15This revised implementing rules and regulations (IRR) shall apply to all individuals, households,
16firms, establishments, industries, institutions, facilities, utilities, public and private operators,
17owners/ administrators, and other entities engaged in the sewage, wastewater and excreta
18collection and disposal system. This also applies to those engaged in desludging, collection,
19handling and transport, treatment, reuse and disposal of domestic sludge from cesspools,
20communal septic tanks, Imhoff tanks, domestic sewage treatment plants/facilities, and septage
21from household septic tanks. Further, the scope of this IRR applies to all local government units
22for the provision and maintenance of drainage system.
24As used in this rules and regulations, the following terms shall mean:

88 the environment and factors therein for the protection of health and welfare of the public.
89 For this IRR, Sanitation means management of human excreta, sewage and wastewater,
90 septage and sludge from HH, commercial and other similar establishments from
91 generation to disposal in order to protect human health.
922.24 SECONDARY TREATMENT – Biological and chemical treatment processes designed
93 to further remove organic matter.
942.25 SEPTAGE – The liquid, solid, and semisolid material that results from wastewater pre-
95 treatment in a septic tank, which must be pumped, hauled, treated, and disposed of
96 properly.
972.26 SEPTIC TANK – A watertight rectangular receptacle designed and constructed to
98 receive and partially treat raw wastewater. The tank separates and retains settleable and
99 floatable solids suspended in the raw wastewater. Settleable solids settle to the bottom to
100 form a sludge layer.
1012.27 SEWAGE – a wastewater generated from residential/domestic, commercial, industrial,
102 institutional sources including special establishments and health care facilities
1032.28 WASTEWATER – a combination of greywater, blackwater and/or used liquid wastes
104 containing substances generated from any sources that make the water unfit for intended
105 or beneficial uses.

108Where a public sewerage system is not available, sewage/wastewater from residences and other
109establishments shall be discharged into a septic tank or sewage treatment system to be
110constructed in accordance with provisions under this Section.

1273.2 SANITARY PRIVIES

129 Sanitary Privy is a structure for the reception, disposition and storage of excreta or fecal
130 sludge or sewage from the household and other establishments. It shall consist with
131 super, mid, sub-structure facilities, and conform to the following minimum
132 requirements:
133
134 3.2.1 Non-water carriage– are facilities that require no amount of water necessary to
135 wash the waste into receiving space (i.e. Ventilated Improved Pit or VIP latrine).
136 a. It shall be located within a safe distance from any source of water supply and
137 should not be located on any area with high groundwater table as certified by
138 the local health office.
139 b. It shall consist of earthen pit, a floor covering the pit, and water-sealed bowl.
140 It shall be so constructed in order that fecal matter and urine will be deposited
141 into the earthen pit which shall be completely fly-proof. The earthen pit
142 described here pertains to compact soil in order to prevent possible cave-in or
143 erosion. Otherwise, shoring or necessary similar structure is required in order
144 to address the problems on cave-in or erosion.
145 c.
146 d. The pit shall be at least one-meter square with a minimum depth of 1.5
147 meters from the ground surface.
148 e. The floor should cover the pit tightly to prevent the entrance of flies. It shall
149 be constructed of concrete or other impervious material.
150 f. The superstructure shall be constructed to provide comfort and privacy for
151 the users of the privy.

153 3.2.2 Water carriage – are facilities that require water to wash/flush the waste into
154 the receiving space i.e. pour flush toilet, water sealed and flush type toilet.
155 a. The water-sealed bowl shall be installed to the floor to form a water-tight and
156 insect proof joint.
157 b. The substructure in a form of septic tank or any approved sewage
158 containment and treatment system from the existing guidelines of the DOH
159 shall be constructed to contain sewage or blackwater.
160 c. No toilet facility shall be constructed without the appropriate sewage
161 containment such as septic tank or any sewage treatment system approved by
162 the DOH.

164 3.2.3 Other Type of Toilet Facilities – are facilities from air, land, and sea vessels
165 and other facilities used for special events or emergencies (e.g. chemical toilet or
166 portalet).
167 a. The facilities used for special events or emergencies shall be required to
168 secure an ESC for not more than 6 months or duration of the event.
169 b. For sanitary toilet facilities from air, land, and sea vessels, excreta shall be
170 managed in accordance to Section 4: Offsite Sanitation of this IRR.

