WRITING TIME: 5 days Pass Marks: 25

Section One: Analytical Questions/ Answer (Total 30 Marks)


In this section, candidates are required to answer any three questions. Each question is worth 10 marks.
1. How do you assess Nepalese Legal system with civil law system and common law system?
2. Do you find favorable legal environment to run business in Nepal? Give key suggestions to maintain investment friendly
environment.
3. Why and How do we legally protect the copyright from infringement by others?
4. How can you assess the limited Liability Company differs in many ways with proprietorship firm? Explain with example
and cases.
5. Do you think contract is valid without essential elements? Elucidate the situation that minor enters into the contract.

Section B: Case Study/Problem Solving


In this section, you are suggested to read the given case or situation and require to answer all questions. Each question is
worth 5 marks.
A) Suppose A offered to 'B' to purchase his shop for Rs.5 lakhs. Relying to 'A's request 'B' said he would not accept less than
Rs. 7 lakhs. 'A' agreed to this price but 'B' sold shop to 'C' for a still higher amount. Answer the followings questions with
legal ground and reasons. (5+5 = 10)

(i) Do you think there was a valid offer and acceptance between A and B?
(ii) Could B stop selling shop to C?

B) A enters into a contract with B for buying motor car as agent of C and without C's authority. B rejects the contract before
C comes to know of it. C subsequently ratifies the contract and sues to enforce it. Answer the following questions with legal
ground and reasons. (5+5 = 10)
i) How can you define such type of agency contract?
ii) Can C enforce the contract?
