This is the information of Sgt Angela HAWRYLUK, a peace officer and member of the Royal Canadian Mounted Police (RCMP). I have personal knowledge of the information in this information to Obtain (Affidavit), except where otherwise stated. | believe all of the information in this affidavit to be true. I have been a member of the RCMP for twenty-eight years. In June of 2019, | was transferred to the Legal Applications Support Team (LAST), where | am currently posted. Prior to being at LAST, | was posted to the Combined Forces Special Enforcement Unit (CFSEU) from 2015 to June of 2019. The main mandate at CFSEU dealt with Outlaw Motorcycle Gang (OMG) activity and the primary criminality involved was the trafficking of illegal controlled substances. From 2013 to 2015 | was posted to Halifax Detachment RCMP as a general duty investigator. Prior to that | was posted from 2000-2013 in federal units, where | became involved in investigations involving offences pursuant to the Controlled Drugs and Substances Act. | have conducted investigations pertaining to offences pursuant to the Criminal Code, Controlled Drugs and Substances Act, Customs and Excise Act, and other federal and provincial acts. | have been involved in investigations where information is obtained by means of conventional police techniques (such as surveillance, information from witnesses, Page 2 of 94 v information obtained as a result of the execution of judicial documents (such as Search Warrants, Transmission Data Warrants, Tracking Warrants, General Warrants, and Production Orders), information from forensic analysis, and information from confidential informants) and also with the interception of private communications and undercover operations. During my career, | have prepared General Warrants, Search Warrants, Transmission Data Recorder Warrants, Tracking Warrants, Production Orders and Part VI Authorizations (both third party and One Party Consent). During my service with the RCMP I have been involved with the handting of confidenital informants who provide information on the condition of confidentiality, The majority of my career has been in Federal Policing, predominantly in drug units investigating offences pursuant to the Controlled Drugs and Substances ‘Act. {have been involved in several project related investigations in roles such as Team Commander, Lead Investigator, File Coordinator and as an affiant (both for part VI judicial applications and non-Part VI judicial applications). Some of these investigations have utilized undercover operators and police agents. | have been involved in several investigations where private communications were intercepted via Authorizations and have been responsible for listening to the intercepted communications to determine patties involved in the communications and to provide a synopsis of the conversation. Based on my involvament in these investigations | am familiar with street names, pricing from street level to importations, packaging, and distribution methods of illegal controlled substances, Ihave successfully completed courses which | believe assist in the preperation of judicial applications, which include, but not limited to, the RCMP Interception of Private Communications Course in February 2003 and the RCMP Human Source Management Course in December 2004. Presently, | am involved with the facilitation of the RCMP Interception of Private Communication Course, and the RCMP Search Warrant Drafting Course. Throughout this Affidavit, where | state my belief, the belief is based on my ‘experience as set out above and on the other information in this Affidavit, The manner in which | have obtained information includes: 5.1. Information obtained from databases; 5.2. Speaking personally with police officers and/or reviewing investigative reports and/or email who are involved with the investigation; 5.3. Conducting database queries on the following databases: 5. The Canadian Police Information Center (CPIC) is a ‘computerized database repository maintained by the RCMP in Ottawa, Ontario. It can be accessed through authorized and restricted terminals, by authorized personnel, and is accessible 0 Page 3 of 94 5.3.2. 5.3.3. 