1723.3 SEPTIC TANK

174 Septic tank is a sewage containment and treatment structure constructed or installed for
175 individual household/single dwelling, cluster of households or any establishments
176 specified in Section 1 of this IRR and shall be constructed in accordance with the
177 following minimum requirements:
178
179 3.3.1 It shall be generally rectangular in shape. When a number of compartments are
180 used, the first compartment shall have the capacity from one-half to two-thirds of
181 the total volume of the tank.
182 3.3.2 It shall be built of concrete, whether precast or poured in place. Concrete blocks
183 may be used provided that water proofing is applied such as plastering as
184 stipulated in the National Structural Code of the Philippines (NSCP).
185 3.3.3 It shall not be constructed under any building and within the safe distance from
186 any source of water supply identified or determined by a Registered Sanitary
187 Engineer of the Local Health Office.
188 3.3.4 Roof drains, foundation drains, area drains or cistern overflows shall not be made
189 to enter the septic tank or any part of the sewage treatment system.
190 3.3.5 Other requirements for the installation/construction of the septic tank such as
191 septic tank capacity, inlet and outlet, tank proportions, inspection manholes,
192 construction methodology and plans, locations, operation and maintenance are
193 stipulated in the DOH AO No. ___s.2019. National Standard on the Design,
194 Construction, Operation and Maintenance of Septic Tank and its Operating
195 Procedures.
196 3.3.6 The size and volume of the septic tank can be designed based on the volume of
197 sewage generated and can be modified to increase the treatment efficiency. The
198 following are types of septic tank:
199 a. Individual/Single Dwelling septic tank – a maximum of 10 person or 1.0m3 of
200 sewage per day can be accommodated in this septic tank.

238 sewage and septage in an onsite system should conform with the following
239 minimum requirements:
240 a. The dried fecal sludge or humus of a fully utilized ventilated pit latrine shall
241 be disposed/reused in accordance with the existing national guidelines on
242 safe use and application.
243 b. The effluent of septic tanks and other onsite sewage disposal system shall be
244 discharged into a sub-surface soil, absorption field where applicable or shall
245 be treated further with some type of a purification device/process.
246 c. The treated effluent may be discharged into a sewer/drainage leading to
247 stream or body of water if it conforms to the effluent quality standards
248 prescribed by the DENR. (DAO 2016-08).
249 d. The design, construction and location of leaching tile fields and leaching beds
250 shall refer to Annex B.
251 e. Oils, greases, industrial/commercial liquid wastes, toxic chemicals and
252 wastewater shall not be discharged to a (leaching field) subsurface sewage
253 disposal system.
254 f. For onsite sanitation facility that requires septage treatment and disposal,
255 shall refer to Section 4.
256 g. Other alternative sewage disposal system that utilizes a method of treatment
257 other than a subsurface sewage disposal system (sand filtration, chlorination,
258 disinfection, effluent filter, etc.) or those areas classified as distinct concerns
259 must be approved by the Department of Health or his duly authorized
260 representative.
261
262 3.5.2 Disposal systems for areas of distinct concern shall conduct a particular
263 investigation. Any of the following are determined to be areas of distinct
264 concern:
265 a. A minimum soil percolation rate faster than one inch per minute or slower
266 than one inch in thirty minutes.
267 b. Groundwater less than 4.5 meter below ground surface.
268 c. Ledge rock/ bedrock less than 2 meter below ground surface.
269 d. Soils with slopes exceeding twenty-five percent.
270 e. Located within the drawdown area of an existing public water supply
271 well/source with a withdrawal rate in excess of 1 m3 per minute.

