Judge: Call the case/Please read the calendar.
Clerk of Court: For trial, People of the Philippines versus Justin Floro Ortega y Francia
and Kyle Terence Viloria y Amilao, Criminal Case No. RP-PS5-101356 & Criminal Case
No. RP-PS5-101357 for Violation of Section 5 and 11 of the R.A. No. 9165
(Comprehensive Dangerous Drugs Act of 2002).
Judge: Appearances.
Prosecution: Your Honor, Prosecutor Jeric Bondoc appearing for the state.
Defense: Your Honor, Atty. (name) appearing for both the accused.
Judge Pimentel: For the prosecution, you may now call your witness.

PRESENTATION OF WITNESS
Prosecution: The prosecution would like to call on our seventh witness, Mr. Ronald
Moreno
Clerk of Court: Can you please raise your right hand. Do you swear to tell the whole
truth and nothing but the truth so help you God.
Witness: Yes, Ma’am. So help me God.
Clerk of Court: Please state your name, age, address, and other personal circumstances
that will lead to identify you.
Witness: I am PCMS Ronald Moreno, 29 years old, single, residing at Number 359 Taylo
Street, Taft. Avenue, Pasay City, Metro Manila, and I am a Police Chief Master Sergeant
of the Pasay City Police.
Prosecution: Your Honor, the testimony of the witness is offered to prove the identities
of the accused and corroborate the affidavits and testimonies of the police officers.
PCMS Moreno is part of the buy-bust operation team who arrested the accused herein
and he was in-charge of the documentation for the said case. Furthermore, his
testimony is offered to identify the evidence submitted by the prosecution, particularly
Exhibit A, C, C-1, C-2, E, E-1 F, F-1 and other related matters. May I proceed, your
Honor, with the direct examination.
Judge: Yes, you may proceed.

PROSECUTION (DIRECT EXAMINATION):

1. Q: Mr. Witness how are you related in this case?


A: I am the witness of the prosecution for the said case.
2. Q: Can you share to the court your involvement in the said case as the witness?
A: I am part of the buy-bust operation team of the Pasay City Police Station.

3. Q: How long have you been in the service Police Chief Master Sergeant?
A: I have been in the service for 5 years already.

4. Q: What are the cases you’re currently handling and have previously handled?
A: I have been part of the Pasay City Police for 5 years and that I have handled
various cases but mostly drugs cases.

5. Q: Since you’ve mentioned a while ago that you are part of the buy-bust
operation, will you be able to identify the accused that were arrested during the
operation?
A: Yes Ma’am.

6. Q: Are they here? Can you please identify or pinpoint them?


A: Yes Ma’am. They are present in this court. The one wearing (clothes and other
physical identification and point the person).

(For identification – the clerk of court will ask the accused to stand-up) Clerk of Court: Please
stand and identify yourself.

Accused: Your Honor, my name is (name)


Clerk of Court: For the record your Honor, the witness pointed to a person wearing
(clothes and other physical identification) and gave his name which is (name of the
accused).

7. Q: How did you learn about the violations of the accused?


A: We had a briefing with Police Major Hingan, along with the buy-bust operation
team, Innocencio, Gipal, Marcos, Diaz and PSSg Descartin, and there he informed us
about the information that was relayed to him by a reliable informant regarding the
violations of the accused.

8. Q: What happened during the briefing?


A: Police Major Hingan gave an instruction to us to conduct a Buy-Bust operation
and we have discussed the procedure for such. Then we were briefed that PSSg
Justin Jeremy Edrei B. Descartin, was designated as poser buyer in the planned buy-
bust operation, and that the buy-bust operation team, consisting of I, PCMS Diaz,
Innocencio, Gipal and Marcos are assigned in a hiding place and we have to wait for
a pre-assigned signal of PSSg Descartin.

9. Q: What is this pre-assigned signal?

A: The pre-assigned signal agreed upon is the removal of PSSg Descartin’s cap
which is a sign that there is already a transaction and the marked money is already
possessed by the suspect.

10. Q: What happened after the briefing?


A: After the briefing, we prepared the necessary requirements and prepared
ourselves for the operation. Then after such, we went to San Isidro Labrador Parish
Church. PSSg Descartin went to the front of the church while I stationed myself at
the nearby store across the church.

11. Q: What did you do during the buy-bust operation?


A: I am one of those who were assigned in a certain hiding place to wait for the
signal of PSSg Descartin, and also after the arrest I was in-charge to assist for the
seize and confiscate and do physical inventory of the evidence especially
dangerous drugs.

12. Q: What happened after you were assigned to your designated place?
A: Then after some time, PSSg Descartin signaled the operation team by removing
his cap. The team responded and arrested Justine Ortega and Kyle Viloria and the
accused Ortega and Viloria ran towards different directions but eventually were
arrested.

13. Q: After they were arrested, what happened?

A: They were frisked and we had an inventory and documentation of the seized
drugs and marked money.

14. Q: Mr. Witness I am showing to you a 500 peso bill, is this the marked money?

A: Yes Ma’am. 500 peso bill bearing serial number CZ007415

Prosecution: Your Honor, for the record, the witness identified the 500 peso bill bearing
serial number CZ007415 previously marked as Exhibit A.
15. Q: Mr. Witness I am showing to you three sachets, are these the sachets that were
confiscated?

A: Yes Ma’am.

Prosecution: Your Honor, for the record, the witness identified the sachets previously
marked as Exhibit C with serial number PA/JS 08-10-19-YB, Exhibit C-1 with serial
number PA/JS 08-10 YB and Exhibit C-2 PNJS 08-10-19 YB.

16. Q: If I will show you the photos during the operation, will you be able to identify
it?

A: Yes Ma’am.

17. Q: I am showing to you these photos, please check the same, do you recognize
these photos?

A: Yes ma’am, I took the said photos.

18. Q: Why did you take such photos Mr. Witness?

A: Ma’am I took it because I was in-charge of the documentation and/or the taking
of photos during the buy-bust operation. And also, it is a standard procedure that
during the operations, the apprehending officer or team having initial custody and
control of the drugs shall, immediately after seizure and confiscation, physically
inventory and photograph the same in the presence of the accused or the person/s
from whom such items were confiscated and/or seized, or his/her representative
or counsel, a representative from the media and any elected public official. Then
after that the physical inventory and photograph shall be conducted at the place
where the search warrant is served; or at the nearest police station or at the nearest
office of the apprehending officer/team, whichever is practicable.

Prosecution: Your Honor, please with leave of court, may we request that the said
documentation be marked as our exhibit P. And please put on record that the same was
recognized by the witness.

19. Q: How can you further prove that you took the photos?
A: I have accomplished a booking sheet.

20. Q: Do you recognize this document marked as Exhibit E and E-1?


A: Yes, that is the Receipt and Inventory of the Property Seized and my name is
indicated therein.
Prosecution: Your Honor, for the record, the witness recognized the document
consisting of two pages previously marked as Exhibit E and E-1.

21. Q: Do you recognize this document marked as Exhibit F and F-1?


A: Yes, that is the Chain of Custody Form and my name is indicated therein as the
investigating officer.
Prosecution: Your Honor, for the record, the witness recognized the document
consisting of two pages previously marked as Exhibit F and F-1.

Prosecution: That is all your Honor. We are done with the direct examination of the
witness.
Judge: Confirms. Thank you, counsel.
Judge: The Defense would like to cross?
Defense: No re-cross, your Honor.
