) of Center For Agriculture


And Rural Development (CARD) Inc. – Vinzons Unit, a micro-
finance non-government organization based in Vinzons,
Camarines Norte, attached herewith as Annex A is a copy of
CARD Inc.’s Certificate of Registration with the BIR;

2. That as an incident to its operations, CARD Inc. -Vinzons Unit


entered into a contract of lease with one Carmen De Mesa as
lessor for CARD Inc. to occupy and use a residential unit
located in Sta. Cruz St., Brgy. 1, Vinzons, Camarines Norte as
its office, a copy of the Contract of Lease is attached as Annex
B;

3. That said contract of lease had a term beginning on May 10,


2018 and ending on May 10, 2019;

4. That as Unit Manager (OIC) of CARD Inc. - Vinzons Unit, I


was tasked to oversee the renewal of the contract of lease;

5. That unfortunately, despite diligent efforts, I was unable to


reach an agreement for the renewal of the contract of lease for
the following reasons:

a) The purported lessor Carmen De Mesa could not present


any proof of authority from the alleged owner Jennel
Rosales to renew the lease. She could only provide a
letter from one Roberto Rosales attesting to the fact that
the subject property was already sold to Jennel Rosales,
a copy of said letter is attached herein as Annex C;

b) The tax declaration of the leased property is still in the
name of the previous owner Roberto B. Rosales, a copy of
the Declaration of Real Property of the house and lot
involved is attached as Annex D and E, respectively;

c) Both Roberto B. Rosales and Jennel Rosales are now said


to be living overseas;

d) The alleged owner of the property, Jennel Rosales, had


already communicated her intention to sell the leased
property and thus, she is no longer interested in
renewing the lease contract;

5. That I am executing this affidavit to attest to the truth of the


foregoing statements and to provide a clear and satisfactory
explanation as to the circumstances surrounding the non-
renewal of CARD Inc.’s contract of lease.

IN WITNESS WHEREOF, I have hereunto set my hand this


14th day of December, 2019, in Daet, Camarines Norte.
