PETITION

PETITIONER, through the undersigned counsel, unto this Honorable


Court most respectfully avers, that:

1. Petitioner ___________________ is of legal age,


single/married/widow, Filipino and resident of _________________;

2. The Respondent Register of Deeds of ________________, is hereby


impleaded as nominal party being the Officer charged as the official
custodian of all documents and records registered in its Office with

in which addresses, the herein party maybe served with the orders and
processes of this Honorable Court;

3. Petitioner is one of the lawful heirs of the ____________________,


both deceased and the registered owners of a parcel of land situated in
the ________________________ containing an area of

embraced in and covered by __________________ issued by the
Registry of Deeds of ____________________. Copy of the certified
true electronic copy of the title is hereto attached as Annex “A.”
Copy of the Death Certificate of ________________ is hereto

1”. Said documents are made integral part of this petition. Copy of the

5. Petitioner acted as the safe-keeper of her family’s important


documents including the Owner’s Duplicate Copy of _________ since
the demised of her parents, which were kept in her residence in

8. In order to protect her interests, Petitioner caused the execution of an


Affidavit of Loss and its annotation at the dorsal portion of the
original copy of the title at the Registry of Deeds of
_________________. Copy of the Affidavit of Loss is hereto attached
as Annex “D” ;

9. The said Certificate of Title was in full force and effect at the time of
it was lost; no deed or other instrument affecting the property have
been presented for registration and that the same was not subject of
litigation or investigation, administrative or judicial, regarding its
genuineness, due execution or issuance;

10. The said certificate of title above stated property was neither sold nor
encumbered to any person or any banking or financial institution;

11.The same property was never attached by any banking or financial


institution nor by the government for nonpayment of taxes due
therein. Copy of the Tax Declaration and latest tax receipt are hereto
attached as Annexes “E” and “F” respectively;

12.Upon the loss of the duplicate owner’s copy of the title, issuance of
the 2nd owners copy is respectfully sought by the herein petitioner
before this Honorable Court.

PRAYER

WHEREFORE, it is respectfully prayed after hearing that judgment

be rendered as follows:

1. Declaring the Owner’s Duplicate Copy of ____________ as lost;

2. Ordering respondent Register of Deeds of _____________ to


issue a second owner’s duplicate copy of ___________ in favor
of the herein petitioner.
