NOTICE

TEMPORARY REGISTRATION OF FOREIGN CONTRACTORS ENGAGED IN CONSTRUCTION PROJECTS IN SRI LANKA

Registration of Foreign Contractors

As per the Subsection 39 (1) of the Construction Industry Development Act No.33 of 2014, every foreign contractor
prior to engaging in any identified construction work in Sri Lanka shall obtain a temporary registration as a
contractor, with Construction Industry Development Authority (CIDA). The procedure for registration and renewal
of such registration are as prescribed by the Extraordinary Gazette bearing No.2085/19 dated 23rd August 2018.

As per the Subsection 39 (2) of the said Act, no person shall engage a foreign contractor in any identified
construction works unless such contractor is registered with CIDA under this section.

Identified Construction Work


As per the Section 67 of the said Act, “identified construction works” means:

(a) all buildings, structures, or any building or structure or landscape which consists of facilities and amenities for
public use exceeding in value rupees ten million or such higher value as may be prescribed by the Minister, from
time to time; and
(b) all buildings, structures or landscapes which need approval of environmental, geological and cultural heritage
regulatory bodies.

Any private residential building constructed for the personal use of any private owner shall be excluded from the
definition of the expression “identified construction works”

Punishable Offence under the Act


Subsection 56 (1) (a) of the Construction Industry Development Act states that, any person who contravenes, or
fails to comply with, any provision of this Act or any regulation made thereunder shall be guilty of an offence under
this Act.
As per the Subsection 56 (2) of the said Act, any person who commits an offence under this Act, shall upon
conviction after summary trial before a Magistrate, be liable to a fine not exceeding rupees one hundred thousand
or to imprisonment for a period not exceeding two years or to both such fine and imprisonment.

Mandatory Requirement
Therefore, every Foreign Contractor who intends to be engaged in a Project of identified construction work in Sri
Lanka, is hereby notified to be registered with CIDA for the period of the Project, before the awarding of the
contract, having obtained a Letter of Intent from the Client of the Project, by submitting a duly completed
Application Form to the Director General of CIDA together with documents and registration fees as per the above
mentioned Extraordinary Regulation.

Every Client of such Project of identified construction work in Sri Lanka who intends to engage a Foreign
Contractor in such a Project, is hereby notified, to direct such Foreign Contractor to be registered with CIDA in the
above manner, for the period of the Project, before the awarding of the contract, having issued a Letter of Intent
to the Contractor.
