I John Brown, of 20 Hope Road, Kingston 6, in the parish of Saint Andrew, Medical
Doctor, being duly sworn make oath and say as follows that:
I. I am the registered proprietor of ALL TI-LAT parcel of land part of EBONY
GLADE in the Parish of Saint Andrew being the Lot numbered FIFTEEN on the
plan of Ebony Glade aforesaid deposited in the Office oCfitles on the 611' day of
October, 1959 of the shape and dimensions and butting as appears by the plan
thereof hereunto annexed and being pc.rt of the land comprised in Certificate of
Title registered at Volume 372 Folio 98 which said parcel ofland was transferred
by transfer numbered 191436 produced for registration on the 201h day of
Januaty 1964 and being all the laud comprised in Ce1iificate of Title registered
at Volume 1000 Folio 765 (hereinafter called "the said land").

2. Attached hereto marked "A" for identification is a photocopy of the duplicate


Cet1ificate of Title in respect of the said land.

3. I bought the said land from Ruby Davis. ln consideration of the sum of $12,
000,000.00, by instrument number 129M78 registered in the Office ol"Titles on
the 6th day of May 2012, Ruby DaYis transferred the said land to me subject to
several restrictive ovenants, inc]uding the fo!lowlng:

"4. The building to be erected on the said land shall not be nearer thau
thirty feet to any road boundary which the same may face nor less than ten
feet from any other boundary. Any outbuilding to be erected on the said
land shall not be nearer than the main building itself. '

4. The said land is patt of the Ebony Glade subdivision and the approved
subdivision plan was formally recorded in the Office of Titles on the 6 th day of
October 1959. To the best of our knowledge. information aud belief the said
restrictions were imposed as a condition or the approved subdivision for the
orderly development of the community. [or the restriction was endorsed on
the said land by miscc.Hanem.rn instnm1t:nt number 876356 registered on the
16 day of May 1986.

5. To tbe best of my knowledge, information and believe no specific


consideration was expressed for the imposition of.the said restriction except
for mutuality of the covenants.

6. I exhibit hereto marked ''B'' for identification a photocopy of the approved


subdivision plan containing the- tenns and conditions of approval.
7. A surveyor's identification report dated the 6 th day of February 2022 prepared
by Donovan Simpson and Associates Limited, Commissioned Land Surveyors,
revealed that restrictive covenant numbered "4" has been breached.

8. I exhibit hereto marked "C" for identification a photocopy of the surveyor's


identification report.

9. Therefore, I request that the said restriction be modified to read as follows:

"4. The building to be erected on the said land shall not be nearer than
twenty feet to any road boundary which the same may face nor less than
two feet from any other boundary. Any outbuilding to be erected on the
said.land shall not be nearer than the main building itself."

I 0.1 will suffer considerable hardship and incur substantial expenses to asce11ain the
names and addresses of each of the proprietor of the Lots of land shown on the
plan of part of Ebony Glade, in the parish of Saint Andrew.

11. The names and addresses of the registered proprietors of lands who appear to be
entitled to the benefit of the said restrictions all of whom are adjoining land
owners are as follows:

a. Hugh James et al of 16 I Windward Road, Kingston 2, in the parish


of Saint Andrew, are the registered proprietors of all that parcel of
land known as Lot 15 registered at Volume 982 Folio 279.

b. Key Homes Limited of 27 D1tl,e Street. Kingston, in the parish of


Kingston, is the registered proprietor of all that parcel of land
registered at Volume 615 Folio 31.

c. Key Homes Ltd of 27 Duke Street, in the parish of Kingston is the


registered proprietor of all that parcel of land registered at Volume
1052 Folio 209.

d. Beverly Ann Malcom of 25 Castle Heights Close. Kingston 8. in the


parish of Saint Andrew, is the registered proprietor of all that parcel
land registered at Volume I 075 Folio 201.
e. Collin Reid of Apartment 4. 4 Brom ton Road, Kingston 5, in the parish
of Saint Andrev"'·, is the registered proprietor of all that parcel of land
known as Lot 21 regisrered at Volume 1288 Folio 245.

f Winsome Mowatt of 61 .Peart Avenue, Kingston 17, in the parish of


Saint Andrew is the registered proprietor of all that parcel of land
registered at Volume 1288 244.

g. Cascades Ventures and Equities Limited of 2A Kensington Crescent_,


Kingston 5, in the parish of Saint Andrew is the registered proprietor
of all that parcel oflai,d registered at Volume 1014 Folio 305.

12. The local authority affected by this 2.pplication is the Kingston and Saint Andrew
Municipal Corporation.

13. My interest in the said land is that of registered proprietor.

14. Tbe grounds on which this application is r:.1ade are as follows:

a. By reason of changes in the character ofthe property or neighbourhood
