DATA PRIVACY NOTICE

FOR APPLICANTS AND EMPLOYEES

Monde Nissin Corporation (hereafter ‘MNC’ or the ‘Company’) respects and values your privacy and employs reasonable measures to protect your personal information in accordance with the Data
Privacy Act of 2012 (‘DPA’), its Implementing Rules and Regulations, and related issuances from the National Privacy Commission (‘NPC’).

As your potential employer/employer, it is necessary for the Company to collect and process your personal data for the purposes stated in this notice.

This Data Privacy Notice will inform you on how we process and protect your personal information. By signing the Declaration above, you certify that you have read and understood, and agree to, the
terms below.

1. PERSONAL INFORMATION COLLECTED AND PROCESSED.


The Company collects the following categories of personal data:
• Personal Details: Name, current address, provincial address, contact details, birthdate, birthplace, age, gender, civil status, religion, citizenship, signature
• Family details: Name of spouse, employer and position of spouse, names of children, number of children, gender of children, name of father, age of father, name of mother, age of
mother, name of siblings, age of siblings, gender of siblings, civil status of siblings, Educational attainment of siblings, employer and occupation of siblings
• Government-Issued Identification: SSS Number, TIN, PhilHealth Number, PAG-IBIG Number
• Educational Background: Schools attended, degree/course, date attended, honors/commendations received, diploma/certificate of graduation, transcript of records/copy of grades,
professional license/s, license number
• Health information: Height, weight, any serious medical condition or major surgery undertaken, results of medical examination and laboratory tests
• Employment Background: Name of company, address of company, contact details of company, position or title held, inclusive dates of employment, salary, reason for leaving the
company, employment history with MNC or any of its affiliates, history of disciplinary action, nature of disciplinary action, law violated
• Organizations or Affiliations: Name of organization, inclusive dates of affiliation, position/s held
• Clearances: NBI clearance, clearance from previous employers, barangay clearance, police clearance
• Where applicable, conviction of any criminal offences
• References: Name, address, telephone number, position/company, relationship
• Emergency Contacts: Name, address, telephone number,
• Information Related to Employment with the Company: Other languages or dialects spoken, relationship with any former or current employee of MNC

2. METHODS OF COLLECTION
We collect your personal data from any documents or communications that you may have directly submitted to us, from publicly available information, or from third parties. This may include any
references that you have provided, such as present and past employers, educational institutions, associations, family members.

Once you become an employee of the Company, you will inevitably be referred to in many Company documents and records that are produced by you and your colleagues in the course of carrying out
your duties and the business of the Company. Your personal data relevant to your role in the Company, including your participation in Company events and activities, may be made public through
different media such as Company newsletters, website, and social media accounts.

You may inform us of the specific personal data you do not want to be processed beyond the requested purpose. We will respect your request in so far as it is feasible to fulfill the purposes for which
the personal data was collected.

Where you have provided us with the personal data of individuals other than yourself, you warrant that you have obtained their consent for the disclosure, in accordance with the DPA.

3. METHODS OF PROCESSING
Your personal data may be processed both by way of computer media and on paper, in compliance with the rules in relation to personal data protection, therein including those relating to data
security.

4. PURPOSES.
Your personal data shall be processed for the following purposes:
a. In relation to your job application:
1) To source interested candidates for employment;
2) To process submitted forms and documents bearing personal information for the purpose of determining the fitness of the applicant for the position applied for;
3) To facilitate the conduct of mandatory pre-employment examinations;
4) To fulfill the manpower requirements of the various departments within MNC;

