Memorandum of Deposit of Title Deeds

This Memorandum of Deposit of title deeds executed at this 8 th day of August 2022 by
Mr.N.Vignesh (PAN:BCVPV2742N), Son of Mr.K.Nachimuthu, residing at No 10, 4th
Street, Sriram Nagar South, West Tambaram, Chennai 600045, hereinafter called the
“Mortgagor” which term shall wherever the context mean and include his/her heirs,
executors, administrators, legal representatives and assigns of the one part in favour of
City Union Bank Limited, a Banking Company incorporated under the provisions of the
Indian Companies Act having its Registered Office at 149, TSR Big street, Kumbakonam-
612001 and a Branch office at Mannivakkam, hereinafter called the “Mortgagee” of the
other part;

Whereas the Mortgagor has been approached by Mr.K.Nachimuthu, Son of


Mr.Karuppusamy (PAN- ACTPN1281F), residing at No 10, 4th Street, Sriram Nagar
South, West Tambaram, Chennai 600045 (hereinafter called the “ the Borrower “) with
a request to offer some of the immovable properties belonging to the Mortgagor as
security for the credit facility (ies) sanctioned/ to be sanctioned by the mortgagee to the
borrower and the details of such Credit facility (ies ) are mentioned in Annexure A to
this memorandum. At the request of the Borrower (s), the mortgagor has agreed to
offer his/her immovable property(ies) more particularly described in Schedule A to this
agreement as security for credit facility (ies) sanctioned / to be sanctioned by the
mortgagee to the extent of Rs 80,00,000/- (Rupees Eighty Lakhs only) together with
interest, costs, other expenses, etc. And whereas the mortgagee is willing to extend the
credit facility(ies) if the borrower (s) would execute a promissory note for the said
amount and also the mortgagor deposits the title deeds of his/her immovable property
(ies) as collateral security for the due repayment of principal and interest, costs, etc.
thereby creating an equitable mortgage over the same.

Now this memorandum of Deposit of title deeds witnesseth that in consideration of the
sum of Rs 80,00,000/- ( Rupees Eighty Lakhs only) sanctioned / to be sanctioned by the
mortgagee to the Borrower (s), the mortgagor on 30/06/2022 deposited with the
mortgagee at their branch office at Tambaram the title deeds listed in Schedule B in
respect of the property (ies) more fully described in A to this memorandum with an
intent to create a security by way of Equitable mortgage by deposit of title deeds within
the meaning of Section 58(f) of the Transfer of Property Act 1882.
