AFFIDAVIT

I, ___________________, of legal age, Filipino, Married and a


resident of _______ UP Bliss San Vicente Philcoa Quezon City, after having
been duly sworn to in accordance with law, depose and state:

1. That I was present and personally saw the newsletters being posted on our
building / premises which has signature of Mrs. Lolita Donato;

2. That I know personally the complainant our UP Bliss Association President


Manuel E. Roque and the respondent our Ex Vice President (Internal) Mrs.
Lolita Donato from whom they serve and belong to as our UP Bliss Officers
for 2017;

3. That Mrs. Lolita Donato’s different newsletters posted publicly on our


Building bulletin board;

4. That the said newsletter which was posted last February 28, 2018 was
supposed to be an invitation of orientation to HLURB;

4. That the said newsletter has an attachment of 4 additional page that


constitutes all the Violations on the constitution of UPBCAI;

5. That after reading the said attachment, I saw on the 4 th page about the
alleged withdrawal of the President and the Secretary amounting to P125,000
that doesn’t state where the money was being used to;

6. That I, being a resident of UP Bliss and a member of the UP Bliss Association


as a _________________ knows for a fact that the said amount that was
being used to rehabilitate the UP Bliss Suntay Multi-purpose hall electrical
system as discussed on the Minutes of the Meeting Dated October 14, 2017;

7. That I, saw the contract of Acts manila ( the one who is renting the UP Bliss
Suntay Hall ) as their place of worship and the UP Bliss Association represented
by our President Manuel E. Roque signed a contract agreement for the
electrical rehabilitation of the Suntay hall;

8. That the said contract agreement is also posted in our website


www.upblisscommunity.com for everyone to see;

9. That we all know, that the amount of P250,000 for the payment to the
contractor ( Labor and Materials ) for rehabilitating the electrical system of UP
Bliss Suntay hall will be shouldered by Acts manila and UP Bliss Association.
That the amount of P125,000 will be split on both parties;
10. That the alleged withdrawal of the President and the secretary contained
malicious imputations and purposely to malign, dishonor, insult and
assassinate their character;

11. That the said newsletter that is being distributed by Mrs. Lolita Donato
created in the minds of our community member and readers imputing stealing
of the association money;

12. That the said newsletter was publicly posted in our gate, bulletin boards
and mailboxes;

13. That I executed this affidavit to attest the truthfulness of the foregoing
facts and to support the filing of criminal case against Mrs. Lolita Tismo
Donato for violation of Libel.
