The humble application of the above named applicants

most respectfully showeth as under.

1. That by means of this criminal misc. application under

section 482 of Cr.P.C. the applicant is challenging the

impugned charge sheet no. 01 of 2014, dated 20-09-

2015, submitted by Investigating Officer/ Patwari,

Kshetra Bangidhar, Tehsil Salt, District Almora and

summoning order dated 01-12-2015, issued by the

learned court of Judicial Magistrate Bhikiyasain, District

Almora, in criminal case no. 124 of 2015, for the offences

punishable Under Section 392, 354, 506 of I.P.C.

Patwari Kshetra Bangidhar, Tehsil Salt, District Almora.

2. That this is the first criminal misc. application on behalf

of the applicant before this Hon’ble Court against the

summoning order dated 23.01.2023 and in the above

noted particulars and except this no application is either

pending or has been disposed of on the same set of facts.

3. That the applicant before this Hon’ble Court is a civilized

and as well as law abiding citizens of the country, he is a

businessman and runs his business of supply of food

stuff from haldwani.

4. That it is pertinent to mention here that the applicant

used to supply food stuff in one the school namely

Kasturba Gandhi Awasiya Balaki Vidhayalaya Jainti –

Lamgara, District – Almora. On 10.09.2022 the opposite

party no. 2 who is a 4th class employee of the aforesaid

school, i.e, Kasturba Gandhi Awasiya Balaki Vidhayalaya

Jainti – Lamgara, District – Almora, lodged an FIR

against the applicant before police station Lamgara,

District-Almora for the offences punishable under section

504, 506 of IPC and under section 3(1)(l) & 3(1)(m) of The

Scheduled Caste And Scheduled Tribes (Prevention of

Atrocities Act 1989), stating therein that, she is a 4 th

class employee of the school, i.e, Kasturba Gandhi

Awasiya Balaki Vidhayalaya Jainti – Lamgara, District –

Almora and on 16.07.2022 at about 15:34 hours the

applicant thretened her abused her by the castiest

remark. It is alleged in the FIR that this person also

threatened her at earlier occations. For kind perusal of

this Hon’ble Court a true certified copy of FIR Dated

10.09.2022 is being filed herewith and marked as

Annexure No. 1 to this application.

5. It is pertinent to mention here, the instant procecution

against the applicant is total false and concocted, the

applicant has not commited any offence as alleged by the

procecution. He has falsely being implicated in this case

on the insistence of the school management of Kasturba

 Gandhi Awasiya Balaki Vidhayalaya Jainti – Lamgara,

District – Almora because the applicant was continuously

complaining against the management in respect of

irregularities being commited by the management and

thus the procecution of the applicant is malicious one

and being challenged before this Hon’ble Court in this

ground alone. The applicant much prior to lodging of the

instant procecution against him, lodged a complaint

before the plice vigilance department at haldwani district

nainital on 9.01.2020 and to SSP Almora on 29.02.2020,

whereby prayed to lodge an FIR against some of the

persons belongs to the aforesaid school management. For

kind perusal of this hon’ble court a true photo and typed

copy of complaint dated 09.01.2020 and to SSP Almora

dated 29.02.2020 are being filed herewith and marked as

Annexure no. 2 and 3 respectively.

6. That after lodging of the aforesaid FIR, the applicant

surrendered before the learned court below and applied

for bail before the learned trial court and the learned

court granted him interim bail on 20.03.2021. For kind

perusal this Hon’ble Court a true copy of the order dated

20.03.2021 is being filed herewith and marked as

Annexure no. 3 to this application

7. That thereafter the investigation started in the matter

and the I.O. filed chargesheet against the applicant for

the offences punishable under section 504, 506 and 509

 of IPC and under section 3(2)(va) of the SCST Act

(Prevention of Attrocities) Act, For kind perusal of this

Hon’ble Court a true certified and typed copy of the

chargesheet is being filed and marked herwith as

Annexure no. 4.

8. That the investigating officer investigate the matter in a

superficial manner and filed the chargesheet in a routine

way in this case. In the brief facts of the case mentioned

at paragragh no. 16 of the chargesheet the IO has

nowhere mentioned that what was the clinch evidence

against the applicant on which basis the chargesheet is

filed in the matter, thus the chargesheet is cryptic in

nature and as such is liable to be quashed by this

Hon’ble Court.

9. That after filing chargesheet, the learned special court i.e,

the additional session judge Almora took cognizance in

the matter on 23.01.2023 and summoned the applicant

to face trial of the offences punishable u/s 504, 506, 509

of IPC and u/s 3(2)(va) of ST/SC (Prevention of Atrocities)

Act, 1989. For kind perusal of this Hon’ble Court a true

certified and typed copy of the chargesheet is being filed

and marked herwith as Annexure no. 5.

10. The Learned Special Court summoned the applicant by

one line order, without discussing this fact that what

evidence produced by the I.O. against the applicant in

regards to his involvement in the offence and how the

 applicant is liable to be summoned to face the trial for

the same, hence the order of cognizance is not

sustainable in the eyes of law being cryptic in nature and

as such is liable to be quashed by this Hon’ble Court by

excersing its inherent jurisdiction under section 482 of

CrPC.

11. That as it has already being stated the instant

procecution has being lodged against the applicant only

because much prior to the loding of the instant

procecution against him, he moved continous complaits

to the authorities in regards to irregularities and

illegalities being committed by the school management in

running the school. The applicant on 23.12.2019 moved

a complaint to this regard to the chief secretary of the

State of Uttarakhand whereby prayed to take the legal

action against the culprits. For kind perusal of this

Hon’ble Court a true copy of complaint along with postal

receipt is being filed herewith and marked as Annexure

no. 6.

12. That the F.I.R. against the applicant is totally false and

concocted and lodged by the opposition in a pre- planned

manner with a malicious intention due to enmity,

however the applicant has never committed any offence

as alleged by the opposite party no. 2 in her F.I.R.

13. That the entire proceedings against the present applicant

in view of the above facts and circumstances are

malicious and not tenable in the eyes of law and the

same has been instituted just to wrecking vengeance due

to personal and private grudge, and therefore the entire

proceedings are liable to be quashed in light of the

landmark judgment of Hon’ble Apex Court in the case of,

“Chaudhary Bhajan Lal Vs. State of Haryana, 1992,

Supreme Court”.

14. That in view of the facts and circumstances of the case

have been disclosed in the accompanying criminal misc.

application, it is expedient and necessary in the interest

of justice that this Hon’ble Court may graciously be

pleased to quash and set aside the Arising out of entire

proceedings in special session trial No. 04/2023 in

chargesheet no. 23/2022 dated 25.11.2022 submitted by

investigating officer, Chalani Thana- Lamgara District

Almora and in FIR no. 25/2022 Chalani Thana-

Lamgara, District Almora and the order of cognizance

dated 23/01/2023 issued by the learned court of

Additional Session Judge Almora, whereby the applicant

is summoned to face trial for the offences punishable

 under section 504, 506, 509 of IPC and under section 3

(2) (va) SC/ST (Prevention of Attrocities) Act.
