At the workplace, often demands for sexual favours (especially when it is by a senior) are
coupled with promises of some kind of preferential ueatment, or implicit presumption

that the work envitonment may tutn unpleasant in case the demand is not adhered to.
As pet the Act, any ptomises of prefereryial or detrimental treatment, thteats related to a
l( woman's employment status ot interfefence with her work, creation an intimidating,
offensive ot hostile wotk envitonmeflt, or humiliating treatment which affects her health
and safety are indicators that afiy unwelcome behaviour, contact, advances or
communication has caused sexual harassment to the.woman.
Conduct that is not of a sexual nature will not be covered within the definition of sexual
harassment. Therefore, a v/oman will not be protected undet the Act in situations of threat
of violence, offensive language or slang which is not sexual, and which is not accompanied
by othet acts that constitute sexual harassment.

offence against such abusive language and files a complaint for sexual harassment?

Answer 3
No, the claim is not sustainable as the abuse by Mr. Raj was of a non-sexual manner. While
Mr. Raj conduct may be professionally unacceptable, only conduct which has sexual
overtones can be btought under the purview of the Sexual Harassment Act.

Pnya is a new hire in a company. Thete's lot of wotk in the otganisation and her supedor
often requires her to stay in office and work late night to complete the tasks at hand. She
finds this too stressful and disturbing and wants to make a complaint for sexual harassment.
Does such a claim qualift as Sexual Harassment?
Answer 4
No, the claim is not sustainable as the threat was flot of a sexual nature, but purely based
on a business need, that is, achieving assigned business targets.
