I, ________________, of legal age, Filipino, single and a resident of

been duly sworn to in accordance with law, depose and state:

1. That on __________, I have entered into a Deed of Contract to Sell


as BUYER of a parcel of land owned by _____________, Filipino,

____________________, herein referred as the SELLER.

2. That in the said Deed of Contract to Sell, the SELLER agreed to sell
her property covered by Transfer Certificate of Title No. ______,
more particularly described as follows:

3. That the Deed of Contract to Sell was acknowledged on ______


before Notary Public ___________ of ____ City and entered in his
Notarial Register as Doc. No. 2, Page 2, Book II, Series of 2022. A
copy of the said Deed is hereto attached as ANNEX “A” and made
an integral part of this Affidavit;

4. [Depending on the condition]. That because I still have a


balance on the purchase price in the amount of ________________
which is payable within _________ from the date of signing of the
Deed of Contract of Sale, it was stipulated that the title and
ownership over the subject property will only be transferred upon
full payment of the same;

5. [If also stipulated in the Deed] That the SELLER in the said
Deed of Contract of Sale agreed that upon its execution, said Deed
shall be annotated in the Title with the Office of the Register of
Deeds of ____ City;

6. That on ___________, it has come to my knowledge that that the


SELLER died. At the risk that someone might claim the property in
disregard of the existing and valid Deed of Contract to Sell, I am
therefore executing this Affidavit for the purpose of attesting to the
truthfulness of the foregoing allegations and in support of my
request for the annotation of an adverse claim over the parcel of
land covered by the Transfer Certificate of Title No. _____.
