plight? What are the triggering factors that led to her advocacies?
Ruth Ginsburg graduated top of her class but in spite of this, she was unable to find a
position in a law firm because none of the 12 firms she applied wants to hire a woman. She can’t
hide the frustration but she then takes the job as a professor at Rutgers Law School, teaching
"Sex Discrimination and the Law". Despite of not having the job she truly wants; she was inspired
with the passion of her students where she can see herself to them also fighting for sex
discrimination seen in the law. This shows that it’s one of her reasons why she’s still earning the
courage to fight for her right and what she believed in. But what triggers her the most that led to
her advocacies is when she found an opening to support her acclaims. And it was Mr. Moritz case,
she sees this case as an opportunity to begin to challenge the many laws enacted over the years
that assume that men will work to provide for the family, and women will stay home and take care
of the husband and children. She believes that if she could set a precedent ruling that a man was
unfairly discriminated against on the basis of sex, that precedent could be cited in cases
challenging laws that discriminate against women and she believes that an appellate court
composed entirely of male judges would find it easier to identify with a male appellant. In this
case, it proves that not only women are being discriminated by the law but also men.
3. Do you think that the main character is too radical? How did you say so?
I think she’s radical to change the law in order to achieve equality for both women and
men and not that being radical to social change. Because as she said, the law became our culture
and we need to follow it for thousands of years now and many have failed to stoop up against it.
We live in a world where change is constant and what we do for the past years may change for
the following years. Mrs. Ginsburg said to the judges that they’re being urge to protect the culture
and tradition and morality of a society that no longer exists. And this proves that we can’t control
change in the society we’re living in, neither is the law. So she believed that the law was gender-
blind and all groups were entitled to equal rights.
4. Using the distinction between sex and gender, explain why the main character has been
advocating for equality.
Everyone was willing to do anything in order to reach or achieve their dreams in life. And
through Ruth Ginsburg’s journey, we realized why she is advocating for equality. For thousand
years, women are seen as dependent to their husband in order to survive. And in this case, time
sees women being held up like slaves in their own home where they couldn’t do what they really
want and experience the freedom of making own decisions because of the law being implemented
which draws a bar to the freedom of women. But this statement is just a supporting detail to the
main goal of Ruth. We have seen that Ruth was happy being a wife and a mother but that’s not
the case, Ruth was struggling to fight the concept of gender roles that based in law. She wanted
to be a lawyer but she couldn’t because it was stated that men are the best and only qualified to
be in that position or career. We have drawn a line or limit to what a woman can do and it’s the
reason why she’s advocating for equality. She wants to prove that everyone can be what they
want to be. That women can do what men can do and vice versa and not to underestimate the
capabilities of a person.
5. Are you in favor of gender equality in social legislations? Why or why not?
I’m in favor because gender equality in social legislations portrays a big role in improving
social condition in a society. This promotes equal rights and equal opportunities to every individual
that is part of a society. Everyone gets to experience freedom and making their own decisions
without limiting their right. I believe that whatever gender we have or we choose to, we should
earn equal rights and promote good camaraderie for the betterment of our society.