315 Septage and fecal sludge management must be provided to protect the
316 environment. Collection and treatment of the accumulated septage, fecal sludge
317 or excreta shall be disposed of in manner approved by the Department of Health.
318
319 a. Collection and Transport - Septage, fecal sludge and excreta collected from
320 any mobile or stationary toilet and sewage treatment facilities shall be
321 collected and transported in a manner to avoid nuisance to the public. An
322 emergency response plan must be provided during the collection and
323 transport. The following conditions shall be strictly observed:
324 i. The collection vehicle used for the transport of septage, fecal sludge and
325 excreta should be enclosed with leak proof body and lock to secure the
326 septage and sludge, and can withstand an impact with another vehicle
327 especially under urban motoring conditions.
328 ii. In case of accidental spillage, sewage, sludge or scum shall be promptly
329 removed or otherwise abated to prevent a nuisance or public health
330 hazard.
331 iii. All vehicles used for the transportation shall be maintained in a clean
332 exterior condition at all times. No defective or leaking equipment shall
333 be used in cleaning operations.
334 iv. All vehicles or equipment shall be stored in a clean condition when not
335 in use. Water used for rinsing such vehicles or equipment shall be
336 considered sewage and shall be disposed of in a sanitary manner
337 approved by the local health authority.
338 v. Raw sludge (untreated sludge) can be transported by land to a stationary
339 treatment facility. In case of inter-island transport, a pre-treatment and
340 proper containment of sludge is required.
341 vi. Collection vehicle should be in good running condition in accordance
342 with the Land Transportation Office (LTO) safety standards on
343 roadworthiness.
344 vii. The vehicle should be properly marked with the following information:
345
346 1. Company name and contact number
347 2. Logo
348 3. Body number
349 4. Markings/signage indicating its content.

351 viii. During the operation, the desludger should carry manifest form, ESC,
352 MOA and other necessary documents related to its operation.

353 ix. The transfer of septage and sludge from the original vehicle to another
354 collection vehicle during transport is prohibited. However, when such
355 transfer is unavoidable, transfer techniques including the loading and
356 unloading shall be included in the operational process and submitted to
357 the CHD to ensure the protection of health and environment.

469 ix. Provisions for soap, mirror and any approved hand-drying material.
470 x. There shall be adequate and separate change rooms for both male and
471 female users with individual lockers for clothes and personal
472 belongings. The change room shall have a space requirement of at least
473 1.9 m2/user.
474 b. Water supply facilities shall be in accordance with the Implementing Rules
475 and Regulation (IRR) and Supplemental IRR of Chapter II “Water Supply” of
476 Code on Sanitation of the Philippines (PD 856) as to its quantity and quality.
477 c. There shall be good practice for Solid Waste Management and shall conform
478 with the provisions of Chapter XVIII “Refuse Disposal” and the Republic
479 Act 9003 known as Ecological Solid Waste Management Act of 2001 and its
480 implementing rules and regulations.
481 d. The service provider/operator shall adopt an approved vermin abatement
482 program to control the infestation of insects and rodents. It shall be in
483 accordance with the IRR of Chapter XVI “Vermin Control” of the Code on
484 Sanitation of the Philippines (P.D. 856).
485 e. The service provider/operator / owner shall provide and institute measures to
486 control odor and other nuisances that may be objectionable and offensive to
487 personnel and community in accordance with the IRR of Chapter XIX
488 “Nuisances and Offensive Trades and Occupations” of Code on Sanitation of
489 the Philippines (P.D. 856).

4924.3 ABANDONEMENT
493 4.3.1 Every abandoned building or house sewer or part thereof, shall be plugged or
494 capped within 1.5 meter of the property line.
495 4.3.2 Every cesspool, septic tank, seepage pit or any sewage disposal system which
496 has been abandoned or has been discontinued otherwise from further use or to
497 which no waste or soil pipe from a plumbing fixture is connected, shall have the
498 sewage removed therefrom and be completely filled with earth, gravel, concrete
499 or other approved material.
500 4.3.3 Every top cover of the cesspool, septic tank, seepage pit or any sewage disposal
501 system shall be removed before filling and the filling shall not extend above the
502 top of the vertical portions of the sidewalls or above the level of any outlet pipe
503 until inspection has been called. After an inspection by the local health office,
504 the cesspool, septic tank or seepage pit shall be filled to the level of the top of the
505 ground.
506 4.3.4 It is unlawful for a person owning or controlling any cesspool, septic tank,
507 seepage pit or any sewage disposal system on his premises or in that portion of

508 any public street, alley or other public property abutting such premises to refuse
509 or neglect to comply with the provision of this section or upon receipt of notice
510 from the local health authority.
511 4.3.5 Where disposal facilities are abandoned, consequent to connecting any premises
512 with the public sewer, the person making the connection shall conduct
513 remediation measures prior to filling all abandoned facilities within 30 days from
514 the time of connecting to the public.
515 4.3.6 The proponent must strictly follow the ECC requirement on abandonment or the
516 proponent must submit an abandonment plan to approved and monitored by the
517 LGU.
518SECTION 5: DRAINAGE
519It shall be the responsibility of every local government unit to provide and maintain in a sanitary
520state and in good repair a satisfactory system of drainage in all inhabited areas where treated
521wastewater from buildings and premises could empty without causing nuisance to the
522community and danger to the public health.

