4) AfTAB ALAM, son of Late Ali Akbar, by faith Islam, by occupation


Housewife, by nationality Indian, all are residing at 12/1/H/14, Moulana
Md Ali Road, P.S. Ekbalpore, Kolkata-700023, hereinafter jointly called
and referred to as the FIRST PARTY/ LICSENSORS (which term or
expression shall unless excluded by or repugnant to the context be
deemed to mean and include his heirs, executors, administration, legal
representatives and assigns) of the ONE PART.
AND
MOHAMMAD SAHID, son of Md Sahwja, by faith Muslim, by
occupation Business, residing at Village - Panjiya, P.O & P.S -
Charkapatthar Jamul, Bihar - 811314, hereinafter called and referred to
as the SECOND PARTY/ LICENSEE (which term or expression shall
unless excluded by or repugnant to the context be deemed to mean and
include his heirs, executors, administration, legal representatives and
assigns) of the OTHER PART.

WHEREAS the Licensors are the owner of a room on the ground floor
with common bathroom at premises No.12/1/H/14, Moulana Md Ali
Road, P.S. Ekbalpore, Kolkata- 700023.

WHEREAS the Licensee is known to the Licensors and Licensee being


in urgent need of accommodation requested the Licensors to provide a
temporary accommodation in the said room at premises No. 12/1/H/14,
Moulana Md Ali Road, P.S. Ekbalpore, Kolkata-700023, morefully
described in the SCHEDULE below for a temporary and short period of
11 (Eleven) months on Leave and Licensee basis for residential purpose
on the following terms and conditions commencing from, 5th August,
2021 till June 5th 2022.

NOW THIS INDENTURE WITNESSETH as follows:-

1. That the Licensee shall use the said flat for the purpose of residence
for himself and his family members on and from 5th August, 2021.

2. That the license is valid up to 11 (Eleven) months that is up to 5 th June


2022.

3. That the monthly licensee fee is settled at Rs.2300/- (Rupees: -Two


Thousand Three Hundred) only per month without electricity charge
payable according to English calendar month with 7th day of each
current months in advance.

4. That the Licensee shall keep in deposit a sum of Rs. 5,000/-(Rupees


Five thousand) only to the Licensors as Security Deposit which will be
refunded with the expiry of the August 2021, without any interest at the
time of handover of the possession of said room by the Licensee to the
Licensor.

5. That the Licensee shall not transfer, assign or part with possession of
the said room to any third person in any manner or whatsoever.

6. That the License will not use the said room for any illegal or immoral
purpose and shall not store any inflammable goods and articles in the
said room. Any change of purpose shall be in clear terms tantamount to
breach of this agreement and/or misunderstanding and in such
circumstances the Licensee shall be liable for eviction before the expiry
of said stipulated period of 11 (Eleven) months.

7. That after completion of the said period of eleven (11) months i.e on
5thJune, 2022 the Licensee shall vacate the said room and deliver the
peaceful vacant possession of the said room to the Licensors.

8. That the Licensee shall use the said room strictly for his residential
purpose only and shall live peacefully without causing any nuisance,
interference and / or annoyance to the Licensors or to any other
occupants of the said building,

9) That if the Licensee violates and/or commit any breach the covenants
and conditions hereunder imposed then the Licensors shall be entitled to
revoke the Licensee earlier upon a fortnight notice notwithstanding the
fact that the contractual period of 11 (Eleven) months has not been
expired when the Licensee shall leave and vacate the said room and
deliver the peaceful vacant possession to the Licensors.

10) That if the Licensee fails and/or neglects to vacate and deliver
peaceful possession of the said room on completion of months then in
that case the Licensee shall pay the damages @ Rs. 500 (Rupees Five
hundred) only per day to the Licensors till recovery of the possession of
the said room and shall entail forfeiture of the security amount Rs. 5,000
(Rupees Five thousand) only.

10) That the instant Agreement is purely a Leave and License


Agreement and this agreement cannot be at any point of time and shall
never be construed and interpreted as Tenancy Agreement or Lease.

SCHEDULE ABOVE REFERRED TO


ALL THAT piece and parcel of one room with common bathroom
situated at premises No. 12/1/H/14, Moulana Md All Road, P.S.
Ekbalpore, Kolkata-700023.

IN WITNESSES WHEREOF the developer and the Tenant have


hereunto set and subscribed their respective hands and seal on this day,
month and year first above written.
