Sub:- Work order for carrying out contract of internal Tiling works for Club house, for our
proposed Residential project “ABC Constructions” at Baner-Pashan Road, Pune.

A) Scope of work :
The scope of the work broadly includes Labor Contract of Internal Tiling for Club house
at ABC constructions
1. Work allotted to you in Ground floor, Toilets, Dado, Gym and Stair case
2. All the necessary resources, Man power, Shifting of material, Tools& Plants etc, are in
contractor’s scope
B) Mode of Measurement:-
The work will be carried out on Labor rate per item. Actual joint measurements shall be taken
at site and you will be paid as per actual measurements.
C) Terms and conditions :
1) TDS as applicable shall be deducted from the Contractor's payment bills.
2)Tiered such as GST will be applicable as per Government rules.
3) Approved Rates are inclusive of Joint Filling and Groove Filling

4)Bod mortar for laying of tiles will be minimum 50 mm tile top. No Extra payment will be made
fior height variations.
5) Material used for bed mortar will be according to the standard proportions and instructions
given by EIC

6) The materials required for execution of civil work on labor basis shall be provided free of cost
by and the same material only shall be used for execution of said civil works on Inbor basis.
Permissible wastage limit for Cement shall be 3% and for Tiles 5%. If the wastage is more than
the Standard nomis then the excess wastage shall be debited to your account decision of the
Project Head shall be final in this matter.

7) The Employer will make an arrangement for Electrical Power for construction and for labour
camp also

8) Defect Liability Period for the sold job is three months from the date of completion &
Handing over of total Job

9) The rates are fixed till the completion of the project along with joint filling and no escalation
in mites Will be entertained by contractor.

10) Water will be supplied free of cost by the Employer. No claims for hold up or delay in Work
on this account shall be entertained.

11)5% Retention money towards the security deposit will be deducted from the entire interim
bill for the period of three months. No interest will be payable on Security Deposit & Retention
money

12) The Contractor shall take all the necessary precautions to protect existing structures etc
from any damages

13) Rate analysis and prior written approval of PM is necessary for extra items.

14) The Contractor should not engage labor below 18 years old and the contractor should pay
the wages to the labor as per the minimum wages act as per the circular issued by Labor
Commissioner, Mumbai, time to time. If any accident takes place, then the Contractor will be
fully held responsible. The Contractor shall submit Workman Compensation Policy, Insurance
Group Insurance / ESIC Scheme, if applicable

15) RA Bills will be prepared and submitted every fifteen days along with supported
measurement sheets for work carried out and the required reconciliation statements for
consumption of materials as per the agreed terms & conditions by the contractor.
16) No Extra payment for rework, ie rework done due to faulty (bad quality) work, Client
complains at the time of possession.

17) The Contractor shall obtain all necessary permits, licenses, sanctions from all regulatory
authorities in connection of Labor and comply with all rules and regulations. Copies of workmen
compensation Policy, Labor License registration with Sales Tax authorities, Provident fund
regulations shall be submitted to the Employer as and when required and asked for Contractor
shall indemnify the Employer, Architect and Consultant from any disputes of what so ever
nature arising out of labor laws and regulations.

18) Period of Maintenance / Defects Liability (DLP) shall be effective for six months from the
date of handing over the possession of the completed work by Contractor. If any work will not
be rectified by the contractor within stipulated time, then, the same will be executed by the
employer und actual cost incurred for rectification plus 10% supervision charges extra will be
debited to the contractor's account directly without any intimation

19) Immediately prior to handing over the works, the Contractor shall thoroughly clean all
buildings und external paved areas and generally clean the Works to the approval of the EIC.

