AFFIDAVIT-COMPLAINT

I, ROTCIV UY, 49 years of age, Filipino, married and a resident of Block

30, Lot 11, Gumamela St, Brgy. San Jose, Pagadian City, after having been duly
sworn to in accordance with law, hereby deposes and says THAT:

1. That I am the complainant of this complaint affidavit, the husband of

Anivid Ecarg Uy, the incumbent Congresswoman of the First District,
Province of Zamboanga del Sur. A machine copy of our marriage contract is
hereunto attached and made as an integral part hereof as Annex “A”;

2. That I together with my family planned for a birthday party of my wife at

Donels Beach and Resort, Lower Bayao, Tukuran, Zambonga del Sur on
April 13, 2021 and invite our friends, colleagues and other guests;

3. That on April 12, 2021, a day before of my wife’s birthday party, one of
my staff in the office named, Balotbotan Alayco received a telephone call
confirming the venue and exact time of the party. The caller introduced
himself as one of the staffs of Mayor Ymmas Oc. When my staff check the
record of the guests the caller is not included therein. The sworn statement
of Balotbotan Alayco is hereunto attached and made an integral part of this
complaint as “Annex B”;

4. On April 13, 2021 was the 43rd birthday of my wife, Anivid Ecarg Uy
held at Donels Beach and Resort, Lower Bayao, Tukuran, Zamboanga del
Sur which started on or about 6:00 p.m (in the evening);

5. That on or about 6:30 pm of April 13, 2021, the night was buzzing with
different activities, guests were enjoying and there were also live bands to
serenade the evening. To ensure the safety of the activities, civilian
personnel and security guards remain on-guard within the vicinity;
6. At about 9:00 pm, one of my security guards, Juan Luna saw a certain
individual at the entrance gate of the said resort. He then approached him to
get inside. This man named, Taylor Oggis, introduced himself as one of the
staffs of Mayor Ymmas Oc. The sworn statement of Juan Luna is hereunto
attached and made an integral part of this complaint as “Annex C”;

7. That two witnesses saw and positively identified the person of Taylor
Oggis, who had a bulk thing tucked in his holster which appears to be a gun.
The said witnesses continuously eyed Taylor Oggis who kept his hand
constantly holding that thing tucked in his holster. The witnesses could not
have misidentified the person, as both of them were shocked why Taylor
Oggis, a known ally of Mayor Ymmas Oc were invited and present at that
night. The collective sworn statements of the witnesses, Tita Amy and Tita
Bona Kid is hereunto attached and made an integral part of this complaint as
“Annex D”.

8. That on or about 9:20 pm, when the security guard neglected the intention
of that stranger, immediately there were commotion. People were shouting
for help inside the resort because Congresswoman Anivid Ecarg Uy while
giving her “Words of Gratitude” was shot in the chest, bathe by her own
blood and fell on the platform. However, no gunshot sound was heard during
the incident. It was presumed that the gun used by the assailant was a
silencer gun. The sworn statement of Isko Magiliw, the security guard is
hereunto attached and made an integral part of this complaint as “Annex E”;

9. That the suspicious man was identified as Oskar Sulayman who was the
companion of Taylor Oggis that night. A CCTV camera captured the
extraneous and weird movements of this person. It was presuming that
Oskar Sulayman was the look-out within the vicinity of the birthday party.
A CCTV footage hereunto attached and made an integral part of this
complaint as “Annex F”;

10. That the suspicious man within the said venue happened to bump Atty.
Bana which causes the spill over of the soft drinks that the lawyer holds on
her hand. It then happened that there’s an exchange of hated argument
between this man and the lawyer;
11. That after the argument and through the witnesses around with the
suspicious movement of this man, lead the authority to arrest him. He then
confesses that he is one of the allies of Mayor Ymmas Oc;

12. A certain identification card (I.D), bearing the name of Taylor Oggis
with the caption as, “Mayor Ymmas Oc Staff was found at the crime scene,
near the victim Anivid Ecarg Uy, who is my wife. The I.D found at the
crime scene and the CCTV footage is hereunto attached and made an
integral part of this complaint as “Annex F”;

13. I immediately brought my wife at Hofilenia Hospital, Pagadian City.

Upon arrival at the said hospital, Dr. Dilly Mahaluna immediately attended
my wife and after a thorough examination, declared her dead-on arrival. The
medico-legal autopsy report and the PSA death certificate of Anivid Ecarg
Uy is hereunto attached and made an integral part of the complaint as
“Annex G, and H”, respectively;

14. I reported the shooting incident on or about 11:00 pm (in the evening at
the Tukuran Municipal Police Station which is the nearest police station.
The original copy of the excerpt of the police blotter duly issued by Senior
Police Inspector Eteretud Ogirdor II of Tukuran Municipal Police Station is
hereunto attached and made as an integral part hereof as Annex “I” of the
complaint;

15. That it is clear that Mayor Ymmas Oc was the distinct mastermind, of
the incident as to the evidences gathered and attached therein. That I am
executing this affidavit freely and voluntarily in support of my intent to file a
case against him as one of the conspirators of the killing incident;

16. That I am also executing this affidavit freely and voluntarily in support
of my intent to file a separate case against Oskar Sulayman ;

17. I am therefore executing this affidavit freely and voluntarily in support

of my intent to file a case for MURDER and/or the appropriate criminal
case against Taylor Oggis who is 52 years of age and a resident of 11, Lot 1,
Sampaguita St., Brgy. Balangasan, Pagadian City.

18. Finally, I humbly submit that I have prepared the present criminal
complaint affidavit to support my claim.
 PRAYER

WHEREFORE, premises considered, it is respectfully prayed that the instant

criminal complaint be GRANTED.
Further, the complainants respectfully pray for such and other reliefs as may be
deemed just and equitable in the premises.
