Performance Agreement

This performance agreement is between a radio station called The Company and a voice over artist, Mr. Siphe Fodi, to record an advert and infomercial. The voice over artist will provide their services for no remuneration. The Company will be responsible for drafting scripts in English, Zunglish, and Zulu. PERFORMANCE AGREEMENT

THE AGREEMENT

In consideration of the following covenants, conditions and promises, Mr Siphe Fodi (the
voice over artist)agrees to perform at an engagement of the radio station (The Company)at
a date and time herein stipulated.

This agreement is made between the Company and The voice over artist. Both parties enter
this agreement willingly and under no duress.

THE ENGAGEMENT

The voice over artist agrees to provide such performance services, under the following
terms and conditions:

PURPOSE: Advert and Infomercial

DATE OF RECORDING: _______________________

VENUE: ______________________

DURATION: _________________________

REMUNIRATION

No remuneration will paid by the company for this purpose.

SCRIPTS OWNERSHIP

The company will be responsible for drafting scripts in English, Zunglish and Zulu. Such
scripts will remain the intellectual property of the company.
TECHNICAL RIDER

5. CD for packaging

AMENDMENTS

No amendments will be made to this agreement within 48hours of the performance. Any
changes to the stipulations in this agreement shall be made in writing by either party within
3days before the date of the engagement.

TERMS and CONDITIONS

1. The Company and the voice over artist agree that performancesand services will be
rendered at the place of engagement.

2. In the event that the Client cancels the performance on the day of the performance,
the Client will pay the Band as liquidated damages, the full guaranteed fee agreed to be paid
for such performance. Timeous and valid cancellation reasons will be discussed before both
parties agree on any remedial action.

4. This agreement is valid in the jurisdiction of the Republic of South Africa and thus it
will be obligated to be contested within the Judiciary System of the Republic of South Africa.

5. All reasonable undertaking shall be taken to honour the agreement hereto entered.

6. The client will use any material (Audio, Video, Pictorials) taken from a reputable and
approved source for the sake of marketing ONLY the engagement hereto referred.