5.3.4. by police and law enforcement agencies throughout Canada. This repository records information such as missing or wanted persons, stolen goods, and criminal records of persons, CPIC accesses records from motor vehicle branches across Canada with regard to driver license information, driving records, dates of birth, and motor vehicle information; The Justice Enterprise Information Network, (JEIN), is a centralized computer system maintained by the Provincial Department of Justice, in Halifax, Nova Scotia, The system includes offender database and case tracking functionality for Courts, Corrections, the Public Prosecution Service, Policing and Victim Services, as well as inquiry access for other Justice related agencies such as the RCMP and Municipal Police Departments, the Department of National Defense, Legal Aid, and the Federal Department of Justice. The JEIN system can be accessed across the province by Department of Justice workers to input and review records information that is collected by the Department of Justice in retation to information associated with court appearance, terms of custody, various court orders and a listing of all charges pertaining {o charged individuals in the Province of Nova Scotia, Police personnel ‘maintain an ability to review such records, but do not have input access to JEIN. Additionally, Registry of Motor Vehicles information including driver's licenses and motor vehicle inquiries can be obtained from the Registry of Motor Vehicles (Service Nova Scotia) system which is interfaced with JEIN; The Police Reporting & Occurrence System, (PROS), which Is a computerized database repository maintained by the Royal Canadian Mounted Police in Ottawa, Ontario. It can be accessed through authorized and restricted terminals, by authorized personnel. This repository records information that is collected through the normal course of an investigation, including the nature of the investigation, names, addresses, vehicles, birth dates, and various reports such as exhibit and continuation or progress reports; The Nova Scotia Property Records Database (Nova Scotia Property Online) is a centralized computer registry for tho province of Nova Scotia controled by the Department of Housing and Municipal Affairs. Access is by subscription, A subscriber can search for properties, property owners, and other information. Results provide a map showing the property, as well as assessment information and an inventory of documents registered at the Land Titles Offices. Reference to these results enables one to determine who the registered Page 4 of 94 y¥ owner Is of a particular property, what deeds or mortgages exist, where they are located, and any other relevant transactions concerning the property. Scanned copies of deeds can be viewed for most properties. To view the actual deeds or morigage documents an investigator must attend the Land Tities Office for the respective region. Members of the RCMP responded to the 911 calls in the Orchard Beach Drive area of Portapique, Nova Scotia and located a residence deceased vc a a deceased fomale At the house next door, there was a deceased female a waa ACidressed in prior proceedings Page $ of 94 10. 11. 12. 13, 14. 15, During the morning hours of April 19, 2020, several reports of shots fired and people being killed were received In the Colchester County area of Nova Scotia, This continued into Hants East County and ended at the Irving Big Stop at Exit 7 ‘of Highway 102 in Enfield, Nova Scotia where Gabriel WORTMAN was shot by police and subsequently died. Gabriel WORTMAN went on a killing sproe and killed more than twenty (20) people during the night of April 18, 2020, and into the morning of April 19, 2020. Police were engaged in a manhunt for Gabriel WORTMAN and in the morning of April 9, 2020, in the Shubenacadie area of Nova Scotia, Gabriel WORTMAN shot Cst. Chad MORRISON, who survived, and then proceeded to kill Cst, Heidi STEVENSON prior to attending the Irving Big Stop at oxit 7 in Enfield, Nova Scotia, where he was subsequently shot by police. There ware several firearms located in the vehicle being operated by Gabriel Statements obtained re common law to Gabriel WORTMAN, describe Gabriel WORTMAN as a person