543 a. No person shall dump, discharge, cause or allow to be discharged any non –
544 storm water or pollutant into the municipal storm water drainage system.
545 b. It shall not be allowed to construct, use, maintain or continue any connection
546 to the municipal storm water drainage system from indoor drains, toilets or
547 which allows discharge of wastewater.
548 c. Adequate provisions shall be made to drain rainwater from low areas in
549 buildings and their premises.
550 d. It shall not be allowed to obstruct or interfere with the normal flow of storm
551 water into or out of the municipal drain system unless approved by the
552 City/Municipal Engineer
553 e. The drainage pipe installation and sewerage system of any premises and/or
554 connection with any public disposal shall conform to the Uniform Plumbing
555 Code of the Philippines.
556 f. The drainage system shall be designed, constructed, and maintained so as to
557 guard against fouling, deposits of solids, and clogging, and with adequate
558 cleanouts so arranged that the pipes may be readily cleaned.

560 5.3.3 Combined Sewer
561
562 a. Combined sewer shall only be allowed to highly urbanized areas where the
563 carrying capacity of the receiving body of water is still attainable.
564 b. Dry weather flow/interceptor shall be installed at outfalls.
565
567Establishments such as market and abattoirs, slaughter houses, dairies, poultries, piggeries and
568other facilities as enumerated in DA AO No. 08 series of 1999 including industrial, laundry,
569mining, hospitals, clinics, funeral parlors, laboratories, schools, hotels, resorts, apartments,
570condominiums, subdivisions, malls, food and other similar establishments, as identified by
571DENR AO 2016-08, generating wastewater that require discharge permit shall also obtain ESC
572and other necessary permits and clearances in accordance to this regulation.
573All establishments (i.e. proposed and existing establishments) shall secure approval of the plans
574and design of their wastewater treatment facility from the LGU.
5756.1 CRITERIA

577 As defined in this Order, special establishments are waste generators that produce
578 wastewater which possess a biodegradability index of values ranging from 0.1 to 1. The
579 following are types of wastewater generated from special establishments:

581 6.1.1 DOMESTIC WASTEWATER - wastewater generated from establishments
582 which includes but not limited to apartments, apartel, hotel, motel and other
583 similar establishments.

585 6.1.2 COMMERCIAL WASTEWATER - wastewater generated from
586 establishments which includes but not limited to restaurants, shopping malls,
587 markets, resorts, and other similar establishments.

589 6.1.3 INDUSTRIAL WASTEWATER - wastewater generated from any producing,
590 manufacturing, processing trade or business or any other operations

617 6.3.1 Special Establishments that involves food preparation or any activity in which
618 grease is a by-product of production shall provide or install a suitable grease
619 trap/ interceptor conforming to Uniform Plumbing Code of the Philippines.
620 6.3.2 Special establishments in areas where sewerage system is available shall employ
621 pre-treatment to lower its strength before discharging to wastewater treatment
622 facility using the wastewater acceptance criteria).
623 6.3.3 In areas where sewerage system is not available, all special establishments shall
624 install an onsite treatment facility and the effluent quality must conform to the
625 standard set by the DENR.

652Special Precaution for Radioactive Excreta and Urine of Hospitalized Patient and other
653hazardous healthcare wastes. The wastewater of healthcare establishments contains hazardous
654pharmaceuticals, toxic chemicals, hormone disruptors, and other infectious materials that can be
655released into the environment. The following conditions shall be strictly observed:

6907.10 Radioactive patients should be instructed to use the same toilet bowl at all times and to
691 flush it at least 3 times after its use. Disposal shall be referred to the guidelines of PNRI.

6937.11 A Health Safety and Management Plan (HSMP) shall be prepared as a guide for risk
694 management for all types of wastes in health care facilities.

