JUDICIAL AFFIDAVIT

This Judicial Affidavit of ANDRE GASGASSI executed to serve


as his direct testimony in Cebuano dialect with English translation,
which both dialect and language known and understood by the
witness and then translated to, by Atty. Juan O. Dela Cruz, who
personally conducted the examination.

The witness is answering the questions asked of him, fully


conscious that he does so under oath, and that he may face
criminal liability for false testimony or perjury.

I, ANDRE GASGASSI legal age, single and residing at Purok


Lubilubi, Olingan, Dipolog City, under oath, depose and say that:

4. Q: Unsa imong pagkaila ni Rafaela ug ni Roger?


[How do you know Rafaela and Roger?]

A: Si Maam Rafaela, amiga mi ana kay ma abi-abihon mana
siya. Kada buntag kay iya kong hapitan ug kape daun mu
“good morning” gyud na siya nako kada niya duty. Si Sir
Roger dili mi suod, pero kaila ko niya kay real estate
agent man pod siya.
[Maam Rafaela is my friend. She is a very nice lady. She
gives me coffee every morning and greets me “good
morning” when she reports for work. I am not close with
Sir Roger but I know him because he is a real estate
agent at work.]

5. Q: Nganong nakabalo man ka aning kasoha?


[How did you know about this case?]

A: Nakabalo ko ani kay nakakita man ko sa post ni Sir


Roger. Gipasa-pasa naman ang post sa among group
chat.
[I knew about this because I saw the post of Sir Roger.
The post has already been circulated and shared in our
group chat.]

6. Q: Dayun unsa man imong reaksyon pakakita nimo?


[ And then what was your reaction when you saw he
post?]

A: Nakaingon ko nga lain mana si Sir Roger. Dili mana angay


i-post nang in ana kay maulawan si Maam Rafaela.
[I thought to myself that Sir Roger was mean. The post
was inappropriate because it will cause shame to Maam
Rafaela .]

7. Q: Unsa man di-ay gayud imong nabasa sa post ni Roger?


[What did you read exactly in Roger’s Post?]

A: Nakita nako nga gipost niya ang picture ni Maam Rafaela


dayon nay nakasulat sa ibabaw: “Hoy ikaw Rafaela
Nedel, putang ina ka! Baho kag bilat! Imong gi jer-jer ang
akong mga kliyente para diha sila mutransaksyon nimo.
Wala raba kay lisensya mamaligya aning mga yuta.
Kawatan ka! Dili raba ka tig remit sa downpayment sa
mga kliyente” Iya ning gipost niadtong Nobyembre 1 ning
tuiga.

[I saw that he posted a picture of Maam Rafaela and
wrote above: “Hey you Rafaela Nedel, you motherfucker!
You have a foul-smelling genitalia! You engaged in sexual
relations with my clients so that they will transact with
you. You don’t have a license to sell these real estate
properties. You are a thief! You do not remit the down
payments made by your clients.” He posted this on
November 1 of this year.

8. Q: Naa koi ipakita nimo nga screenshot sa usa ka conversation


sa messenger diin na share ang post nga gihimo ni Roger.
Unsa imong ika ingon bahin ani?
[ I am showing to you a screenshot of conversation in
messenger where the post made by Roger was shared. What
can you say about this?]

A: Mao na akong pasabot Attorney.


[ That was what I was reffering to Attorney.]

ATTY DELA CRUZ: The print out of the messenger conversation


between Mr. Gasgassi and his friends showing that the post made
by Roger is shareable to the public is marked as Annex “A”.

9. Q: Unsa imong gibuhat paghuman nimog basa?


[ What did you do after reading it?]

A: Ni reply ko sa among group chat nga undangan na ug


share-share kay basin makiha mi ug apil. Pagkaugma pag
sulod ni Maam Rafaela sa duty ni ingon ko nga ug iyang
ikiha si Sir mu testigos ko para niya.
[ I replied in our group chat that they should stop
sharing the post because we too might be sued. The day
after, when Maam Rafaela reported for office I told her
that I am willing to testify in her behalf should she
proceed to file a case against Sir Roger .]

10.Q: Aduna pa ba kay laing gusto nga iingon?


[Do you have other things you wish to say?]

A: Wala na. Gawas ug pangutan.on