that was a collector of motorcycles, police equipment and firearms and purcha: United States. Witness statements are continuing to be obtained and Gabriel WORTMAN was described as a man who collected firearms, decommissioned police cars, police uniforms and equipment, was paranoid and had security systems in place at his, properties. Gabriel WORTMAN is the registered owner of the residence and businass at 193 Porttand Street, Dartmouth, Nova Scotia and property which included a cottage and a warehouse located at 136 Orchard Beach Drive, 200 Portapique Beach Road, and 287 Portapique Beach Road in Portapique, Nova Scotia, Page 6 of 94 V 16. 17. 18. 19. Addressed in prior proceedings| Financial Transactions and Reports Analysis Centre of Canada (FINTRAC) prepared a Suspicious Transaction Report (STR) with respect to Gabriel WORTMAN and Northumberland Investments Inc. (Gabriel WORTMAN Is reported as the President/Owner/Director) and it showed suspicious transactions involving Gabriel WORTMAN's PayPal account towards the purchases of vehicle accessories commonly used by police, including items explicitly labeled as bein intended for police use via eBay. The FINTRAC report also outlined STRs with respect to credit cards associated to Gabriel WORTMAN for purchases at GCSurplus Ottawa of More than $15,000.00, It is known that some of these purchases were for white Ford Taurus vehicles which were decommissioned police cars. CIBC reported that in March of 2020, Gabriel WORTMAN had requested to liquidate some of his investments, amounting to $475,000. Gabrial WORTMAN requested that the $475,000 be in $100 denominations, This was delivered to Gabriel WORTMAN on March 30, 2020, via Brinks. A search conducted at 200 Portapique Beach Road, Portapique, Nova Scotia on April 22, 2020, resulted in the seizure of| Peter GRIFFON was a friend to Gabriel WORTMAN and performed odd jobs at Gabriel WORTMAN's property in Portapique, Nova Scotia, Peter GRIFFON knew that Gabriel WORTMAN had a police car that was decaled out to resemble an RCMP police car. Peter GRIFFON works at {I and stated that he has done detail work for Gabriel WORTMAN in the past on a truck owned by Gabriel WORTMAN. [EEE stated that he is a co-owner of Jand Peter GRIFFON had a memory stick containing graphic work and asked if he could print off some work for Gabriel WORTMAN involving police decals and was told no. JNNNNN:aid that Peter GRIFFON told him he didn't do the work but he does not know ifhe did it or not. [EMsaid that he reviewed the graphics with Peter GRIFFON and the graphic depicted an image that is on RCMP police cars. Peter GRIFFON spoke with police again on May 4, 2020, and he admitted to printing off RCMP related images at his work Jand researching RCMP Images on the computers at Peter GRIFFON also stated that he printed the numbers that were on the decommissioned police car operated by Gabrie! WORTMAN on April 18, 2020, and April 19, 2020. Peter GRIFFON said that there will be pictures of the RCMP police car that Gabriel WORTMAN had on his cell phone. Peter GRIFFON’s cell phone was seized on May 4, 2020, Page 7 of 94 Yg Victims Known to Date 20. McKAY which depicted the areas where persons ‘were either injured or deceased, Page 8of 94 Addressed in prior proceedings| 20.9. 20.10. 20.14 20.12. 20.13. 20.14, Gabriel WORTMAN (1968-07-05) 24, Gabriel WORTMAN does not have a criminal record but does have one conviction for assault in 2002 according to his Offender Summary Report on JEIN?, 70n Apri! 19, 2020, | conducted 2 query on CPIC and JEIN with respect to Gabriel WORTMAN. 22, Gabriel WORTMAN has a valid Nova Scotia driver license with an address of 193 Portland Street, Dartmouth, Nova Scotia and has the following vehicles with current registrations in his name®: 22.1. 2017 Ford F150 truck with Nova Scotia license plate GDM984; 22.2. 2007 Jeep Wrangler with Nova Scotia license plate GNPP860. 23. Gabriel WORTMAN has the following properties registered in his name*: 23.1. 193 Portland Street, Dartmouth, Nova Scotia; 23.1.1. Cst. Kyle DOANE (Cst. DOANE), a peace officer and member of the RCMP, was near 193 Portland Street on April 19, 2020, and observed a white vehicle in the driveway and a detached garage at the rear of the property. Cst. DOANE also stated that the main structure contains the business on the main level and an upper floor appears to be a residence®; 23.2. 