ASSESSMENT BRIEFING

Creation of a 30 minute training programme


You are the HR Adviser in an organisation. You have been asked to put together a
30-minute training session for a group of newly recruited line managers. You can
presume that your audience has minimal experience of managing people, and no
experience of employment law.
The presentation you are giving is part of their induction process, and the brief is to
give an overview of the legal issues that they must understand when managing
people.
The Assessment brief is available on the VLE.
You will be required to produce
• slides that you would use in your presentation
• notes that you would use to accompany your presentation

ASSESSMENT BRIEF CONTINUED
Specifically, you must cover
1. The aims and objectives of employment law. You must include the role of the Employment Tribunal and other
courts in the UK in enforcing the law, and the ways of settling disputes before and during the Employment
Tribunal process. (AC 1.1, 1.2, 1.3)
2. The importance of ensuring that the recruitment and selection process of new employees is fair. In addressing
this point you must outline the key issues relating to discrimination and explain how a contract of employment
is created. (AC 2.1, 2.2)
3. The law to be aware of as organisations change and develop. In addressing this you must highlight the
processes to be followed when varying a contract of employment, managing redundancies and addressing a
transfer of undertaking. (AC 3.1, 3.2, 3.3)
4. The key rights that employees have during employment. Here you must cover working time, pay (including
equal pay) and family friendly rights specifically including maternity and paternity rights. Highlight the areas
that you think are most important for line managers to know about. (AC 4.1, 4.2, 4.3)
5. The protection that the law gives to employees. Here your employer has asked you to specifically address
health and safety, the implied duties of the contract of employment and freedom of association. There should
be an example of at least two implied duties and an explanation of what happens when these duties are
breached (which will include reference to constructive dismissal). (AC 5.1, 5.2, 5.3)
6. How the law requires disciplinary situations relating to capability and conduct to be addressed. You must
explain the procedures that line managers have to follow. You must explain the right of employees to be
accompanied during formal disciplinary or grievance hearings. (AC 6.1, 6.2)

WHAT IS REQUIRED?

Evidence must be produced – you need to ensure you back up what you are saying.

• Legal authorities – legislation, case law


• Academic arguments on the application of the law to practical situations
• Use information in a critical and informed way
• References – ensure all sources are referenced in the notes/slides where appropriate
• In the notes, use Harvard referencing and include a bibliography
• References and bibliography are not included in your word count
• No more than 15 slides
• No more than 3900 words
• NOTE: You do not have to give the presentation

3 How will you manage and monitor the word count?
4 How does the work from your studies help you to answer the questions? Consider
the laws that apply.
5 How can you demonstrate application of your learning to the organisational context?
6 How will you ensure assessment requirements are met (the learning outcomes)?

The assessment criteria are listed next to each learning outcome.


When answering each of the six questions, look back to the assessment criteria and ensure that you
have addressed each of them – thus you will meet all the learning outcomes.

STRUCTURE

Presentation slides – no more than 15 – six questions to be answered.


There are 16 assessment criteria – one for each? Decide which two will be combined.

Notes to accompany the slides


3900 words maximum – six questions – 650 words each – but does not have to be equally divided –
think about which questions might need more words (700 perhaps) and which can be answered in
fewer words.

Remember your audience


• This is a presentation aimed at line managers with no prior knowledge of employment law
• But always bear in mind that this is an academic piece of work, the aim of which is meet the
requirements of the unit! So, for example, don’t forget Harvard referencing, and use of references
to relevant law (legislation and case law)

In addition, as this is a law assessment, you will need to reference statute and cases.
Legislation
On first reference, cite the full name and date of legislation, for example Employment Rights Act 1996.
Refer to relevant sections/schedules also.
Further references can be abbreviated; for example ERA
At the end, include a list of statutes used – again, use full citation: Employment Rights Act 1996
Case law
On first reference, cite the full name of a case; for example British Homes Stores Ltd v Burchell (1978).
Further references can be abbreviated to the name of the claimant; for example Burchell.
In the bibliography, include a list of cases used – again using the full name and the source, so
British Home Stores Limited v Burchell [1978] IRLR 379
or it could be a reference to bailii British Home Stores Ltd v Burchell, available at:
https://www.bailii.org/cgi-bin/format.cgi?doc=/uk/cases/UKEAT/1978/108_78_2007.html
