Compromise Agreement

This document is a compromise agreement between Rachelyn Gomez and Cristina Delos Reyes (the complainants) and Chester Tan and John Tan (the respondents). The respondents are detained for allegedly raping Gomez. COMPROMISE AGREEMENT

      This Agreement executed this ____ day of November, 2022 at General


Santos City, by and between:

      RACHELYN D. GOMEZ and CRISTINA AMALIA Q. DELOS REYES,


both Filipinos, of legal age with address at Zone 6, Block 11, Fatima, Uhaw,
General Santos City, Philippines, (hereinafter referred to as “the
complainants”).

-and-

      CHESTER S. TAN and JOHN NECOLE TAN, both Filipinos, of legal age
with address at Zone 2-B, Saway, Labangal, General Santos City,
Philippines, (hereinafter referred to as “the respondents”).

WITNESSETH:  That -

      WHEREAS, the complainant RACHELYN D. GOMEZ is intending to


file a criminal action for RAPE against CHESTER S. TAN and JOHN NECOLE
TAN;

WHEREAS, the respondents CHESTER S. TAN and JOHN NECOLE


TAN are detained in the Police Station 2 at Makar, General Santos City for
the alleged crime of rape;

WHEREAS, the respondents offered to amicably settle the case of


which the complainants are amenable;

       WHEREAS, the parties desire to buy peace and wish to avoid a


protracted litigation in this case.

     NOW THEREFORE, in consideration of the foregoing and the further


covenants hereinafter set forth, the parties agree as follows:

1. Complainants shall be paid the sum of ONE HUNDRED


THOUSAND PESOS (P100,000.00), Philippine Currency, payable in cash.
The respondents shall pay SEVENTY THOUSAND PESOS (P70,000.00)
upon execution of this agreement. The remaining amount of THIRTY
THOUSAND PESOS (P30,000.00) shall paid the next day. Failure on the
part of respondents to pay the remaining balance shall not render this
agreement valid and the right to file criminal action is not waived.

2. The sum shall be paid directly and personally to the


complainants as a condition precedent for the execution of AFFIDAVIT OF
DESISTANCE.

3. Should, by reason of alleged rape, complainant RACHELYN D.


GOMEZ be impregnated, respondents will give financial support from
conception until birth of the child. Should respondent fail to comply with this
particular term, the complainant may have the right to proceed in the filing
of criminal action. However, if the complainant will not get pregnant, this
provision is deemed as not written.

4. That by paying the sum of ONE HUNDRED THOUSAND PESOS
(P100,000.00) to complainants, it is understood that the case against the
respondents is settled. And that complainant RACHELYN D. GOMEZ will no
longer file a criminal action for rape against respondents. Furthermore,
complainant will execute an AFFIDAVIT OF DESISTANCE.

5. The parties or their assigns hereby waive, renounce and forever


quitclaim all their respective claims and counterclaims subject of the instant
action as well as those that may arise therefrom, in connection therewith or
in relation thereto.

6. The foregoing covenants are not contrary to law, morals, or


public policy and the parties bind themselves to comply strictly with their
undertakings.

IN WITNESS WHEREOF, parties herein affixed their signatures on


the date and place above written.