6988.1 The service provider/operators shall have an Occupational Health and Safety
699 Plan/Program for their personnel, in consonance with the provision of the law on the
700 health security of workers, in accordance to the integrated DOLE – DOH/ OSH
701 guidelines.

7038.2 The operators shall include in their manual of operations the proper and safe operation
704 and maintenance of treatment and disposal facilities for sewage, septage and domestic
705 sludge.

7078.3 The plant operators shall observe and require their personnel to wear the appropriate
708 personal protective equipment (PPE) at work and at all times during the operation.

7108.4 The personnel involved in the operation shall undergo the appropriate training regarding
711 sewage, sludge and septage collection, handling, treatment, disposal, maintenance of
712 facilities and equipment including emergency response. The training service provider
713 shall secure approval from the DOH-HHRDB.

7158.5 The operator and personnel shall secure health certificate from the City/Municipal
716 Health Office (CHO/MHO/IPAs).

763 b. Plans and Designs - Any person, government or private entity, firm and/or
764 agency, corporation, institution or local government unit which intends to
765 construct a public sewerage system or sewage treatment plant shall be
766 required to submit plans, design and the necessary data and specifications to
767 the Provincial/City/Municipal Health or Engineering Office, for approval
768 thereof prior to start of work. In case there is an existing one, it’s as-built plan
769 and specifications shall be submitted for review and approval.
770 c. Designer/Preparers’ plans/design shall be reviewed and approved by a
771 Registered Sanitary Engineer of a Local Health Office.
772 d. Government project shall be signed and sealed by Registered Sanitary
773 Engineer (i.e. outsourced).
774 e. Health and Safety Management Plan to ensure that health, sanitation and
775 safety concerns are integrated in the implementation of project activities and
776 processes
777 f. Engineer’s Report of the project proponent shall be submitted for project
778 proposal that are not required to secure ESC. This is only applicable for
779 onsite treatment facilities with treatment capacity of less than 60 cubic
780 meters, thus a Non-ESC Coverage shall be secured. (refer to Form 2)

7829.2 SANITARY/PLUMBING PERMIT
783
784 9.2.2 The city or municipal Building Official shall refer all applications for
785 Sanitary/Plumbing Permit to the local health office for checking of sanitary
786 facilities, prior to the issuance of the building permit. The construction and
787 installation of Sanitary/Plumbing Permit shall be in accordance with the design
788 and specification and shall be signed by Registered Sanitary Engineer before
789 issuance of Occupancy Permit.
790 9.2.3 The property owner, service provider/operator or his authorized representative
791 agent shall file an application for a Sanitary/Plumbing Permit to the local health
792 office for construction, installation, alteration, or extension of an individual
793 excreta and sewage disposal, a sewage treatment, sub-surface absorption system
794 or other treatment device prior to start of work.
795 9.2.4 The application shall be made in writing on a form prescribed by the Department
796 of Health and shall contain all pertinent information relative to the location,
797 construction, installation, alteration or extension of an individual sewage
798 disposal system.

8009.3 OPERATIONAL PERMIT

802 9.3.1 No person shall discharge or permit or cause to be discharged the effluent from
803 an individual sewage disposal system or other putrescible or offensive wastes
804 from his premises unless an application for an operational permit has been
805 approved by the local health office.
806 9.3.2 Only a person or dwelling owner who complies with the requirements of these
807 rules and regulations shall be issued an operational permit.
808 9.3.3 The local health office at any reasonable time may inspect the sewage disposal
809 system, sample the effluent, or take any other step which he deems necessary to
810 ensure compliance with these rules and regulations. The local health authority
811 may utilize inspection and reports submitted by local health officer, sanitary
812 engineer, sanitation inspector or other qualified national or local government
813 personnel to determine operational compliance.

