RHODES COLLEGE ALUMNI AGAINST

AMY CONEY BARRETT’S NOMINATION

Dear President Hass,

We, the undersigned, are proud Rhodes alumni. At Rhodes, we learned the values that have
animated our alma mater since 1848 and that still emblazon the college seal: Truth, Loyalty, and
Service. Our alma mater also taught us how to think critically; how to value and evaluate facts and
information; and how to relate to, and respect, those who disagree with us.

Many of us also were contemporaries of, friends of, and even sorority sisters of Amy Coney Barrett,
who is now President Trump’s nominee to fill the Supreme Court seat of the very recently departed
Justice Ruth Bader Ginsburg.

However, despite the respect that many of us hold for her intellect, and even the friendship that
many of us held or continue to hold with her, we are firmly and passionately opposed to her
nomination.

We are likewise firmly and passionately opposed to Rhodes administrators’ attempts to embrace
Amy Coney Barrett as an alumna of our beloved alma mater. We oppose this embrace because we
believe both her record and the process that has produced her nomination are diametrically opposed
to the values of truth, loyalty, and service that we learned at Rhodes.

TRUTH: Amy Coney Barrett has repeatedly obfuscated, when it was convenient for the
advancement of her judicial career, about issues central to the personal autonomy of Rhodes alumni.
This is particularly true of issues related to Rhodes’ LGBTQ and female alumni.

During her 2017 Senate confirmation hearings for her current seat on the United States Court of
Appeals for the 7th Circuit, Judge Barrett dutifully sidestepped direct questions about how she
would rule on a challenge to the right to abortion that the Supreme Court protected in its landmark
1973 Roe v. Wade decision. “As for your question about Roe, I think that the line that other nominees
before the committee have drawn in refraining from comment about their agreement or
disagreement or the merits or demerits of any Supreme Court precedent is a prudent one,” she said,
adding that, as a member of the 7th Circuit appellate court, she would “follow all Supreme Court
precedent without fail.” She deferred to the jurisprudential concept of stare decisis -- a Latin term for
“let the decision stand.”

What she failed to note is that, while past Supreme Court precedent is binding on the lower federal
courts (like the 7th Circuit), she would be bound by no such constraints were she to join the
Supreme Court. Indeed, any Rhodes alumnus who understands what the names Plessy v. Ferguson and
Brown v. Board of Education mean gets the concept. And her legal writings suggest she is more than
ready to jettison the concept of stare decisis on the Supreme Court if she is elevated to that body.
Indeed, in a 2013 article for the Texas Law Review, she wrote: “I tend to agree with those who say
that a justice’s duty is to the Constitution and that it is thus more legitimate for her to enforce her
best understanding of the Constitution rather than a precedent she thinks is clearly in conflict with
it.”

It is important to note that, for six years while she taught at the Notre Dame Law School, Judge
Barrett belonged to the Notre Dame chapter of the anti-choice group University Faculty for Life.
And, as anyone who has paid any attention to Supreme Court nominations for the last three decades
knows, the Federalist Society would only vet and approve a nominee who they believe is willing to
overturn or seriously curtail Roe v. Wade.

During her 2017 confirmation hearings, Judge Barrett also obfuscated about her association with an
anti-LGBTQ organization that the Southern Poverty Law Center -- an Alabama-based nonprofit
that studies hate groups more intensely than any organization in the United States (with the possible
exception of the FBI) -- has labeled a hate group. In fact, the Alliance Defending Freedom (ADF,
formerly known as the Alliance Defense Fund) has openly advocated for laws in foreign countries
that would criminalize homosexuality and even defended European laws that forced the sterilization
of transgender people. In the United States, ADF has also repeatedly advocated in U.S. and state
courts and legislatures against the rights of LGBTQ people and has falsely and repeatedly linked
LGBTQ people to pedophilia.

Despite this despicable and well-publicized reputation -- and when confronted with facts about
ADF’s past advocacy against LGBTQ people around the world -- Judge Barrett, in her 2017 Senate
confirmation hearing, attempted to deflect questions about it. “It has never been my practice to
investigate all of the policy positions of a group that invites me to speak,” she said, in response to
questioning about her work with ADF. But when confronted with the fact that ADF was a hate
group, she claimed she was unaware of its positions and said, “I never witnessed any discriminatory
conduct in any way.” She then challenged the very idea that ADF is, in fact, a hate group. “ADF, if it
were truly a hate group, it wouldn’t be co-counsel right now” on a Supreme Court brief with a top-
flight Washington law firm, she said. She added, “I gather that the Southern Poverty Law Center’s
designation of ADF as a hate group is controversial.”

