PETITION

Petitioner by the undersigned counsel, and unto this Honorable


Court, respectfully alleged that:

1. On April 01, 2010, petitioner presented to the Register of Deeds


of Batangas City for registration a deed of sale of a certain
parcel of land located at Brgy. Conde Labac, Batangas City
wherein Helen Carla L. Tabernero was the vendor, and the
petitioner, the vendee;

2. Said deed of sale on said date was duly entered in the Entry
Book of the said Registry of Deed as Entry No. 1234 Volume
567;

3. That the deed of sale as the be presented, was accompanied by


the owner’s duplicate certificate of title, Transfer Certificate No.
89123;

4. Pending registration of the above papers and documents, and


while the same were in the possession and custody of the Office
of the said Register of Deeds, the building which was housed
the Office of the Register of Deeds was burned to the ground,
together with all its records and papers;
5. Upon the re-establishment of the said Office of the Register of
Deeds, petitioner made inquiries that said office regarding the
above deed of sale and accompanying Transfer Certificate of
Title No. 89123 but was informed that the said papers were
missing and were not among those salvaged from the fire
wreckage;

6. In view of the above, the said Transfer Certificate of Title No.


89123 of the Register of Deeds of Batangas City must be
deemed to have been lost of destroyed.

WHEREFORE, pursuant to law, and in view of the fact that said


Transfer Certificate of Title had been lost or destroyed, it is respectfully
prayed that, after due proceedings, an Order be entered directing the
Register of Deeds of Batangas City to issue a new duplicate certificate of
Title No. 89123, the same to be regarded as the original certificate for all
purposes of law.

4. That I have not commence any other action or


proceedings involving the same issue subject matter of
this application with the Supreme Court, Court of
Appeals, or any tribunal or agency of the government;

5. That to the best of my knowledge, no other action


regarding the subject matter of this application is
pending with the Supreme Court, Court of Appeals, or
other tribunal or agency, and that if I should thereafter
learn that a similar petition is pending before the Court
or tribunal so mentioned, I undertake to report this fact
to this Honorable Court, within five (5) days from my
knowledge.