922 a. Appoint a Sanitary Engineer for the City/Municipal Health Office.
923 b. Adopt and implement national rules and regulations and provincial
924 ordinances related to sewage, sludge and septage collection, handling,
925 transport, treatment and disposal.
926 c. Receives and reviews notarized ESC application, conducts site inspection and
927 recommends action.
928 d. Implements the provisions of this IRR through quarterly inspection or as the
929 need arises.
930 e. Issues Health Certificate and Sanitary Permit and other permits.
931 f. Provides necessary supplies, equipment and other logistics support to
932 City/Municipal Health Office for use in the conduct of evaluation, inspection,
933 monitoring of establishments covered by this IRR.
934 g. Implements the posting of Sanitation Standard Rating Sticker for the
935 guidance of the public.
936 h. Revokes the Sanitary Permit of the service provider/operator upon the
937 recommendation of the City/Municipal Health Office after finding
938 discrepancies in the operation of the establishments, after due process of law.
939 i. Take the lead and spearhead committees and inter-agencies relative to
940 sanitation and public health.
941 j. Prioritize actions in support to the overall sanitation program through the
942 provision of appropriate budget.
943 k. Enforce the provisions of these rules and regulations.

945 10.4.4 Provincial/City/Municipal Sanitary Engineer
946
947 a. The Sanitary Engineer evaluates detailed engineering design, specifications,
948 calculations, engineering report and documents for sanitation facilities as to
949 compliance to technical requirements under the Building Code and Sanitation
950 Code.
951 b. The Provincial, City or Municipal Sanitary Engineer shall be primarily
952 responsible for the enforcement of the provisions of this implementing rules

99310.6 OTHER REGULATORY AGENCIES

995 10.6.1 Environmental Management Bureau – Department of Environment and
996 Natural Resources (EMB-DENR)

998 a. The DENR/EMB shall fully implement the accreditation of the PCO as per
999 DENR A.O. #02 s.2014).
1000 b. Ensure that all establishments and facilities as described in this IRR have
1001 secured ESC prior to issuance of ECC and Discharge Permit.
1002 c. Monitoring of the environmental compliance of the establishment and
1003 facilities within the scope of this IRR.

1017 a. Guide the City and Municipal Building Officials in the performance of their
1018 duties and responsibilities pertinent to Building Codes of the Philippines,
1019 issuing permits, and the provisions of this IRR.
1020 b. Issue and promulgate additional rules and regulations related to building

1072 11.3.1 The city or municipal health officer or the chief of the sanitation division or
1073 section or unit of the local health office, as the case maybe, shall issue a mission
1074 order (EHS Form No. 112) for every sanitation inspection that will be conducted
1075 by the Sanitary Engineer and/or Sanitation Inspector.
1076 11.3.2 The mission order must contain the date, mission order number and series, the
1077 name of the inspector and the I.D. number, the business name and addresses,
1078 categories of establishments or facilities and the scheduled date of inspection.
1079 This must be shown to owner/ service provider/operator of the establishment
1080 before any inspection is conducted. The immediate supervisor of the inspector
1081 shall monitor the enforcement of the mission order.
1082 11.3.3 Sanitary inspection conducted without mission order is prohibited.
1083 a. Provided, that in cases of extreme urgency or exigency of service, or where
1084 the sanitation issue is apparent and readily perceptible, and where public
1085 health or safety is in danger, a Mission Order may be dispensed with.
1086 b. Provided further, that all the reportorial requirements after the inspection
1087 shall be complied with by the inspector.
1088 11.3.4 The owner/service provider/operator of the establishment or facility shall report
1089 to the local health officer or chief of sanitation division/section/unit any
1090 unauthorized inspection that was executed.

1094 11.4.1 If upon re-inspection of the establishment/facility after the deadline, the Sanitary
1095 Engineer and/or Sanitation Inspector finds that correction has not been effected,
1096 he shall report to the local health officer who shall recommend to the local health
1097 authority the revocation of the sanitary permit.
1098 11.4.2 A copy of the inspection form and any notice served shall in all cases be filed
1099 and kept by the local health office and be available for inspection by authorized

1104 11.5.1 Whenever an inspection and evaluation form indicates non-complying items, the
1105 local health officer shall serve to the holder of the permit, owner/service

1106 provider/operator a sanitary order requiring him, within the time (grace period)
1107 stated in the order, to take remedial action as may be specified therein.
1108 11.5.2 In case of non-compliance with the terms of the first sanitary order, the health
1109 officer may cause the issuance of a second notice to the holder of the permit,
1110 owner service provider/operator.
1111 a. If the owner of the establishment needs additional time to comply with the
1112 first sanitary order, he shall request the local health officer in writing, prior to
1113 the expiration of the said sanitary order, for an extension of grace period. The
1114 local health officer, upon the recommendation of the Sanitary Engineer
1115 and/or Sanitation Inspector who conducted the inspection, will act on such
1116 request.
1117 b. Notice of Hearing (EHS Form No. 118). The city or municipal health officer
1118 shall call the holder of the sanitary permit to show cause, at a time and place
1119 stated in the notice, why the permit issued in respect of the
1120 establishment/facility shall not be revoked.