191 Portland Street, Dartmouth, Nova Scotia; 23.3. 189 Portland Street, Dartmouth, Nova Scotia; 23.3.1. The properties at 191 and 189 Portland Street, Dartmouth, Nova Scotia have been identified as a parking lot and a laneway; 23.4, 287 Portapique Beach Road, Portapique, Nova Scotia; 23.4.1. Cst. Dayle BURRIS (Cst. BURRIS), a peace officer and member of the RCMP, went to 287 Portapique Road on April 20, 2020, and described the property as a grassy property with no visible structures from the road. The property contains lots of trees®; 23.5. 200 Portapique Beach Road, Portapique, Nova Scotia; 23.5.1. Cpl. Matt CONN (Cpl. CONN), a peace officer and member of the RCMP, viewed photos taken on April 19, 2020, by Ident of the property at 200 Portapique Beach Road and said that there On Aprit19, 2020, | conducted queries on JEIN with respect to Gabrie! WORTMAN on the motor vehicle registry. On Aprit 19, 2020, | conducted a query on Nova Scotia Property Online with respect to properties registered to Gabrie! WORTMAN, * On April 20, 2020, | spoke with Cst, DOANE regarding his observations of 193 Portland Street, Dartmouth, Nova Scotia on April 19, 2020. On Aprit 20, 2020, | spoke to Cst, BURRIS with respect to his observations of 287 Portapique Beach Road, Portapique, Nova Scotia on Aarl 20, 2020, Page 10 of 94 was a bumt out Taurus and the structure was burt down to the foundation’; 23.8. 136 Orchard Beach Drive, Portapique, Nova Scotia; 23.6.1. Cpl. CONN viewed photos taken on April 19, 2020, by Ident of the property at 136 Orchard Beach Drive and said that there was a burt out Jeep and Taurus and the structure was bumt with most collapsed into the middie but there was approximately eight (8) feet of walls sfil standing. 24, On February 12, 2020, Gabriel WORTMAN was charged with speeding on Portapique Beach Road, Great Village, Nova Scotia and was operating a white 2013 Ford Taurus with Nova Scotia license plate GMK9058. 24.1, Nova Scotia license plate GMK9085 is registered to Berkshire Broman Corporation of 193 Portland Street, Dartmouth, Nova Scotia and attached to a white 2013 Ford Taurus®. 24.1.1. Nova Scotia Joint Stocks has Berkshire Broman Corporation in its database with the following information'®; 24.4.4.1, Itis a non-registered company; 24.1.1.2, The jurisdiction is New Brunswi 24.1.1.3. The mailing address Is 193 Portland Street, Dartmouth, Nova Scotia; 24.1.4.4, Itwas registered on 2008-07-16; 24.1.1.5. There are no people listed on file. 24.2. The master number for Berkshire Broman Corporation is BERKS6030006 and the company has the following white Ford Taurus cars registered to it: 24.2.1, White 2013 Ford Taurus (VIN I) vith Nova Scotia license plate GMK905; 24.2.1.1. On July 28, 2019, this vehicle was owned by the RCMP and sold to Berkshire Broman Corporation. 7Gn Aprit 20, 2020, | spoke to Cpl. CONN with respect to him viewing photos taken by fdent on April 19, 2020, "On April 19, 2020, 1 conducted a query on PROS with respect to Gabriel WORTMAN. * On April 19, 2020, | conducted a query on JEIN with respect to Nova Senta license plate GMK9OS, On April 19, 2020, | conducted a query on Nova Scotia Joint Stocks + On April 19, 2020, | conducted a query on JEIN with respect to Nava Scatla license plate GIX365 and the master ‘number assoclated to Berkshire Broman Corporation, 1 24.2.2. 24.2.3. 24,2.1.2. On October 2, 2019, the vehicle was transferred from the RCMP to Berkshire Broman Corporation and on November 6, 2019, Nova Scotia license plate GMK905 was attached to the vehicle’; As will be detailed, on April 20, 2020, a Search Warrant was executed at 193 Portland Street, Dartmouth, Nova Scotia and this vehicle was located in the driveway; ‘White 2013 Ford Taurus (VIN a with Nova Scotia license plate GJX385; 24.2.2.1 On March 27, 2019, this vehicle was owned by the RCMP and sold to Berkshire Broman Corporation and Nova Scotia license plate GJX365 was attached to the vehicle"; White 2017 Ford Taurus (VIN I ) vith no license plate affixed to It; 24.2.3.1, 24.2.3.2. On