Refugee assignment

1. When I asked the first victim of human trafficking that why she didn’t take protection from
protective homes and rehabilitation center after coming back in Bangladesh which works for the victim
of human trafficking?

Regarding this situation, she answered that she hadn’t any knowledge about protective homes and
rehabilitation center. And, no one suggested her that she should sick treatment from rehabilitation
Centre .

Here under the act there is a provision of establishment of protective homes and rehabilitation Centre
for the victim of human trafficking.

According to section 35 of the act, Government will establish a good number of protective homes and
rehabilitation Centre for facilitating the physical and psychological treatment of the victim of trafficking.
And no organization are willing to establish a protective home shall not run any activities without having
a license or permission from the government. In case of existing Centre’s they shall obtain their license
within six months after commencement of the act.

But in reality, the scenario is different because there is lack of implementation. The victims don’t have
any knowledge about it including the one we asked. Furthermore, I asked our legal expert that whether
the victim gets the proper treatment in the rehabilitation Centre and Is there any authority to monitor
these protective homes and rehabilitation?

Our expert told us that there is no authority to monitor these protective homes and rehabilitation
Centre on the other hand in some cases victim reported abuse within their shelter. Further more there
are thousand of cases where the victim does not send to the rehabilitation Centre for treatment
because govt don’t widely adopt the information of victim for facilitating them.

2. Section 36 states that al the victim of trafficking will send to the rehabilitation Centre after being
rescued If they don’t send to their house then all the related information will send to the govt or
competent authority.

Here victims who are residing in a protective home will give consent to all the concerned matter and get
the medical treatment and legal counseling.

Here the legal expert give us information that victim needs court referral and could not leave without a
family members consent.

Then I create a poll on the social media to know what individual think about this statement. And the
result is bit shocking that 67% people think that this statement is quite conflicting that why they don’t
leave protective homes without any family member. Other side 33% said there is no problem in this.
3. Section 37 talks about the protection of victim or affected persons and witness in criminal trial.
According to this any person or agency dealing with this matter will ensure that no victim should be
punish or convicted under this act or any other existing laws.

Also said that no one will reveal their identity and if anyone does this then he will be penalized with 6
months imprisonment or 1 lac tk fine or with both. Then if any victim or witness of trafficking fell any
threat or risk to life then they are entitled to get police protection or any other protective measures
provided by the govt.

Here after analyzing the section through social media poll 97% people think that victim don’t get this
protection from the authority.

Then I asked our expert about it he said that there is risk if the law enforcing agency did not pay
attention to this matter then they might get confused between the traffickers and the victim.
Sometimes victim can be penalized for prostitution or other illegal activities which they were compelled
to did.

4. As per section 38 of the act any person dealing with any child victim or witness shall apply the
principle of welfare and the best interest of the child and the principle of of priority under any other law
and shall take necessary measure to avoid the child victims to be convicted. Further more no child victim
shall be sent or detained in any development Centre or in a remand room.

I asked the legal expert that does the child victim really not send to remand room?

He said that most cases they don’t send to remand room but the authority keep the child victim alone
with the adult victims.

5. Section 39 says that the victim can file a civil suit for his/her actual suffering and loss.

I asked the victim of our interview that did they file any civil suit?

She replied that she did not even file a criminal suit let alone a civil suit. Because the traffickers are very
powerful in their area so she was afraid to file any suit.

Our legal expert also said that most of the cases people don’t file any civil suit for this because civil suits
are cost effective and takes long time to dissolve.
