This deed of trust is executed on this …. Day of …….by Fr. A.


Selvaraj, S/o. Antony Pillai. Aged 83, residing at Clergy Home, Christu
Nagar, Agastheeswaram Taluk, Kanyakumari District, Tamilnadu
(Aadhaar No:868052300937) the founder and the author of the trust who
is creating the trust “Fr. A. Selvaraj, Charitable Trust”.
The founder and the author of the Trust have nominated the following
members as executive members of the trust and they have also agreed to
hold office. The founder and the author of the trust who hereinafter will
act as a “Managing Trustee”. The board of Trustees shall consist of
members who are;
1. Fr. A. Selvaraj S/o. Antony Pillai. Aged 83, residing at Clergy
Home, Christu Nagar, Agastheeswaram Taluk, Kanyakumari
District, Tamilnadu. (Aadhaar No:868052300937). The founder
author of the trust.
2. Mr. M. Udaya Selva Dhas, S/o Maria Dhas, 442, Jothi Street,
Christu Nagar, Nagercoil, Agastheeswaram Taluk,
Kanyakumari.629003.

3. Mr. F. Lawrence, S/o Francis, 14E/ H1A Dr. Maria Johnson Street,
Carmel Mount Road, Nagercoil-629004, Kanyakumari District.

The wish of the founder and the author of the trust is after the life
time of the founder managing trustee, the present Treasurer who is
also one of the trustee Mr. F. Lawrence, S/o Francis, will take the
charge of the managing trustee and continue till his life time and
the secretary M. Udaya Selva Dhas, S/o Maria Dhas who is also
one of the trustee will continue as secretary till his life time and
other trustee`s will be elected as per the norms of the trust deed.
After the lifetime of the managing Trustee/Autor the treasurer Mr.
F. Lawrance will be elevated on the managing Trustee/Author. The
family members of the founder/ author have no right over the
Trust. Likewise the R.C Diocese also have no right over the trust.
Managing trustee is having the right to finalise the name of the
beneficiaries.
Whereas as follows with the aim of doing Education do there Charitable
Services among the poor people we hereby create the Charitable Trust
with the following terms and conditions.
1. Name of the trust: Fr. A. Selvaraj Charitable Trust.
2. Office of the Trust: 299/B, Clergy Home, Christu Nagar,
Nagercoil Village, Agastheeswaram Taluk,
Kanyakumari District, Tamil Nadu (Rental
building).
3. Object of the Trust:
 The author will operate the trust till his death.
 After the death of the author Mr. F. Lawrence, S/o Francis, the
present Treasurer will become the author of the trust and he
continue till his life time. Likewise Mr. M. Udaya Selva Dhas,
S/o Maria Dhas, the present Secretary will also continue in the
same position till his life time, Other trustees will be elected as
per the Provisions of the Trust.
 The fund should be used ultimately for Higher education of
very poor and clever children of any caste or religion.
 The Board of Trustee shall have the powers to make and alter
or amend the rules and regulations.
 The Trust is irrevocable; the income of the trust shall solely be
utilized for the object of the trust.
 The beneficiaries of the trust shall be public and general
irrespective of caste, creed and sex.

4.The Funds of the Trust


It shall comprise properties and assets herein after following.