July 3, 2019, this vehiole was owned by the RCMP and sold to Berkshire Broman Corporation. No plate was attached to this vehicle", Cpl. Jemy ROSE-BERTHIAUME (Cpl. ROSE- BERTHIAUME), a peace officer and member of the RCMP, checked the notes of Sgt. Darlene McEACHREN (Sgt. McEACHREN), a peace officer and member of the RCMP, and confitmed that the last three of the VIN on the vehicle burnt out at the scene involving Cst. STEVENSON was, mm. Novalea Holdings Limited does not appear to be associated to Gabriel WORTMAN as he is not listed as a person holding any of the positions of Director, Vice President, Secretary, Treasurer, and Recognized Agent’, maa ACdressed in prior proceedings} 25.2.8. On April 22, 2020, I dialed 902-455-1636 and the call went to voicemail with a female volce who said that it was March 19 and that the office is closed due to the coronavirus until April 15, when they would re-asses. 25.2.4. On April 22, 2020, Jo-Ann McNAMARA, a civilian member of the RCMP who works with Special | and responsible for liaising with telco companies, made a request to telco companies and ‘was told the following: 2.2.4.1, 902-464-0808 and 902-455-1636 are active Aliant landline telephone numbers; 26.2.4.2. CONN conducted a query on archive.org and noted a snapshot of dentureshalifax.ca on January 24, 2019, of a website associated to Atlantic Denture Clinic which contained the following information: 25.4.1. 902-464-0808 was listed as the phone number; 25.4.2, 193 Portland Street, Dartmouth, Nova Scotia and 3542 Novalea Drive, Halifax, Nova Scotia were listed as locations. Information from Cst, Shawn STANTON 26. On April 19, 2020, | spoke with Cst. Shawn STANTON (Cst. STANTON), a peace officer and member of the RCMP, who is one of the investigators assigned to investigate this matter and learned the following®: 26.1. At 2205 hrs on April 18, 2020, multiple 911 calls were received with respect to shots being fired and buildings on fire in the vicinity of Orchard Beach Drive, Portapique, Nova Scotia; 28.2. Cst. Dave LILLY (Cst. LILLY) and Cst. Chris GRUND (Cst. GRUND) attended Portapique, Nova Scotia and the following transpired: 26.2.1. Gabriel WORTMAN did not have an account at’ cc: his name, it was under the business name of Atlantic Denture Clinic. Financial Transactions and Reports Analysis Centre of Canada (FINTRAC) prepared a Suspicious Transaction Report (STR) with respect to Gabriel WORTMAN and Northumberland Investments Inc. (Gabriel WORTMAN is reported as the President/Owner/Director) and it showed suspicious transactions involving Gabriel WORTMAN's PayPal account towards the purchases of vehicle accessories commonly used by police, including items explicitly labeled as being Page 90 of 94 wa intended for 1 FINTRAC report also outlined STRs with respect to credit cards associated to Gabriel WORTMAN for purchases to GCSurplus Ottawa of ‘more than $15,000.00. It is known that some of these purchases were for white Ford Taurus vehicles which were decommissioned police cars. 84. CIBC reported that in March of 2020, Gabriel WORTMAN had requested to liquidate some of his investments, amounting to $475,000. Gabriel WORTMAN Tequested that the $475,000 be in §100 denominations. This was delivered to Gabriel WORTMAN on March 30, 2020, via Brinks. A search conducted at 200 Portapique Beach Road, Portapique, Nova Scotia on April 22, 2020, resulted in the seizure = 85. _ Peter GRIFFON knew that Gabriel WORTMAN had a police car out to resemble an RCMP police car. On May 4, 2020, Peter GRIFFON provided a cautioned statement and admitted that he did do research on RCMP images at EEEEEEEM§end did print and cut RCMP related decals that were placed on the decommissioned RCMP police car that Gabriel WORTMAN was operating on April 18, 2020, and April 19, 2020 Peter GRIFFON said that there would be images of the car owned by Gabriel WORTMAN on his cell phone and that some of the pictures were taken at the warehouse belonging to Gabriel WORTMAN. 87. The video in the possession of Brink’s Canada Limited will show that Gabriel WORTMAN physically had possession of a white Ford Taurus on March 30, 2020, when he attended to pick up $475,000, which he withdrew from CIBC.