b. Where you have been accepted for employment within the Company:
1) To facilitate your onboarding into the Company, which includes processing of your pre-employment requirements;
2) To facilitate entry into contracts with the Company and third parties;
3) When so required by the Company, to allow you to act on behalf of the Company and sign contracts and documents on its behalf;
4) To facilitate the deployment of service providers to support or augment operations of the Company;
5) To communicate with you, through any available means, regarding matters related to your employment and other legitimate matters;
6) To issue Company identification cards;
7) To issue Company assets to qualified employees;
8) To maintain employee records, as required by law;
9) To create, modify, and delete your account in the Company’s IT system;
10) To assess your performance and competencies as an employee;
11) To provide you with training and development opportunities beneficial to you and the Company;
12) To process your payroll, loans, allowances, and other benefits, and make direct deposit of payments to your bank account;
13) To comply with regulatory requirements, such as, but not limited to, the filing and remittance of taxes and payment of mandatory contributions to PhilHealth, HDMF and SSS;
14) To process your enrolment with Health Maintenance Organizations (HMO), insurance providers, and other benefits providers;
15) To facilitate any insurance and benefits claims that may be available to you by virtue of your employment with the Company;
16) To manage and facilitate welfare-related services made available to employees of MNC;
17) To facilitate the conduct of random drug tests in accordance with the law and the policy of the Company;
18) To provide the means for employees to consult with the company-accredited physicians, if necessary;
19) To process extensions of the effective period of employment of affected employees;
20) To process the regularization of employees, if applicable;
21) To comply with internal processes and legal requirements in the administration of disciplinary proceedings;
22) To investigate and resolve work-related incidents within and outside the Company;
23) To provide a safe workplace, and secure the Company premises from threats, theft, robbery, and similar incidents;
24) To manage the assets and documents that may have been released to you in the course of your employment with the Company;
25) To process the disbursement of expenses that may have been incurred by you in the performance of your tasks;
26) To process any certificates of employment, or any other documents that you may request from the Company in relation to your employment therein;
27) To establish a contact point in the event of an emergency involving you, your colleagues, or third parties;
28) To comply with the obligations stipulated in your employment contract;
29) To conduct Company audits or investigate a complaint or security threat;
30) When so required, to process the termination of your employment;
31) When so required, to settle accountabilities upon termination of your employment;
32) To comply with statutory and regulatory requirements, including directives, issuances by, or obligations of the Company to any competent authority, regulator, supervisory body,
enforcement agency, exchange, court, quasi-judicial body or tribunal;
33) To enable the Company to exercise sound corporate governance over its businesses, ensure that risks arising therefrom are duly identified, measured, managed and mitigated, and
enhance risk assessment and prevent fraud;
c. To establish, exercise, or defend legal claims; and
d. To fulfill any other purposes directly related to the above-stated purposes.

MNC will not process the personal information of its employees in ways incompatible with the above-stated purposes.

5. PERSONAL INFORMATION CONTROLLER


The Company is the Personal Information Controller under the DPA, which means that it determines what purposes personal information it holds will be used for. It may also be that your personal
data is disclosed to third parties pursuant to a data sharing agreement, in which case, such third parties are also the personal information controllers of your personal information.
6. TRANSFERS AND DISCLOSURES
Your personal information may be disclosed to the Company’s partners and third parties for the following purposes:

a. To respond to law enforcement authority or other government regulatory bodies’ requests;


b. To prevent physical harm or financial loss;
c. To facilitate the conduct of physical and medical examinations;
d. To process and administer the medical benefits of employees and their declared dependents;
e. To facilitate the health-related consultations of employees;
f. To facilitate the provision of vehicle benefits, if applicable;
g. To facilitate the processing of the payroll;
h. To conduct audits, including operational, risk, compliance, financial, and anti-fraud and corruption audits, and/or investigate a Complaint or security threat;
i. To comply with the Company’s business and management responsibilities and policies, which are necessary for the organizational functioning of the Company;
j. To comply with statutory requirements
k. To establish, exercise, or defend legal claims; and
l. Fulfill any other purposes directly related to the above-stated purposes.

To verify the accuracy of the information you provided, particularly your identity, qualifications, and employment history, the Company (or its authorized representatives and/or service providers) will
conduct background checks, which necessarily include verification with third parties such as educational institutions and previous employers, where applicable. You expressly authorize the Company
(or its authorized representatives and/or service providers) to verify such information and procure copies of relevant records and documents from these third parties.

When the processing of your personal data is outsourced by the Company to a third party, the processing will be subject to written agreements between the Company and the third parties processing
the data. These written agreements specify the rights and obligations of each party and will provide that the third party has adequate security measures in place and will only process your personal
information on the specific written instructions of the Company.

