COMPLAINT-AFFIDAVIT

I, ROMAN SANTOS GO, of legal age, Filipino citizen and a


resident of# 664 Mary Grace Village Sto. Nino, Plaridel, Bulacan,
after having sworn in accordance with law hereby, respectfully states
that:

I Hereby Formally Charge:

JERWIN AMOS BASBAS, of legal age, Filipino Citizen and a


resident of # 5 1ST Dominic Drive, Baesa, Quezon City for violation of
Article 365 of the Revised Penal Code on CRIMINAL
NEGLIGENCE, or any other offense which the Honorable Public
Prosecutor may deem proper to file, committed as follows, and further
states:

MATERIAL ALLEGATIONS

1. That on November 18, 2022,I went to Cavite using my
HONDA CBR1000RR BIG BIKE WITH PLATE
NUMBER

TT3354 and Chassis number AF351754467 registered to


South-wing Heavy Equipment Inc., from my residence in
Bulacan to have my Motorbike tuned-up by my long time
Mechanic in Cavite which I frequented, along with my
companions, my son ROMNEY CHRISTIAN E. GO and his
friend JOHN LOREN C. SALAYAwho also drove their own
Motorcycle Bikes, attached herein are the Affidavits Executed
by the foregoing marked as “ANNEX A” and ANNEX A-1”
respectively;

2. That at around 8:19 in the evening on our way to eat dinner at
Tagaytay while traversingfrom east to west direction along
TagaytayCalamba Road in Barangay San Jose, Tagaytay
Cityin front of City land Bldg, while taking the inner/fast lane
towards TagaytayRotonda, I was travelling at around forty (40)
kilometers per hour (KPH);

3. That a MONTERO SPORTS WITH PLATE NUMBER


NGM9840 with engine number 4N15UGJ7456 and Chassis
Number MMBGUKR10LH007599, registered to a ROSA E.
BASBAS of 12 Jasmin St. Perpetual Village
BagongTanyagTaguig, NCR, traversing
theTagaytayCalamba Road in Barangay San Jose, Tagaytay
City from west to east direction Driven by JERWIN AMOS
BASBAS, RECKLESSLY AND NEGLIGENTLY
SUDDENLY TURNED LEFT, occupied and blocked the
lane I was traversing which resulted in a Vehicle Collision
between my Motorcycle Bike and The Montero Sports;

4. That after the collision, on-looker pedestrians immediately gave


me assistance and called an ambulance who immediately
responded to the scene of the Vehicular collision and brought

me to the nearest Hospital which is the Tagaytay Medical
Center, Inc.;

5. Police Authorities of the Cavite Police Provincial Office,


Tagaytay Component City Police Station also responded to
the incident. For this purpose, a Police Report prepared by
PSSgCarlito G. Jimeno Investigator on the Case, was issued
by the said Police station. A copy thereof is hereby attached
and Marked as “ANNEX B”.

6. That the Dash Board Camera of the Montero Sports driven by


the respondent captured the incident, for this purpose a
Compact Disc containing avideo capturing the incidentis hereby
attached and Marked as “ANNEX B-1”;

7. That as a result of the Negligent and Reckless Driving with


inexcusable lack of Precaution of JERWIN AMOS
BASBAS, I incurred Multiple bodily injuries. As proof
attached herein are the copy of the following 1.)Medico Legal
Certification marked as “ANNEX C”, 2.)Medical Certificate
issued by Tagaytay Medical Center Inc., Marked as “ANNEX
C-1”, 3.)Clinical Abstract issued by Tagaytay Medical Center
Inc., Marked as “ANNEX C-2”, 4.) Record of Operation
Issued by Tagaytay Medical Center Marked as “ANNEX C-3”;

8. Also Attached are the Photos of the Injuries that I incurred


during the Collision which is hereby Marked as “ANNEX D”
and “ANNEX D-1” respectively;

9. That because of the Multiple Bodily Injuries, I also incurred


enormous medical expenses as proven by the following, to wit:
1.)Photocopy of Official Receipt No. 0909756 Marked as
“ANNEX E”, 2.)Official Receipt No. 12789 Marked as
“ANNEX E-1”,3.)Official Receipt No. 0909757 Marked as

“ANNEX E-2”4.)Official Receipt No. 090925 Marked as
“ANNEX E-3” 5.) Official Receipt No. 0909512 Marked as
“ANNEX E-4”;

10.That I also incurred damage to my Motorcycle Bike during the


collision, with an estimated Value of Two hundred fifty
Thousand pesos (PHP 250,000);

11.That after the Unfortunate Incident My son ROMNEY


CHRISTIAN E. GO and JERSON AMOS BASBAS executed a
document entitled “MALAYANG SALAYSAY NG
KASUNDUAN” herein attached as “ANNEX F” where the
Respondent plead forgiveness and promised to shoulder all the
Medical expenses of the Complainant including the Hospital
Bills and all Medications. The Respondent further promised to
Shoulder the expenses in the repair of the Motor Bike of the
Complainant;

12.After several demands, the respondent reneged on his


promise and commitment to answer for the medical expenses
and repair of the damaged motorcycle. A copy of the Demand
Letter sent to the Respondent is hereby attached and Marked as
“ANNEX G”, also a copy of its transmittal via Private
Courier (LBC) is hereby attached and marked as “ANNEX G-
1”;

13.That I am executing this complaint affidavit freely and


voluntarily for the purpose of attesting to the truth of the
foregoing statements, to inform the proper authorities of the
above facts, to support my complaint against Respondent
JERWIN AMOS BASBAS and for whatever purpose this may
serve best.

14.That the incident has caused me not only


physical injuries but also

mental anguish, anxiety, sleepless nights
and traumatic episodes;
