Application for Permanent Alimony and Maintenance under Section 37


and 38 of the Special Marriage Act, 1954 Read With Section 7(1)(A) of
The Family Courts Act, 1984
The applicant submits as under:
1. That the Applicant was married to the Respondent at Goa on the 25 th
day of November, 2002 and the marriage was solemnized and duly
registered by the Marriage Officer at Mapusa, Goa.
2. The Applicant has filed a suit for divorce against the respondent and
the same is pending before this Hon’ble Court.
3. That the applicant, Mrs. Jacinta Verma, was a housewife in the
companionship of respondent husband, Mr. Manish Verma, and that
the applicant has no independent source of income sufficient for
subsistence as was expected out of the marriage.
4. That the Applicant and her two children Jessi aged 8 years and Jis
aged 4 years, are dependent on the Applicant’s father Mr. Aloysius
Paul, who is working as the Principal of St. Michaels School, Arpora.
5. That the applicant owns no other movable or immovable property or
any other source of income other than the earnings of her father, Mr.
Aloysius Paul.
6. That the respondent is an Architect in SVC Designers, drawing a gross
monthly salary and allowance of Rs. 75,000/-( Rupees Seventy Five
Thousand only) per month.
7. That the Respondent has a bungalow at Hyderabad, and an
apartment in Keshavnagar, Pune, wherefrom he derives Rs. 35,000/-
(Rupees Thirty Five Thousand only) as rent.
8. That the only person dependent upon the respondent is the applicant
and the two children born to them out of wedlock.
9. That the respondent has refused to pay maintenance to the applicant
prior to this suit.
10. That the Applicant has incurred litigation expenses of
Rs.10,000/- in bringing the above proceedings.
11. That the applicant has not conducted herself in any way which
would disentitle her from receiving maintenance from the respondent.
12. That the Applicant claims Rs. 50,000/- per month as
maintenance for herself and her two children on the basis of budgeted
expenses, which is annexed to this application as Annexure B.
PRAYER
The applicant humbly prays before this Hon’ble Court to direct the
respondent to pay the said sum of Rs. 10,000/- as expenses for the
above proceedings and Rs. 50,000/- per month as maintenance for
the applicant and her children or such sum as may seem to the
court to be reasonable.
