CONSTRUCTION CONTRACT AGREEMENT

Know all me by these presents.

This Construction Agreement made and entered this ___ of December 2015 at
Binalbagan, Negros Occidental, Philippines by and between:

SUSAN GO CHENG, of legal age, and resident at Binalbagan,


Negros Occidental, hereinafter to as the OWNER;

- and -

LICMAR BUILDERS, a company organized and existing under and by


the virtue of the Laws of the Republic of the Philippines with office
address at Phase 11, Gregoria Village, Kabangkalan City, Negros
Occidental, Philippines represented by its Opreations Manager, Engr.
Lican H. Gayares, licensed Civil Engineer, hereinafter referred to as the
CONTRACTOR;

WITNESSETH

WHEREAS the OWNER desired to avail and engage the construction services of
the CONTRACTOR for the proposed project more specifically:

-which covers the labor costs only and for the supply of labor workforce and
workmanship in the above-described construction project;

WHEREAS, the for construction and any and all related services, the
CONTRACTOR shall be paid in the amount of _______________________________
Pesos (P____________);

WHEREAS, the CONTRACTOR assured that it is a competent and reliable to


furnish the technical engineering, supervisions, labor and workmanship, tools and
equipments necessary to complete the works in accordance with the design and
specifications stated and stipulated on the plans and has offered its quality services to the
OWNER;

NOW THEREFORE, for and in consideration of the foregoing, the OWNER and
the CONTRACTOR agreed the following:

1. DEFINITION OF TERM:

The Contractor shall be referred to he said agreement and shall include all
employees and/or anyone who are working with the construction of the premises pursuant
to the agreement between the OWNER;

2. PROJECT WORKS

As clearly defined and explained to the OCNTRACTOR in the terms of the plans,
designs and specifications, complete bill of materials and quality, complete costing and
structural analysis, the scope of works shall include:

The CONTRACTOR shall execute the works as per design base and
specifications as provided for the purpose if the project work premises.

The project work shall be strictly in accordance with the plans and specifications
documents enumerated as per scope of works detailed in the complete bill of materials
and quality which is hereby confirmed by both parties the CONTRACTOR and the
OWNER.

The materials as required to be used by the contractor shall always be of best


quality and shall at all times ensure that the materials used are as per quality and reliable
as mentioned in the rate analysis, structural analysis and in compliance with the industry
standard;

3. OBLIGATIONS”

The CONTRACOR shall secure the necessary work and building permits from
the concerned government agencies before commencement of actual construction works;

The CONTRACTOR shall execute all the works with due care and diligence and
shall employ all technical persons that are qualified and experienced to execute said
project;

The CONTRACTOR shall always ensure the execution of the project works are in
accordance with the contract documents and shall have any authority to major/minor
changes in the works with proper coordination to the OWNER, thus any deviations under
and/or circumstance on the plans and specifications and in the manner the
CONTRACTOR shall always inform the OWNER in advance for the details and of the
purpose for such changes;

The CONTRACTOR shall be fully responsible for all the activities connected
with the proper and timely completion of the project ;

The CONTRACTOR will observe and shall ensure observance and confirmation
to all applicable laws and standards of business ethics and honest business practices and
shall refrain from any acts in the manner that could materially harm reputation and
goodwill of both parties.

The CONTRACTOR shall not abandon the project and should there be part of the
construction work that was found not more than one (1) year after the turn-over of the
project, the CONTRACTOR shall render repair works on said substandard work free of
charge;

4. MODE OF PAYMENT
a. Upon the execution of this CONTRACT, the OWNER shall pay to the
CONTRACTOR the sum of __________________ (P________) as mobilization be as
well as to cover the costs of all the necessary permits from the concerned government
agencies such as but not limited to the Office of the Building Official (OBO), office of
the Mayor, Barangay, etc;

b. Upon the execution of the Contract, the CONTRACT shall prepare a BILL OF
MATERIALS, for which the OWNER has the sole obligation to purchase and procure
and have them delivered to the project site at least five (5) working days prior to

commencement of the actual construction works, in this connection, the CONTRACTOR
shall also indicate in the BILL OF MATERIALS the estimated commencement of actual
construction works;

c. The CONTRACTON be paid in the following manner:

i. 25% of the actual labor costs mentioned in the WHEARAS


CLAUSE above, upon completion of 25% of the actual
contruction works;
ii. 25% of the actual labor costs mentioned in the WHEARAS
CLAUSE above, upon completion of 50% of the actual
contruction works;
iii. 20% of the actual labor costs mentioned in the WHEARAS
CLAUSE above, upon completion of 75% of the actual
contruction works;
iv. 30% of the actual labor costs mentioned in the WHEARAS
CLAUSE above, upon completion and turn-over of the project to
the OWNER.

IN WITNESS WHEREOF, we have hereunto affixed our signature