112211.6 REVOCATION OF THE PERMIT

1124 11.6.1 After prior notices and hearing as provided above, the local health officer, if
1125 satisfied that the terms of the two notices have not been complied with or that
1126 failure to comply therewith is not excusable, shall recommend to the local health
1127 authority the revocation of the said permit, or;
1128 11.6.2 After the second sanitary order on an extended grace period, a re-inspection was
1129 conducted and still the owner/service provider/operator fails with such order as
1130 reported by the Sanitary Engineer and/or Sanitation Inspector, the local health
1131 officer shall recommend the revocation of the sanitary permit without delay and
1132 shall inform other related agencies of the city or municipality of such revocation.
1133 11.6.3 The local health officer shall recommend to the local health authority the lifting
1134 of suspension of permit whenever the owner/ service provider/operator of the
1135 establishment/facility complies with notices.
1136 11.6.4 The owner/ service provider/operator of the establishment/facility may file a
1137 motion for reconsideration to the local health authority if he/she is not satisfied
1138 with the action of the local health officer.
1139 11.6.5 The local health authority may file court proceedings against any establishment
1140 continuously operating after the revocation of its permit.

1225 a. Drain lines shall be constructed of materials not subject to excessive deterioration and
1226 shall be laid with open joints, except that perforated clay tile, perforated bituminous fiber
1227 pipe, or other approved materials may be used, provided that sufficient openings are
1228 available for distribution of the effluent into the trench areas. (Total area of perforations
1229 shall be at least 150% of the cross-sectional area of the pipe.)
1230 b. The drain lines shall have a minimum diameter of 100mm. (4 in.) and shall have a relative
1231 level grade, but in no instance shall have a fall greater than 1 cm. in 60 minutes.
1232 c. In leaching tile fields the minimum distance between centerline of trenches shall be at
1233 least 1.80 m. (6 ft.).
1234 d. In leaching beds, lines for distributing effluent shall be spaced 0.90 m. (3 ft.) from side to
1235 side of trench walls.
1236 e. Final grading shall be completed prior to installing a leaching field or leaching bed.
1237 f. The leaching tile field or leaching bed shall have a minimum depth of 30.0 cm. (12 in.) of
1238 clean gravel, stone or slag fill, extending at least 5.0 cm. (2 in) above and 15 cm. (6 in)
1239 below the drain lines. The filter material shall be 2 cm. to 6.5 cm. (0.80 to 2.5 in.) in size.
1240 g. The absorption trenches shall have a minimum depth of 45 cm. (18 in.) but not more than
1241 75 cm. (30 in.)
1242 h. Before placing filter material and drain lines in a prepared excavation, all smeared or
1243 compacted surfaces shall be removed from trenches by raking to a depth of 2.5 cm. and
1244 the loose material is removed. Clean stone, gravel, slag or similar filter material varying
1245 in size from 2.0 cm. to 6.5 cm. shall be placed in the trench to the depth and grade
1246 required by this section. Drain pipe shall be placed on filter material in an approved
1247 manner. The drain lines shall then be covered with pervious material to the minimum
1248 depth of 5 cm. as required by this section, and this covered with untreated building paper,
1249 straw or similar porous material to prevent closure of voids with earth backfill.
1250 i. Where two or more drain lines are installed, an approved distribution box of sufficient
1251 size to receive lateral lines shall be constructed at the head of each disposal field. The
1252 inverts of all outlets shall be level and the invert of the inlet shall be at least 2.5 cm. above
1253 the outlets. Suitable baffles shall be provided to insure equal flow. Distribution boxes
1254 shall be built on a level concrete slab installed in natural or compacted soil.
1255 j. All laterals from an approved distribution box to the disposal field where the grade
1256 exceeds 1:2000 (0.0005%) shall be bell and spigot vitrified clay or other approved pipe