The Company may also transfer your personal information to third parties as required by law or legal instrument, to protect the Company’s rights or assets, to facilitate acquisition or disposition of the
Company’s businesses, and in emergencies where the health or safety of a person is endangered.

The Company will not sell, rent, share, trade, or disclose any of your personal data to any other party without your prior written consent, with the exception of entities within the Company and any
third-party service providers which the Company has engaged, whose services necessarily require the processing of your personal data.

The following are the third parties to whom your personal data may be disclosed:
a. Regulatory bodies/agencies and other legal bodies
b. Health maintenance organizations (HMO), insurance providers
c. Accredited clinics and physicians
d. Leasing and finance corporations
e. Payroll-processing service provider
f. Fund managing entities
g. Third-party service providers and suppliers
h. Stockholders and business partners
i. Potential investors or target companies in the context of an M&A deal

7. DATA RETENTION
Your personal data will be retained or stored for as long as the purposes for which they are being processed have not been satisfied. The Company will retain and use your personal information as
necessary to comply with its legal obligations, resolve disputes, and enforce its agreements:

1. Hardcopies of the forms you have submitted, as well as all records that shall be relevant to your tenure as an employee of the Company may be stored in the Company premises in a secure
cabinet or in an off-site warehouse managed by a third-party service provider.
2. Forms and documents which contain your personal data will be digitized and stored on the Company’s information management system hosted by the Company on-site or in the premises of an
authorized third-party service provider.
3. The Company shall ensure, using contractual and other reasonable means, that the Third-Party Service Provider implements proper safeguards to ensure the confidentiality, integrity and
availability of the personal data processed, prevent its use for unauthorized purposes, and comply with the requirements of the DPA, its Implementing Rules and Regulations, and other
applicable laws for processing of personal data, and other issuances of the NPC.

8. DATA PROTECTION MEASURES


MNC has put in place physical, electronic, and managerial procedures designed to help prevent unauthorized access, to maintain data security, and to use correctly the Information we collect online.
These safeguards vary based on the sensitivity of the Information that we collect and store.

9. ACCESS
MNC encourages its employees to keep their personal information current and updated. Subject access requests may be made by emailing the data protection officer. MNC may take reasonable steps
to confirm the requester’s identity as a data subject before granting access to the personal information and allowing updates thereto.

10. DATA SUBJECT RIGHTS


You have the following rights under the DPA, which you may exercise at your discretion:
a. The right to access personal information
Under the DPA, it is possible for individuals to request access to any of their personal data held by the Company, subject to certain restrictions. A request for disclosure of such information is
called a subject access request. Any such requests should be addressed to the Data Protection Officer.
b. The right to make corrections to personal information
The DPA requires the Company to take reasonable steps to ensure that any personal data it processes is accurate and up-to-date. It is your responsibility to inform us of any changes to the
personal information that you have supplied to us during the course of your engagement.
c. The right to object to the processing of personal information
You have the right to object to the processing of his/her personal information, including processing for direct marketing, automated processing or profiling. You shall also be notified and be
given an opportunity to withhold consent to the processing in case of changes or any amendment to the information supplied or declared to you in this Data Privacy Notice. Please note that
some of the personal data you have provided to us is necessary for us to comply with statutory and regulatory requirements, as well as the Company’s administrative policies and is thus
mandatorily required to be collected and processed. Withholding of your consent to the processing of certain personal data may prevent you from availing of certain benefits.
d. The right to erasure or blocking of personal information
You have the right to suspend, withdraw or order the blocking, removal or destruction of your personal information from our filing system.
e. The right to be informed of the existence of processing of personal information
You have the right to be informed whether personal information pertaining to you shall be, is being, or have been processed, including the existence of automated decision-making and profiling.
f. The right to damages
Upon presentation of a valid decision, the Company recognizes your right to be indemnified for any damages sustained due to inaccurate, incomplete, outdated, false, unlawfully obtained or
unauthorized use of personal information, taking into account any violation of your rights and freedoms as a data subject.
g. The right to lodge a complaint before the NPC.

11. CHANGES TO THIS NOTICE


This Data Privacy Notice may be updated from time to time. The data subject will be notified whenever there are any updates that will significantly affect his/her rights.
