DEED OF EXTRA-JUDICIAL SETTLEMENT OF REAL PROPERTY

WITH WAIVER AND RENUNCIATION OF RIGHTS

KNOW ALL MEN BY THESE PRESENTS:

WHEREAS, FELICIDAD JUANGA, died intestate at Leganes, Iloilo on July 28,


1992, leaving no will nor debts settled to date but leaving a parcel of land;

WHEREAS, at the time of his death, she left as forced heir, ELISEO JUANGA
JAPITANA SR. married to Antonieta Luceño Japitana, both died on November 24, 1996
and May 23, 2009 respectively in Leganes, Iloilo and was also survived by the following
heirs:

ROSELLER LUCEÑO JAPITANA
JOHNSON LUCEÑO JAPITANA
ELISEO LUCEÑO JAPITANA JR.
ELLEN JAPITANA CALDERON
HELEN JAPITANA SALADO

All of legal age, Filipinos and residents of Leganes, Iloilo, Philippines.

WITNESSETH:
 
THAT we are the legitimate children of ELISEO JUANGA JAPITANA SR. A copy
of his death certificate is hereto attached as Annex “A”;
 
THAT said deceased died without any will or testament and without any
outstanding debts in favor of any person or entity;

THAT said deceased, at the time of his death, left a certain real property,situated
in Barangay Napnud, Leganes, Iloilo, Philippines and more particularly described as
Original Certificate of Title No. 12164, covering a parcel of land known as Lot No.
1769 of the Cadastral Survey of Sta. Barbara, PSD No. 574;

WHEREAS, in view of the above facts and circumstances, we are therefore co-
owners and to terminate co-ownership over the same, we hereby adjudicate over the
same in pro-indiviso sharing pursuant to Section 1, Rule 74 of the Rules of Court of the
Philippines, subject to the liabilities imposed by Section 4, of the same rule.

WAIVER OF RIGHTS

WHEREAS, We, ESPERANZA JAPITANA CADORNIGARA, ROSELLER


LUCEÑO JAPITANA, JOHNSON LUCEÑO JAPITANA, ELLEN JAPITANA CALDERON,
and HELEN JAPITANA SALADO (whose personal circumstances is mentioned above)
has agreed and covenanted to CEDE, TRANSFER and CONVEY unto our co-heir
ELISEO JUANGA JAPITANA JR. (whose personal circumstances are mentioned
above), his heirs and assigns the full ownership and possession of the above-described
property.
 
NOW, THEREFORE, for and in consideration of the foregoing premises, We
waived and renounced as by these presents, We hereby WAIVE and RENOUNCE our
share, right and participation over the above-described property in favor of ELISEO
JUANGA JAPITANA JR. their heirs and assigns the full ownership and possession of
the above-described property.
IN WITNESS WHEREOF, we have hereunto set our hands, this _____ day of
_______________in the City of Iloilo, Philippines.
