PRIVATE NOTICE QUESTION

To ask the Honourable Prime Minister, Minister of Defence, Home Affairs and External
Communications, Minister for Rodrigues, Outer Islands and Territorial Integrity –

Whether, in regard to persons gone missing and not found, he will, for the benefit
of the House, obtain from the Commissioner of Police, information as to the
number thereof being –

(a) Mauritian citizens, distinguishing between male and female and


excluding those who disappeared at sea, for 2019 and 2020 and since
January 2021 to date, categorised as follows:-

(i) below the age of 12;


(ii) between 12 and 18;
(iii) Alzheimer sufferers and mentally impaired persons;
(iv) aged and handicapped; and
(v) others; and

(b) expatriate workers presently missing and who reported as such by their
employers?

REPLY

Mr Speaker, Sir,

I am informed by the Commissioner of Police that in accordance with


established procedures set out in the Police Standing Order 130, under the
heading, –“Missing Persons” - and the Police Instructions Manual, any
missing person should be reported to the nearest Police Station and police
action must start immediately.

Whenever a person is reported missing at a Police Station, the case is
recorded in the Register of Missing Persons, giving a detailed description of
the missing person.

In fact, missing persons are classified in five categories, as follows:

(a) Children under the age of 12 years;


(b) Young persons between the ages of 12 and 18;
(c) Aged or infirm persons;
(d) Adult persons who are suffering from mental or nervous disorders;
(e) Adult persons of sound mind above the age of 18.

Special attention is given to cases involving children and minors, elderly,


infirmed persons and adult persons suffering from serious diseases.

Mr Speaker, Sir,

With regard to part (a) of the Question, I am informed by the


Commissioner of Police that, for the period 2019 to date, 1525 persons were
reported missing out of whom 1448 persons were successfully located by
the Police and found safe, 24 were found dead and 53 persons are still
reported missing.

With regard to calendar year 2019, 773 Mauritian citizens, excluding


those lost at sea, were reported missing. For calendar year 2020, 574

persons were reported missing. Whereas for the period January 2021 to
date, the figure stands at 178.

Mr Speaker, Sir,

I am informed by the Commissioner of Police that the number of


missing persons in the different categories is as follows:

Mr Speaker, Sir,

With regard to part (b) of the Question, I am informed by the Passport


and Immigration Office that the number of expatriates reported missing by
their employers is 2224 as at date, comprising 2126 males and 98 females.

Mr Speaker, Sir,

I wish to inform the House that a non-citizen is not allowed to take any
paid employment in Mauritius without a valid work permit under provisions of
the Non-citizens (Employment Restriction) Act. Any non-citizen engaged in
any gainful employment in Mauritius without a valid work permit shall commit
an offence and shall be liable on conviction, to a fine of not less than 25,000
rupees but not more than 50,000 rupees and to imprisonment for a term not
exceeding 2 years. Likewise, it is an offence for any employer or any
individual to employ a non-citizen without a valid work permit. Such an
offence is also subject to a fine of not less than 25,000 rupees but not more
than 50,000 rupees and to imprisonment for a term not exceeding 2 years.

Mr Speaker, Sir,

Employers of non-citizens in Mauritius have an obligation under


Section 6 of the Non-Citizens (Employment Restriction) (Work Permit)
Regulations 2017 to forthwith notify the Ministry of Labour, Human Resource
Development and Training and the Passport and Immigration Office where
their workers (non-citizens) are missing for more than five consecutive days
from their dormitories and workplaces.

Once notified, the PIO and the Ministry of Labour, Human Resource
Development and Training conduct independent inquiries respectively to
ascertain the circumstances surrounding the absence of the worker from his

workplace and whether the conditions of the contract of employment have
been breached.

Further to investigations by the two Authorities, the work permit and


the residence permit, if still valid, are usually cancelled. Thereon, the PIO
pursues the search for the worker with the aim of locating and repatriating
him. Should incriminating evidence be obtained against the offender in this
process, the case may be referred to the Commissioner of Police for
investigation and referral to the Director of Public Prosecutions for
appropriate advice.

Mr Speaker, Sir,

With a view to addressing the problem, a High Level Committee, co-


chaired by the Minister of Labour, Human Resource Development and
Training and the Attorney-General, was set up to analyse and propose
solutions for remedying the current situation whereby many foreign workers
are missing from their workplaces and working illegally in Mauritius.
