AMENDED P E T I T I O N

COMES NOW petitioner, through counsel, unto the Honorable


Court, most respectfully avers:

1.That the Petitioner ________________________ is of legal


age, Filipino, single, a resident of
________________________________, Bislig City, Surigao del Sur
where she can be served with summons and other processes of this
Honorable Court.

2. That ____________________, is the father of Ezekiel


____________________________, and his address is unknown to the
Petitioner as of this time as _________________ has not been
communicating with petitioner and had abandoned the child

________________________ for almost seven (7) years; to the best


memory of the petitioner, the last known address of
_______________________ was in Mangagoy, Bislig City, Surigao del
sur; Hence Petitioner is asking for an order of the Honorable Court
for subpoena by Publication;

3. Respondent Local Civil Registrar (LCR-Bislig) of Bislig is


a public office tasked with the preparation, recording and
safekeeping of the civil registry records of all residents in the City of
Bislig, including that of the Certificate of Live Birth of the petitioner.
The Local Civil Registrar can be served with the summons and
processes of this court at the City Hall Building, Poblacion, Bislig
City, Surigao del Sur, Philippines. And the Philippine Statistics
Authority (PSA) is also a public office also can be served with the
summons and processes of this Court at the 3 rd Floor, Vibal Building,
Times Street cor. EDSA West Triangle, Quezon City, these Offices are
being impleaded as required by law where it may be served with
notices and other processes in said address.

4. Petitioner’s son, __________________________ was born


on April 24, 2011 at Bislig City to _________________________; and
said birth was registered at the Local Civil Registrar of Bislig City,
Surigao del Sur, the copy of the Certificate of Live Birth of the
Petitioner’s son is hereto attached as ANNEX “A”.

5. That said certificate of live birth of the Petitioner’s son


contained an entry particularly the entry as to the entry of child’s
name; this entry is contained in item no. 1 of the certificate of live
birth that bears the name _______________________________.

6. Petitioner posits that she as the biological mother


_____________________ and _______________________ were never
married to each other at the time her son was born and at the time
Ezekiel’s birth was registered at the Office of the Civil Registrar of
Bislig. There was no subsequent marriage of
_______________________ and __________________ from the time of
the registration of the birth Charles Ezekiel;

7. Petitioner was never married at the time her son,


________________________ was born, and she remains to be a single
person up to the present; to prove this allegation of the Petitioner,

hereto attached is the CERTIFICATE OF NO MARRIAGE


(CENOMAR) issued by the Philippine Statistics Authority as
ANNEX “B”; said certification is based on the records of years 1945
up to year 2014 as enrolled and recorded in the database of the
Philippine Statistics Authority.

8. To support further this petition, petitioner hereto submits


her own certificate of live birth as ANNEX “C”.

9. That the petitioner in all her affairs has been representing


herself to be a single person;

10. That the law provides that a child born out of wedlock is
illegitimate. An illegitimate child shall use the surname of his/her
mother.

11. That the petitioner is of the desire to cause for the


deletion or cancellation of the birth certificate of her son
_______________________ and to allow her register a new birth
certificate with the corrected entry; invoking the provision of the law
regarding the use of the correct surname of the child born out of
wedlock, which is the case of ____________________;

12. Petitioner wishes to correct and straighten her son’s birth


records and for other legal purposes that will serve her child best;

PRAYER

WHEREFORE, petitioner most respectfully prays that after due


notice and hearing, her petition for the deletion or cancellation of the
Certificate of Live Birth of __________________________ at the Office
of the Civil Registrar of Bislig City, Surigao del sur under REGISTRY
NO. ________________ be granted;

And direct the Local Civil Registrar of Bislig City, Surigao del
Sur and Philippine Statistics Authority to cause for the new
registration of the birth of her child Ezekiel entering thereon the
correct entry in the said new birth certificate.

Petitioner also prays for other remedies which the Honorable


Court may deem just and equitable under the premises.
