I, Mike Enriquez, Filipino, 46 years old, male, married and a resident of Purok Lubi,Minglanilla,
Cebu after having been sworn to an oath in accordance with law hereby depose and state
THAT:

PRELIMINARY STATEMENT

The person who expounds the questions on this Affidavit in a Question and Answer form is
Police Corporal Ronald Co who is a permanent member of the Philippine National Police and presently
assigned with Minglanilla Police Station, Minglanilla, Cebu and designated as Investigator of this Police
Station and this statement was likewise taken at the Investigation room of Minglanilla Police Station.

I have answered all the under oath and to tell the truth and nothing but the whole truth and I knew that I
may face criminal liability for false testimony or perjury.

QUESTION AND ANSWER

Q1. – Will you please state your name and other personal circumstances?

A1 – I am Mike Enriquez, Filipino, 46 years old, owner of JT Humayan Food Park,Minglanlla,


married and a resident of Purok Lubi, Minglanilla, Cebu.

Q2. – Please tell this investigator, why are you here in my office?

A2 – I am here to have my statements taken to support in filing a complaint against the

suspect JASPER CRUZ, Filipino, of legal age, male, single, and residing at Purok Tambis, Brgy. Tungkil,
Minglanilla, Cebu for the crime Theft that happened on February 19, 2023 inside JT Humayan Food Park
located at Minglanilla Food Park.
Q3. – Do you know personally the respondent of this case?

A3 – No sir. It's my first time to see him.

Q4. – Can you narrate to me the incident that happened at the mentioned time and date?

A4 – Yes sir. On 11:30 in the evening of February 19, 2023 I called the Minglanilla Police
Station because I’ve heard that there is someone entering backdoor secure where my bag and other things.

Q5. - What did you do upon seeing the bags and other things?

A5 - I immediately notice that my bag is open and my other things like my cellphone
already gone.

Q6. - What else happened?

A6 – Then I informed sir Mond and sir Cris that the theft left immediately to the backdoors
after he heard me coming

Q7. - What transpired next?

A7 - After discovering that some of my things were missing, I then informed my


staff to check the backdoors and ask them to also check the CCTV footage of that room where I put and
secure my things.

Q8. - After knowing that somebody stole your things, what else did you do?

A8 - I informed my staff and where I conducted inventory of the lost things, wherein after
conducting inventory the following things were lost and believed to be taken by the suspect: Bag, wallet,
cash of 15,000 pesos, and a watch.

Q9. - Showing to you a photographs, what is the relation of this photograph to the one you mentioned
earlier?

A9 - It is the same thing that being confiscated from the position of the accused during he
is arrested by the arresting officer.

Q10. - Showing to you the photograph of the suspects as well as the items stolen will you able to
identify this?

A10 - Yes sir. This is the suspect that took/stole and carted away my things without our
knowledge and these are the things that he stole from my premises.

Q11. - This investigator has no more questions to ask do you have anything to say or add to your
Statement or to retract from your statement?

A11 - None for the moment sir;

Q12. - Are you willng to sign your statement consisting of three(3) pages to include this page and to
affirm to an oath the truthfulness of the foregoing?

A12 - Yes sir,I will sign;

III. FACTS OF THE CASE:

7. On or about 11:30 in the evening of February 19, 2023 the owner of the food park Mr. Mike
Enriquez reported and seek for police assistance as he seen that there is someone who stole his
bag and other items inside his office.

8. In the investigation conducted by the duty police investigator in the alleged theft disclosed that
after verification and ocular inspection to the alleged stole things revealed that the suspected
person incurred the damage at the backdoors as he enter the office of Mr. Enriquez. He really
knew on how he could enter that certain office.

9. Follow-up investigation, as seen in the CCTV footage and it was confirmed that it was Mr. Jasper
Cruz who allegedly stole and incurred the damages of the premises of Mr. Enriquez. It was then
happened when the suspect noticed that the food park was already dark because it was really
closing time. He then immediately went straight to the backdoor of Mr.Enriquez’s office without
him knowing that Mr. Enriquez is still in that certain area of the food park.

10. In the statement of one of Mr.Enriquez staff as he seen the CCTV footage he noticed that the
suspected person is quite familiar to him as he stated he seen Jasper who observe the
surroundings and then Jasper went to the restroom but the staff don’t mind him because he think
it’s their regular customer.

IV. DISCUSSION:

11. Gleaned from the record or evidence presented, it could be established that the JT Humayan Food
Park, is a 60 meters away from the guards post. Because there was no guard assigned to the back
area, the guard was unable to check or inspect the Food Park. The guards on duty were unable to
inspect the food park because the custodian neglected to properly secure and lock the back
entrance and forgot to notify them of his departure.

