INFORMATION

The undersigned accuses ERNANI MARTINEZ y NAZARENO of the


crime of Attempted Estafa, committed as follows:

That on or about January 3, 2005, in the City of Manila,


Philippines, the said accused, with intent to defraud, did then and there
willfully, unlawfully and feloniously commence the commission of the
crime of Estafa, directly by overt acts, to wit: the said accused, by means
of false manifestation and fraudulent representations which she made to
JENNY CLAIRE MATA y VILLANUEVA to the effect that he had the power
and capacity to recruit and employ her in Taiwan as a Factory Worker
and could facilitate the processing of the pertinent papers if given the
necessary amount to meet the requirements thereof, and by means of
other similar deceits, induced and succeeded in inducing her to give and
deliver, as in fact she gave and delivered to the said accused the
additional amount of P10,000.00, but the said accused did not, however,
perform all the acts of the execution which should have produced the
crime of estafa as a consequence, by reason of some cause or causes
other than his own spontaneous desistance, that is the timely discovery
of the fraud and caused the arrest of the said accused.
