AFFIDAVIT OF LOSS

I, the undersigned, of legal age, Filipino, single and with office address at
Km 12, Diversion Road, Panacan, Davao City, Philippines, under oath state that:

1. I presently work as paralegal at Vicente T. Lao Construction;

2. I was served with summon attached therewith is a complaint from


the Regional Trial Court in Cities Branch 42 of City of Koronadal,
for a case entitled Sps. Wilfredo L. Almodia, and Erlinda L. Almodia
and Filoteo M. Enopel vs. Vicente T. Lao Construction and
Raymond Antalan Mongcal with civil case no. 2356-42;

3. That the original copy of said summon together with other


documents were kept in my envelope after my transaction with our
lawyer;

4. That upon checking my documents sometime on December 23,


2019, I discovered that the original copy of said summon together
with its attachments is nowhere to be found in my files;

5. That I have exerted diligent efforts to retrieve the files but all my
efforts were in vain;

6. That I am executing this affidavit to attest to the truth of the


foregoing declarations and for whatever legal purpose this may
serve.

IN WITNESS WHEREOF, I have hereunto set my hand this 2nd day of


January 2019 at Davao City, Philippines.
