AFFIDAVIT
2. From Prosperidad, Agusan del Sur, we used as private transport vehicle the
Toyota Grandia bearing plate number AAW 1315 owned by Ms. Guadalupe
Laylo.
3. But before we proceed to the actual site, I invited Ms. Thelma Capua, another
friend working in the Land Transport Terminal in Tagum City, to come and
guide me to the location of the property.
4. On our way back to Prosperidad, Ms. Thelma Capua asked Ms. Guadalupe
Laylo to give a free ride to eight (8) persons in bus terminal, because their
Public Utility Bus bound for manila was then having a mechanical problem.
5. Ms. Guadalupe Laylo accedes to the request since her private van was also
bound for Manila, the place of residence of the former.
6. In the Highway of Tagum City at around 8:32 in the evening, we were flagged
down by personnel of Land Transportation Office (LTO).
7. One of them instructed us to alight from the vehicle and informed us that the
vehicle is colurum and impounded the same in their office.
8. That we tried to reason out that the vehicle was not operating as PUV nor
collect any fees for the passengers therein, and this was confirmed by them at
that time.
9. That the use of such vehicle was solely for private purpose and the passengers
therein were merely accommodated upon the request of Ms. Thelma Capua.
10. That Ms. Guadalupe Laylo did not ask for a fee from the passengers for
purposes of transportation to Manila, but only did so for humanitarian
considerations.
11. That I am executing this affidavit to attest to the veracity of the foregoing
particularly to testify that Toyota Grandia bearing plate number AAW 1315
owned by Ms. Guadalupe Laylo did not operate as a public utility vehicle and
merely gave a free accomodations to eight passengers bound for Manila out of
kindness.

I would like to request for reinstatement of my St. Peter LPA with Contract
bearing LPA No. N15073430D, which has been automatically terminated and cancelled
as provided in the pertinent provisions of the Contract, due to my failure to pay
installments within sixty (60) days from due date.
Before it was terminated, I made 35 instalments for my policy and now has a
remaining balance of P23,750 to be paid. Should this request be granted, I will pay the
entire balance.