 The amount of Rs.1000/- made as contribution by the


founder of the trust. There is no immovable or movable
properties in the name of the trust at present.
 The properties and the assets including cash that may be
contributed or collected from the Friends & Relatives.
 Properties movable and immovable, which the trust may buy
(or) received as donation.
 Income from properties, which the trust may receive in
future.
 Gift and contribution made by members of the trust.
5.Management of the Trust
 The management of the trust shall vest in a board of
Trustees, the Board shall have all the powers incidental to
and necessary for carrying out the administration of the
trust.
 The present of trustees shall consist of 6 Members, who
subscribe their names in this trust deed. The members of
the board are competent to contract; they shall hold office
for 5 years.
 At the end of the period of 5 years, the trustee except the
managing trustee and secretary shall be elected by the
members of the board.
 If any vacancies arise in the office of the executive
committee it shall be filled up by election of members
among the trustee and he will hold office for the
remaining period of the trustees.
 The founder and the author of the trust Fr. A. Selvaraj
shall be managing Trustee and President.
 The Managing Trustee shall administer the trust with full
power.
 The Board of Trustees shall meet once in 3 months.
 The Board of Trustees can appoint sub committee and
regulate the function. The sub committee will report to the
board and the decision of board will be final.
 Roll of members of the trust shall be maintained.
 The Board of trustees verified all accounts of receipts and
expenditures.
 All documents executed by or in favour of the trust shall
be represented by the Managing Trustee.
 Quorum for the meeting shall be 60%.
6.Finance of the Trust
 The Board of the Trustees has the power to convert, sell
or otherwise dispose off any investments, movable,
immovable properties of the trust and reinvest or change
the nature of investment.
 Bank account opened in the name of the trust. It shall be
operated by the Managing trustee.
 Proper books of accounts shall be maintained and it shall
be audited by a Charted Accountant to be appointed by
the Board of Trustee.
 The financial year of the Trust shall be 1 st April to 31st
March every year.
 The Board have the powers to borrow money, to raise
loans either by mortgaging trust properties or otherwise
for the purpose of carrying out the objects of the trust.
 The trust can raise any amount of donation, which may be
duly acknowledged by issuing receipt.
7. Trust Fund
 Maximum fund will be received from the family
members. Trustees may collect further contributions in
cash or kind towards its Corpus Fund or General Fund
or Capital Fund or Revenue Fund or Earmarked Fund
or any other specific fund.
 Where the income and other receipts exceed the
expenditure of the trust, the surplus funds may be
transferred to Corpus Fund or General Fund or Capital
Fund or Revenue Fund or Earmarked Fund or any other
specific fund.
 The income and other receipts of the trust shall be used
to defray the capital and revenue expenses of the trust.
Where such income or receipts and insufficient to meet
the expenses of trustee may use such portion of the
Corpus Fund or General Fund or Capital Fund or
Revenue Fund or Earmarked Fund necessary for the
attainment of the objectives state in the object clause.
 The trustees shall use the trust funds and assets for the
benefit of General Public in INDIA without
discrimination as to sex, nationality, religion, caste,
creed, language or any other cause.
 The funds of the trust will be invested in such manner as
prescribed under section 11(5) read with section 13(1)
(d) of the income Tax Act,1961 as amended from time
to time.
8.Application of Income
 The income from property of the trust if any, will be
applied solely for the promotion of the objects of
trust as set forth in the object clause and no portion
thereof shall be paid or transferred directly or
indirectly by the way of profits dividends, interest,
bonus to other wise to any persons provided nothing
herein shall percent the payment in food faith or
remuneration to the officers, servant or employees of
the trust and other person in return of the services
rendered to the trust.
 It shall be absolutely in the discretion of the
Managing Committee to decide from time to time as
to for which objects and purposes specified in the
object clause hereof the entire corpus of the trust or
net income of the trust property or portion(s) of
either shall be utilized paid or spent by them and also
the terms conditions, durations and the manner in
which the same shall be so utilized paid or spent
subject however to the conditions that income of
corpus of the trust shall be spent applied exclusively
for such object and purpose only in INDIA.
 The interest of the deposited fund will be taken
out every year and given to the selected
beneficiary.
9. Function, Power of the Office Bearers
Managing Trustee
The Managing Trustee will be the President of the Trust.
He shall have all the powers to carry on the day to day activities,
administration of the trust, he will represent in all Court,
Government and other Public Officer. He shall convene and
preside over all the meeting of the board of the trustees and trust
activities in consultation with the secretary.

Secretary
The secretary shall convene all the meeting of the board of
trustee as directed by the Managing Trustee, record its
proceedings. All the records related to trust should be in the office
of the managing trustee/author.

Treasurer
The Treasurer will be responsible for all the accounts,
receipts and acknowledgement.
Except to the terms and conditions mentioned in the trust deed, for
all other required terms, condition and other provisions which are
not discussed and stated in the trust deed Indian Trust Act 1882
will be applicable.
