MARSHON ROBINSON is charged with attempted murder. On July 28th, Cpl. Bishop responded to a report of a shooting and found Terry Mitchell shot twice. Mitchell identified MARSHON ROBINSON as the shooter. Security footage shows ROBINSON shooting Mitchell in the back as he ran away. Officers found the gun used hidden by ROBINSON's residence.

Comes now the undersigned Affiant, a law enforcemen


t officer for the Elkhart Police Department,
after being duly sworn upon his oath states as follows:
and

1. THAT on or about the 28th day of July, 2021, Cpl Bishop


, a law enforcement officer with the Elkhar
Police Department reSponded to a report t
of a shooting located at 1396 Benham
Indiana. Upon arrival, Officer Bishop Ave, Elkhar t County ,
observed a male, Terry Mitchell lying in an
alley bleeding from his
left shoulder blade area and buttoc
ks. Officer Bishctp observed holes in those
areas that looked like entry
wounds from bullets. Terry Mitchell was transported
t0 memorial hospital for treatment. The
secured by the Elkhart Police Department scene was
and seven (7) 9mm
casings were recovered close to where
Terry Mitchell was discovered.

THAT Terry Mitchell was interviewed at Memorial Hospital.


Terry Mitchell advised that he had walked
with a male named MARSHON ROBINSON to the north side of the Elkhart Housing Author
Benham Ava, where MARSHON ROBINSON shot him. Terry Mitchell explained that heity, 0n
MARSHON ROBINSON from prior interactions with him and when knew
MARSHONROBINSON initially
MARSHON
pulled the gun, he thought ROBINSON was just going to shoot it in the air. Terry Mitchell
advised that when MARSHON ROBINSON turned the gun on him he ran. Terry Mitchell advise
then felt his body go numb and realized that he d that he
had been shot.

. THAT Dr. Thomas Memorial Hospital advised Terry Mitchel] had been
at
shot twice. One of the bullets
had entered his iefi shoulder blade and traveled towar
ds his esophagus stopping millimeters from being
fatal. The second bullet entered
Terry Mitchell in his left glute and stopped several
millimeters from his
femoral artery.

. THAT MARSHON ROBINSON was located and after being advised of his rights and stated
that it was
Terry Mitchell who had the gun and the two had fought
obtained the upper hand shoved Terry Mitchell
over it. MARSHONROBI NSON advised that he

advised that he then threw the gun


t0 the ground and shot him. MARSHON
ROBINSON
by a building.

. THAT DetectiVe Claeys obtained the security footage


of the event and observed Terry Mitchell and
MARSHON ROBINSON walking together. MARSHONROBINSON stops and Terry Mitchell
continues for a few steps before turning around. MARSHON
ROBINSON bends over and Terry Mitchell
begins t0 run away, exposing his back to MARSHON
ROBINSON. Shortly thereafter Teny Mitchell
stumbles and falls to the ground and MARSHON
ROBINSON runs ofi.

. THAT officers from the Elkhart Police Department


ROBINSON’S
obtained a search warrant for
residence and upon execution of the search warran
MARSHON
located. That M&P Shield was determined to be the gun the fired
t a Smith and Wesson M&Pshield was
the seven (7) rounds, the casings of
which were discovered by Terry Mitchell.

7. THAT all of the aforesaid facts


occurred in Elkhart County, Indiana,
knowledge or the personal knowledge of and are within my personal
the aforementioned persons. And,
information has been corroborated that the aforesaid
by independent observations and investigation

tment, and, accordingly, I believe the afore
is reliable and credible. said information