20) The rates of various items to be executed shall be as per the bill of quantities enclosed
herewith as “Annexure A” this work order. The payment will be made as per actual quantities
of the work carried out as per working drawings and jointly measured and certified by EIC. The
individual quantities may vary to any extent and Contractor shall have no claim whatsoever for
the change in quantities of any item(s). The owner reserve the right to add, to omit and to alter
the work shown on the drawings and described in the schedule of Bill of Quantities in Annexure
A to this agreement and this shall not invalidate the Contract.

21) The rates quoted in the work order shall include all input costs and charges for tools, plants,
temporary water and electric connections (if any, hire charges if any, maintenance of all
services and equipment for clearing the site etc, for the execution of the works shall also
include all taxes such as Sales Tax, Octroi Duty, Excise or any other duties and levies of any
public body or corporation (duly authorized to collect)

22) Safety Clause - The owner shall not be liable for or in respect of any damages or
compensation payable at law in respect or in consequence of any accident or injury to any
workman or other person in the employment of the contractor or in the employment of the
contractor.

23) Insurance Compliances - The contractor has to submit Aadhar Number and Savings Account
details along with documentary proof for each labor at site to the Project Manager
24) Quality - Quality is an integral part of work & no let ups on part of the contractor will be
entertained by employer.

25) All substandard works/materials rejected by project in charge/architects consultant will be


redone by the contractor this own count & risk.

26) The owner shall not be liable for or in respect of any damages or compensation payable at
law in respect or in consequence of an accident or injury to any workmen or other person in the
employment of the contractor or in the employment of the sub-contractor.

27) Safety Agreement - It will be the Contractor's sole responsibility to ensure that there is no
accident and there is no casualty in any manner by providing sufficient safety measures and or
as may be required by the Law. In any case, if any liability arises on this account, it will be The
Contractor's responsibility and on The Contractor's account. The Contractor will take all
required Insurance Policies including Contractor's all risk policy. The insurance premium
towards third party (IP) liabilities and all the necessary insurance premiums related to
Contractor's Workmen Compensation, Plants and Equipment, Pilferage etc, shall be arranged
and bone by the Contactor and proof of the same shall be submitted to the EIC. You will also
have to sign safety agreement before execution of work.

All above stipulated point's viz work, time period, terms and condition mentioned in this Work
Order has been agreed with mates mentioned in Annexure "A-Bill of Quantities.

The Work Order is being issued with the mutual understanding that any conditions stipulated
by you in your offers are not binding upon us and the terms and conditions of the tender and
subsequent addendum, corrigendum to it are final and shall be binding upon both of us

1. Readily accessible First Aid Kit including adequate sterilized cotton and dressing shall be
provided on site.

2. Any injured person shall be taken to nearest public hospital without delay

3. All workmen working at heights shall be provided with PPE like safety harness, safety belts,
safety shoes & Helmets, etc. 8 meters, In case of ladders above 8 meters additional man

4. Portable Ladders shall be of heights less than shall be provided for holding the ladders.

5. Workers abused in welding and related works shall be provided with protective eye shield
and gloves

6. The openings shall be provided with necessary signals barricades, obstacles etc. All the
electrical connection taken for construction purposes full have thing wires provided for
equipment earthing.

7. Open/temporary joining of the cables shall be avoided and all connection shall be taken
through proper sockets plug tops, Insulated joints and switches etc & Live wires shall not be laid
on ground road or taken on surface without protective cover

8. Live wires shall not be laid on ground/road or taken on surface with-out protective cover

9. All Work and Supervisors shall be provided with Helmet Safety Caps. All Visitors/Engineers
shall also wear Helmets when moving sites

10. Safety apps und love of appropriate class shall be wed for all testing commissioning
activities Proper care through danger notice boards, personal vigil shall be taken during such
operation to avoid Injury and damage.

11 Protective switchgear shall also be used for all temporary works

12. Safety tool box shall be conducted by Safety steward /Safety officer on daily basis and
report to be shitted to client/project manager.

Notes : Penalty will be proposed by client/project manager in case contractor fails to follow
above safety & rules and complete the works as per agreed timeline