V. CONCLUSION:

12. WHEREFORE, in view of the foregoing facts and circumstances, the undersigned investigator is
of the opinion that the aforesaid custodian is liable for the loss of the bag and other important
things of the Mr. Enriquez because the key of the backdoor entrance which was issued to or held
in trust by the owner. It is believed that the undersigned investigator advises be placing the a
security guard with other skilled PSAI Security personnel to prevent this kind of situation.

III. RECOMMENDATION:

13. Therefore, there should be an additional one (1) guard be posted at the back of the food park
during night time to cover the back portion of the Food Park.

JOINT AFFIDAVIT OF ARRESTING OFFICER

We, Police Corporal Steven Mendez and Police Patrolman Carlo Quinto, Filipino National
of legal ages and an active member of the Philippine National Police presently assigned at Municipality
of Minglanilla, Police Station after having been sworn to an oath in accordance with do hereby depose
and state.
THAT:

PRELIMINARY STATEMENT

The person who expounds the questions on this Joint Affidavit in a Question and Answer Form
is Police Corporal Ryle Vincent Lacson who is a permanent member of the Philippine National Police
and presently assigned at Minglanilla Police Station, Minglanilla,Cebu and designated as Investigator,
and this statement was likewise taken at the Investigation room of Minglanilla Police Station.

I have answer all the under oath and tell to the truth and nothing but the whole truth and I knew
that I may face criminal liability for false testimony or perjury.

QUESTION AND ANSWER

Q1. - Will you please state to this investigation your names and other personal circumstances?

A1. - We Police Corporal Steven Mendez and Police Patrolman Carlo Quinto, Filipino
National of legal ages and an active member of the Philippine National Police presently assigned at
Minglanilla Police Station, Minglanilla, Cebu and member of alert team.

Q2. - Officer where were you before 10:15 in the evening of October 16, 2022?

A2. We were rendering our tour of duty as Alert Team wherein we provide police presence
at Poblacion Ward 2, Minglanilla, Cebu
Q3. - While you were performing you duty, was there any incident that transpired? Will you narrate the
circumstances of the incident?

A3. Yes sir. While we were performing our official duty we were informed by our duty desk
officer PSSg. Claud Martinez that there is a telephone call from a concerned citizen that there is an
individual entering the premises of Nexus computer shop.

Q4. - What transpired next?

A4. - We quickly went to the area after obtaining the aforementioned information as we
perform our tour of duty in the area in question. There, we observed a single male picking up coins and
other things and place them in a back pack.

Q5. - What transpired next?

A5. - Then, as we were approaching the said male person in full police uniform, he fled and
took with him one (1) brown bag that contained what we believed to be stolen moneys and computer
accessories. There was a brief motor chase that ended with the said suspect being cornered and arrested.
We then place him under arrest after informing him of his constitutional rights in a language he can
understand.

Q6. - What did you do next?

A6. - Afterwards we bring the suspect to the Minglanilla Police Station for further investigation.

Q7. - Did you arrived at the Minglanilla Police Station, what did you do, if any?

A7. - Yes Sir. Upon arrival at the Police Station I (PCpl Lacson) immediately informed the
duty Desk Officer to record the incident into the Police Blotter, and I (Pat Quinto) ask the arrested person
for his personal identification for record, mug shot purposes and he revealed his personal identification as
JAY ALCAZAR, 22 years old, lived-in and resident of Sitio Premier, Poblacion Ward 2, Minglanilla,
Cebu.

Q8. -What transpired next?

A8. - On behalf of Stephene Tan, the department's supervisor, I (PCp| Lacson) get in
touch with the manager of Nexus computer shop to let him know that someone broke into their
shop and took money and some accessories putting them inside.

Q9. - Showing to you a photograph, what is the relation of this photograph to the one you mentioned
earlier?
A9. - The identical things were taken from the accused's position at the moment of his arrest.

Q10. - Showing to you a photograph of the suspects will you able to identify these?

A10. - Yes, because this is the same person that we apprehend on 10:15 in the evening of
October 16, 2022.

Q11. - This investigator has no more questions to ask, do you have anything to say or add to your
statement or to retract from your statement?

A11. - None for the moment sir.

FACTS: Upon calling this station, a worried citizen asked for police aid regarding at the Minglanilla
Police Office, there was a THEFT occurrence, and police were called. They were able to apprehend the
culprit after he was caught in the act of stealing the listed items. Investigation revealed that the suspect
fled and avoided capture while carrying the stolen goods after noticing the presence of the police officers
and while stealing the aforementioned items. After a brief chase, the culprit was cornered, which led to
his arrest. Suspect was taken to this station for proper handling after having his rights under the law and
the nature of his offense correctly explained to him in a language he is familiar with.