Amy Coney Barrett has repeatedly shaded the truth about her own views and past associations. She
does not honor the Rhodes value of adhering to the truth.

LOYALTY: Judge Barrett also fails the Rhodes values test on the grounds of loyalty. Indeed, many
would argue that by even accepting President Trump’s nomination less than two months before an
election, she is endorsing the rank hypocrisy and disloyalty to their own claimed principles of the
Republican senators who blocked President Obama from appointing Merrick Garland to the
Supreme Court more than eight months before the 2016 presidential election, but who are now
vowing to rush her nomination through the Senate. But even Judge Barrett’s own words on this
topic indict her. In a 2016 interview with CBS News about the death of late Justice Antonin Scalia,
she argued that it would be inappropriate for a Democratic nominee to replace the ultra-
conservative Scalia in an election year because it would “dramatically flip the balance of power” on
the Court.

SERVICE: Judge Barrett also fails the test of Rhodes values when it comes to service. Since being
appointed to the U.S. Court of Appeals for the 7th Circuit, Judge Barrett has demonstrated a judicial
philosophy and record that fails to serve and protect the vulnerable in our society, including
immigrants, those in the criminal justice system, and individuals reliant on the Affordable Care Act
(the “ACA”) for health insurance. Rather, Judge Barrett has shown a propensity to protect corporate
interests over those of private individuals.
Judge Barrett agreed with the denial of a visa for the Yemeni wife of a U.S. citizen by a consular
officer on the basis that the woman was attempting to smuggle her children into the United States,
despite evidence provided by the woman that her children had died in a drowning accident. With
respect to immigrants who may depend on government assistance, Judge Barrett has argued for
increased enforcement of the “public charge rule” in determining whether a noncitizen should be
denied a green card on the basis that an individual who may need to rely on the government to
“satisfy a basic necessity for a year, or multiple basic necessities for a period of months” lacks self-
sufficiency. She has also upheld the deportation of a 30-year legal permanent resident of the United
States and of a Salvadoran individual seeking asylum due to fear of torture by gang members after
having witnessed a murder.

With respect to defendants’ and prisoners’ rights, Judge Barrett dissented from an opinion holding
that a defendant was denied his Sixth Amendment right to counsel when his attorney was not
permitted to speak during a pre-trial hearing based on her assertion that the state court’s decision
should stand. She also dissented in a case involving prison violence during a fight between inmates,
claiming that there was no evidence that prison guards were shooting at the prisoners (but, rather, at
the ceiling) and, as the majority notes, she suggested that firing two shotguns loaded with buckshot
into the ceiling of a crowded dining hall cannot be deemed to be malicious and sadistic or even
characterized as an intentional application of force without a showing that a guard intended to hit or
harm someone.

Judge Barrett has consistently evidenced her disapproval of the ACA, a statute that helps to ensure
access to healthcare for millions of vulnerable people who may not otherwise have access, such as
individuals with pre-existing conditions. She has publicly criticized Chief Justice John Roberts’
decision in NFIB v. Sebelius, which upheld Congress’ power to enact the ACA, and has also publicly
denounced the ACA’s requirement that employers provide access to birth control in their insurance
plans.

Judge Barrett has demonstrated a willingness to act in favor of corporate interests and reduce the
protections afforded to the public, including workers, by upholding a “separate yet equal” practice
of assigning employees to stores based on race; by ruling that the “disparate impact” provisions of
the Age Discrimination in Employment Act do not apply to job applicants, but rather only to
current employees; and by denying GrubHub workers access to courts to seek mandatory overtime
pay, instead requiring the employees to seek redress through arbitration. Despite the current gun
violence crisis, Judge Barrett has voiced her support of expanding gun rights to certain convicted
felons.

Because of these serious violations of the values we learned at Rhodes, we urge the Senate to reject
her nomination. More importantly to us as proud Rhodes alumni, we implore you to make very clear
that: (1) Rhodes opposes intolerance, discrimination, and bigotry of all kinds; and (2) that Rhodes
stands with its LGBTQ, female, minority, and other marginalized students and graduates who fear
that their rights may be endangered by the lifetime appointment of Amy Coney Barrett to the
highest court in the land.
