Judicial Affidavit of Ma. Consuelo Palma Gil-Roflo

This Judicial Affidavit was taken on 27 July 2018 conducted by Atty. April
Sillada at Sillada Law Firm, Door 1 ABC Building, General Luna St., Davao City.

Offer of Evidence

Private complainant Stella Caba, offers this judicial affidavit executed and
attested to by Ma. Consuelo Palma Gil-Roflo to prove: [1] She was at Jacinto St.,
Davao City, within the vicinity of Ateneo de Davao University around 4 o’clock in
the afternoon of 14 July 2018; [2] She saw the accused rushed to the side of
Stella Caba and with a sharp-pointed instrument, intimidated her into parting with
her “Marc Jacobs” bag that contained valuables; and [3] When she refused, the
accused forcibly pulled the bag from Stella’s arms causing her to fall to the
ground and sustain minor injuries

Direct Examination

Q1: Can you please state your name, age, status, and address for the record.

A: I am Ma. Consuelo Palma Gil-Roflo, of legal age, married and a resident of


Buhangin, Davao City.

Q2: Are you working?

A: No.

Q3: If you are not working, may I know what do you do?

A: I am a 4th year law student of the Ateneo de Davao University.

Q4: If you can recall, where were you on July 14, 2018 at 4o’clock in the
afternoon?

A: I was near Ateneo de Davao University, particularly, along Jacinto St.

Q5: What were you doing there?


A: I just arrived, and I was parking my car.

Q6: When you were parking your car, did you see anything unusual?

A: Yes.

Q7: What did you see?

A: In my right-side mirror, I saw a strange man rushed to the side of my


classmate, Stella Caba. The man, who was about 5’10 in height and had fair
skin, was holding a sharp-pointed instrument, or what seemed like an ice pick,
and pointed it at Stella.

Q8: What happened next?

A: Stella refused to give the Marc Jacobs bag, so the man forcefully grabbed the
bag and ran towards the direction of Union Bank. Stella, by that time, was thrown
to the ground.

Q9: What did you do after?

A: I was shocked and a bit scared at first. Then, I dialed 911 and called for the
police. The police arrived 5 minutes after, but the man had already run away.

Q10: Do you know who that man was?

A: No, but I came to know later on that he was Geomar Ejercito, when I learned
he surrendered at the police station the next day.

Q11: Can you identify that man when you see him?

A: Yes, I can still remember his face and how he looked. I can point to him when
necessary.
